Przedmiotem glosy jest uchwała składu siedmiu sędziów Sądu Najwyższego z dnia 8 maja 2024 r., III CZP 142/22, odnosząca się do ustalenia odszkodowania przez zakład ubezpieczeń na rzecz poszkodowanego z tytułu umowy ubezpieczenia odpowiedzialności cywilnej posiadaczy pojazdów mechanicznych. Uchwała ta dotyka problematyki dopuszczalności zastosowania przez zakłady ubezpieczeń ulg (upustów) i rabatów przy ustaleniu wysokości odszkodowania za szkodę w pojeździe mechanicznym poszkodowanego. Przedmiotowa kwestia ma istotne znaczenie dla praktyki ubezpieczeniowej, gdyż od kilku lat trwa polemika na temat dopuszczalności podejmowania tego typu działań przez zakłady ubezpieczeń – zarówno w orzecznictwie sądów powszechnych, jak i w rozważaniach doktryny. Niejednolita praktyka ubezpieczeniowa doprowadzała po wielokroć do ustalania odszkodowań w niższej wysokości, aniżeli przedstawione rzeczywiste koszty naprawy pojazdów, a to z kolei rodziło spory na linii: poszkodowany – zakład ubezpieczeń. Glosa odnosić się będzie wyłącznie do dwóch tez uchwały z dnia 8 maja 2024 r., gdyż do złożenia glosy do publikacji nie doczekaliśmy się publikacji jej uzasadnienia.The subject of this gloss is the judgment of the Supreme Court of 8 May 2024, reference III CZP 142/22, concerning the determination of compensation to be paid by an insurance company to the injured party under a civil liability insurance contract for owners of motor vehicles. The judgment addresses the question whether is admissible that insurance companies apply discounts when determining the amount of compensation for the injured party's motor vehicle. The issue in question is of significant importance for insurance practice, as for several years the admissibility of this type of activities by insurance companies has been raised in the jurisprudence of common courts and it also has been subject of considerations in the doctrine. Ununified insurance practice often led to compensation being set at a lower amount than the actual costs of vehicle repair, which in turn gave rise to disputes between the injured party and the insurance company. The gloss only refers to two theses of the judgment of 8 May 2024, as the statement of reasons thereof has not been published upon submitting this gloss for publication

The subject of the gloss is the thesis of the resolution of a bench of 7 judges of the Supreme Court of 15 January 2025, issued as a result of the referral pursuant to Article 39817 § 1 of the Code of Civil Procedure by the Supreme Court’s decision of 20 November 2024 (reference number II CSKP 1372/22) of the following legal issue - whether in the case of indexation, pursuant to Article 3571 § 1 of the Civil Code, of the limit of liability specified in the compulsory civil liability insurance contract for motor vehicle owners, resulting from provisions no longer in force providing for a lower amount than the provisions in force at the time of the ruling, the indexation criterion is the current amount of the sum guaranteed for compulsory civil liability insurance contracts for motor vehicle owners, specified in the provisions in force at the time of the ruling. This resolution touches on the issue of adopting the criteria of an extraordinary change of circumstances for the application of the rebus sic stantibus clause. The issue in question is of significant importance for insurance practice, as there are increasingly frequent cases of drivers of motor vehicles causing damage exceeding the statutory minimum limit of liability, which (in theory) constitute the upper limit of the insurer’s liability. The inconsistent insurance practice has often led to the refusal to apply the rebus sic stantibus clause in relation to increasing the guarantee amounts, which in turn has given rise to disputes between the injured party and the insured party and the insurance company. The commentary will refer exclusively to the thesis of the resolution, as the justification of the judgment has not yet been submitted for publication. Nevertheless, due to the fact that the resolution under discussion touches on such an important issue from the point of view of protecting injured parties, in the author’s opinion it is necessary at this stage to publish selected considerations that are of potential interest, and perhaps even future argumentation of the Supreme Court.Przedmiotem