Going Beyond Counting First Authors in Author Co-citation Analysis
Full text linkThe present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation
counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed

No full textOpracowanie omawia jeden z problemów związanych z prawem wydawców prasy przewidzianym przez normy Dyrektywy 2019/790, a mianowicie zagadnienie interpretacji pojęcia „dostawcy usług społeczeństwa informacyjnego”. Analiza prowadzi do wniosku, że pojęcie to powinno być rozumiane w sposób szeroki i obejmować także podmioty niewynagradzane przez odbiorców świadczonych przez nich usług, lecz finansujące swoją działalność z innych źródeł, jak również podmioty, które z tytułu korzystania z publikacji prasowej osiągają znikome przychody lub nie osiągają ich w ogóle.The study discusses one of the problems related to the right of press publishers provided by the rules of Directive No. 2019/790, namely the issue of interpretation of the notion of “information society service provider”. The analysis leads to the conclusion that this concept should be understood in a broad way and should also include entities that are not remunerated by the recipients of the services they provide, but finance their activities from other sources, as well as entities that earn little or no revenue from the use of a press publication
Przedmiot i podmiot prawa do wizerunku
Full text linkWizerunek człowieka stał się przedmiotem zainteresowania prawników i ustawodawców pod koniec XIX w. W Stanach Zjednoczonych zakaz rozpowszechniania wizerunku człowieka jest jedną z płaszczyzn ochrony jego prywatności (right to privacy). W Niemczech zaś wizerunek jest chroniony jako osobne dobro osobiste, niezależne od innych (cześć, kult pamięci osoby zmarłej). W prawie polskim prawo do wizerunku pojawiło się już w ustawie o prawie autorskim z 1926 r. Obecnie wizerunek jest chroniony zarówno przez kodeks cywilny (art. 23 w zw. z 24 k.c.), jak i przez prawo autorskie (art. 81 pr.aut.). W doktrynie nie występuje jedna powszechnie aprobowana definicja pojęcia "wizerunek", jest ono przedmiotem sporów. Na uwagę zasługuje propozycja wyróżnienia pięciu osobnych pojęć, a mianowicie: podobizny, wizerunku, portretu, materialnego egzemplarza i "persony". Zagadnieniem kontrowersyjnym jest również to, czy wizerunek, o którym mowa w art. 23 k.c., należy definiować tak samo, jak na gruncie art. 81 pr.aut. Wizerunek, w przeciwieństwie do innych dóbr osobistych, charakteryzuje się dużą zmiennością (w zależności od wieku, charakteryzacji, pozy osoby przedstawionej). Dla uzyskania ochrony przed sądem konieczne jest, aby osoba przedstawiona była rozpoznawalna na wizerunku. Sporne jest jednak, jak szeroki musi być krąg osób niezbędny dla przyjęcia tej rozpoznawalności, jak i zakres elementów, cech koniecznych dla identyfikacji. Z pojęciem wizerunku związany są też takie zagadnienia, jak relacja, w jakiej pozostaje on do maski artystycznej (artystycznego wykonania) czy karykatury. Na uwagę zasługują również nowe propozycje takie jak: wizerunek piśmienniczy, czy audialny (dźwiękowy), co do których postulowane jest stosowanie art. 81 pr.aut. per analogiam. Obok wizerunku osoby fizycznej, w doktrynie prawniczej innych państw występuje także pojęcie wizerunku osoby prawnej, co jednak nie znalazło uznania w nauce polskiej. Variations on the Author
Full text link“Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship
Appropriate Similarity Measures for Author Cocitation Analysis
Full text linkWe provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature. Permissibility of acquisition of ownership of author's economic rights not belonging to the bankrupt by a third party and the principle of nemo plus iuris
No full textThis study attempts to answer the question of whether it is possible for a third party to acquire, as a result of bankruptcy proceedings, the economic copyright in a work erroneously considered part of the bankruptcy estate. The first part of the paper deals with the principle of nemo plus iuris… and the exceptions to it, including those relating to economic copyright. The second part of the paper discusses the effect of the acquisition of property or rights as a result of enforcement proceedings and then as a result of bankruptcy proceedings. The third part presents the basic arguments in favor of the possibility of acquiring the rights in question as a result of the bankruptcy proceedings, even though they did not actually belong to the bankrupt, as well as the arguments against this thesis. Consideration of these arguments has led to the conclusion presented in the conclusion of the publication. The issue in question had not previously been discussed in this form in the legal doctrine
Dispelling the Myths Behind First-author Citation Counts
Full text linkWe conducted a full-scale evaluative citation analysis study of scholars in the XML research field to explore just how different from each other author rankings resulting from different citation counting methods actually are, and to demonstrate the capability of emerging data and tools on the Web in supporting more realistic citation counting methods. Our results contest some common arguments for the continued
use of first-author citation counts in the evaluation of scholars, such as high correlations between author rankings by first-author citation counts and other citation
counting methods, and high costs of using more realistic citation counting methods that are not well-supported by the ISI databases. It is argued that increasingly available digital full text research papers make it possible for citation analysis studies to go beyond what the ISI databases have directly supported and to employ more

do których prawa autorskie majątkowe zostały nabyte w wyniku postępowania
upadłościowego przez nabywców tych praw. Rozstrzygnięcie
tego zagadnienia wymagało odpowiedzi na pytanie, czy i po spełnieniu
jakich wymogów syndyk w wyniku postępowania upadłościowego
może przenieść na osobę trzecią prawo zezwalania na wykonywanie
praw autorskich zależnych. Ponadto niezbędne było określenie, jaki
wpływ na korzystanie z opracowań przez nabywcę prawa zezwalania
na wykonywanie praw autorskich zależnych mają prawa autorskie
osobiste, a przede wszystkim prawo do integralności utworu. Przeprowadzona
analiza dostarczyła wniosków mających znaczenie zarówno
teoretyczne, jak i praktyczne.The subject of this study is the assessment of the possibility for the
purchasers of dependent works (developments) made on the basis of
works whose economic copyrights have been acquired as a result
of bankruptcy proceedings to use these rights. The resolution of this issue
required an answer to the question of whether, and upon fulfilment
of which requirements, a trustee as a result of bankruptcy proceedings
may transfer to a third party the right to authorise the exercise of derivative
copyrights. In addition, it was also necessary to determine what
effect personal copyrights, above all the right to the integrity of the
work, had on the use of the works by the purchaser of the right to authorise
the exercise of subsidiary copyrights. The analysis carried out
