Характеристика окремих видів адміністративних актів за новітнім законодавством України про адміністративну процедуру
Get PDFThe relevance of the study of types of administrative acts is determined primarily by the fact that an administrative act as the main tool of activity, recognized by the provisions of the Law of Ukraine "On Administrative Procedure", although it is accepted (performed) daily by all subjects of public administration exercising public power in the relevant spheres of public life , the forms of their external and legal expression, the cases, grounds and order of their acceptance (commitment), the matters on which they are accepted (committed), as well as their focus on the acquisition, change, termination or realization of rights and/or obligations differ, provided by the current legislation of a private person. Taking into account the arrangement and systematization of administrative acts, it seems possible only with the help of their classification. In this regard, the purpose of the article is to identify and research the types of administrative acts provided for in the legislation of Ukraine on administrative procedure, and their theoretical and legal analysis. Research methods include general and special methods of scientific knowledge, the method of system analysis, the dialectical method, formal-logical methods, structural-functional and comparative-legal methods, as well as a number of empirical methods, which ultimately made it possible to determine and analyze existing approaches to distinguishing types of administrative acts , to carry out their comparative characteristics, as well as to characterize the provisions of the legislation on administrative procedure regarding the definition of types of administrative acts. As a result of the conducted research, the classification of administrative acts was carried out according to the form of acceptance (commitment); according to the method of production (formation); by direction of content; according to the nature of the effect of administrative acts; depending on the number of persons to whom the administrative act applies; according to the quality of the execution of administrative acts, and their theoretical and legal analysis was carried out taking into account the provisions of the latest legislation on administrative procedure. It is substantiated that the potential of the classification of administrative acts is also revealed in the fact that, with its help, it seems possible to distinguish administrative acts from other instruments of activity of public authorities, in particular, regulatory acts and administrative contracts, and political decisions, official orders, etc. This proves that the classification of administrative acts is a promising direction for further scientific research. At the same time, it was noted that the principle in the aspect of research of types of administrative acts is the applied orientation of the proposed classifications and the support of each of the selected types of administrative acts with specific examples.Актуальність дослідження зумовлено насамперед тим, що адміністративний акт як основний інструмент діяльності, визнаний положеннями Закону України «Про адміністративну процедуру», хоча і приймається (вчиняється) щоденно усіма суб’єктами публічної адміністрації, що здійснюють публічну владу у відповідних сферах суспільного життя, проте розрізняється з огляду на передбачені чинним законодавством форми їх зовнішнього та юридичного вираження, випадки, підстави та порядок їх прийняття (вчинення), питання, з яких вони приймаються (вчиняються), а також їх спрямованість на набуття, зміну, припинення чи реалізацію прав та/або обов’язків приватної особи. Здійснення упорядкування та систематизації адміністративних актів видається можливим виключно за допомогою їх класифікації. Метою статті є виокремлення та дослідження видів адміністративних актів, передбачених у законодавстві України про адміністративну процедуру, та їх теоретико-правовий аналіз. Методи дослідження включають загальні та спеціальні методи наукового пізнання, метод системного аналізу, діалектичний метод, формально-логічні методи, структурно-функціональний та порівняльно-правовий методи, а також низку емпіричних методів, що зрештою дали змогу визначити та проаналізувати наявні підходи до виокремлення видів адміністративних актів, здійснити їх порівняльну характеристику, а також охарактеризувати положення законодавства про адміністративну процедуру стосовно визначення видів адміністративних актів. Проведено класифікацію адміністративних актів за формою прийняття (вчинення); за способом вироблення (формування); за спрямованістю змісту; за характером дії адміністративних актів; залежно від кількості осіб, на яких поширюється адміністративний акт; за якістю вчинення адміністративних актів, та здійснено їх теоретико-правовий аналіз з урахуванням положень новітнього законодавства про адміністративну процедуру. Обґрунтовується, що потенціал класифікації адміністративних актів також виявляється у тому, що за її допомогою видається можливим відокремлення адміністративних актів від інших інструментів діяльності суб’єктів публічної влади, зокрема нормативних актів та адміністративних договорів, та політичних рішень, службових розпоряджень тощо. Встановлене засвідчує, що класифікація адміністративних актів є перспективним напрямом подальших наукових досліджень. Зазначено, що принципом в аспекті дослідження видів адміністративних актів є прикладна орієнтованість запропонованих класифікацій та супроводження кожного із виокремлених видів адміністративних актів конкретними прикладами
Going Beyond Counting First Authors in Author Co-citation Analysis

counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed
Variations on the Author
Get PDF“Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship
Appropriate Similarity Measures for Author Cocitation Analysis
Get PDFWe provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature. Note that the objective for the hut study was to evaluate the IRS treatment applications for residual efficacy against Anopheles mosquitoes, including the local An. coluzzii mosquito population. Cows were only used to attract mosquitoes into the huts and no tests were carried out directly on the cows. The author checklist is intended for use with studies where experiments are carried out on animals, which is why we have had such difficulty in completing this for the hut study, as many of the questions do not relate to how the cows were used