glosy jest teza uchwały składu 7 sędziów Sądu Najwyższego z dnia 15 stycznia 2025 r. wydana wskutek przekazania na podstawie art. 39817 1 k.p.c. postanowieniem Sądu Najwyższego z dnia 20 listopada 2024 r. (sygn. Przedmiotowa kwestia ma istotne znaczenie dla praktyki ubezpieczeniowej, gdyż coraz częściej zdarzają się przypadki spowodowania przez kierujących pojazdami mechanicznymi szkód wartościowo przewyższających ustanowione ustawowo minimalne sumy gwarancyjne, stanowiące (w teorii) górny limit odpowiedzialności ubezpieczyciela. Niejednolita praktyka ubezpieczeniowa doprowadzała po wielokroć do odmowy zastosowania klauzuli rebus sic stantibus w odniesieniu do podwyższenia sum gwarancyjnych, a to z kolei rodziło spory na linii poszkodowany–ubezpieczony–zakład ubezpieczeń. Glosa odnosić się będzie wyłącznie do tezy uchwały, gdyż do złożenia glosy do publikacji nie doczekaliśmy się jeszcze uzasadnienia orzeczenia. Jednak z uwagi na to, że glosowana uchwała dotyka tak ważnej problematyki z punktu widzenia ochrony poszkodowanych, w ocenie autora konieczna jest już na tym etapie publikacja wybranych rozważań pozostających w sferze potencjalnego zainteresowania, a może i przyszłej argumentacji Sądu Najwyższego
Gloss to the judgment of the Supreme Court of 12 May 2023, IICSKP 885/22
Zagadnienie potencjalnych roszczeń w przypadku wyrządzenia szkody na osobie oraz naruszenia praw pacjenta doczekało się dość pokaźniej liczby orzeczeń sądowych oraz licznych opracowań naukowych. Glosowanym orzeczeniem swoje stanowisko w tym zakresie zajął także Sąd Najwyższy, przyjmując, że zadośćuczynienie oparte na art. 448 k.c. w zw. z art. 4 ust. 1 ustawy z dnia 6 listopada 2008 r. o prawach pacjenta i Rzeczniku Praw Pacjenta jest samodzielnym i odrębnym żądaniem od roszczenia o zadośćuczynienie wywodzonego z tytułu szkody na osobie i opartego na art. 445 § 1 kodeksu cywilnego. Celem niniejszej glosy jest aprobata analizy rozstrzygnięcia SN.The issue of potential claims in the event of personal injury and violation of patient rights has been the subject of quite a large number of court decisions and numerous scientific studies. In a commented judgment, the Supreme Court also expressed its position in this respect, assuming that compensation based on article 448 of the Civil Code in connection with article 4 section 1 of the Act of November 6, 2008 on patient rights and the Patient Ombudsman is an independent and separate claim from the claim for compensation for personal injury based on article 445 § 1 of the Civil Code. Going Beyond Counting First Authors in Author Co-citation Analysis
The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation
counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed
Variations on the Author
“Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship
Appropriate Similarity Measures for Author Cocitation Analysis
We provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature. Dispelling the Myths Behind First-author Citation Counts
We conducted a full-scale evaluative citation analysis study of scholars in the XML research field to explore just how different from each other author rankings resulting from different citation counting methods actually are, and to demonstrate the capability of emerging data and tools on the Web in supporting more realistic citation counting methods. Our results contest some common arguments for the continued
use of first-author citation counts in the evaluation of scholars, such as high correlations between author rankings by first-author citation counts and other citation
counting methods, and high costs of using more realistic citation counting methods that are not well-supported by the ISI databases. We have done our best to complete the author checklist relating to the use of animals in the hut study. Note that the objective for the hut study was to evaluate the IRS treatment applications for residual efficacy against Anopheles mosquitoes, including the local An. coluzzii mosquito population. Cows were only used to attract mosquitoes into the huts and no tests were carried out directly on the cows. The author checklist is intended for use with studies where experiments are carried out on animals, which is why we have had such difficulty in completing this for the hut study, as many of the questions do not relate to how the cows were used
