The article analyzes the humanitarian protection news contained in the law 132/2018. The changes introduced pose some interpretive problems on the tem- poral effects of the repeal of humanitarian protection and their impact on the right to asylum under article 10.3 of the Italian Constitution. The paper focuses, in particular, on the relationship between humanitarian protection and the right to asylum, highlighting the need for the intervention of the Italian Constitutional Court, in order to participate in the construction of a common European right of asylum

The contribution deals with the issue of the display of religious symbols in public schools, where different religious and cultural traditions coexist, retracing the main stages of the jurisprudential path on the subject of displaying the crucifix in schools, both nationally and internationally, with particular regard to the sentence of the Court of Cassation, United Sections, of 2021, which seems to dissolve some problematic issues that remained unresolved in the previous jurisprudence, highlighting how the 'supplement' activity of the judges is insufficient, because it leaves some empty spaces open which would require the intervention of the legislator and the political class represented by it
La moral suasion del Presidente della Repubblica nella forma di governo italiana
The book shall analyse the moral suasion of the President of the Republic, with a particular regard to informal relationships with the Parliament and Government, both political institutions in the Italian legal order. In particular, the monograph focuses on the analysis of the different instruments underpinning moral suasion, as well as their effects and implications on the President’s formal powers of control, constitutional guarantee, and those related to political decisions under articles 92 and 88 of the Constitution. The overall aim of the book is to highlight the interconnection between the President’s influence activity and his role and figure in the Italian form of government

The paper analyzes the origins and characteristics of the differentiated re- gionalism referred to in art. 116.3 of the Constitution, highlighting the impact that its implemen- tation could have in Title V of the Constitution, in relation to both ordinary regions and regions with special status. The widespread nature of differentiated regionalism could, in particular, lead to the definitive, tough gradual, overcoming of regional uniformity, towards a model of mainly differentiable regionalism

The paper analyzes the role of the Head of State's influential judiciary in the formation of the Government, both following new political elections and in the management of government crises. As is well known, the Head of State, in order to carry out his activity of moderation, persuasion and stimulus towards the political bodies, has combined the formal presidential powers with informal tools and procedures of moral suasion. The informality of the aforementioned activities and procedures has allowed a greater margin of intervention and influence of the President of the Republic in the exercise of his functions of political intermediation, during the phases of government crisis management and formation of the new government, compared to what is allowed to him by the powers constitutionally attributed to him. In this regard, the Mattarella presidency has recorded both a line of continuity with the past, through the use of confidential communications, to dialogue with the political and parliamentary forces, in order to identify the political personality on which the consensus converged and to whom to entrust the task for the formation of the government, and some significant innovations consisting in the choice of informal tools of presidential persuasion that President Mattarella wanted to make public, breaking that aura of confidentiality that has always characterized the aforementioned presidential power in republican history. Despite the extension, or rather, the adaptation of presidential powers to the political, economic and social context, the interpretation of the role of the Head of State, during the formation of the Government by the President of the Republic Sergio Mattarella, is overall constitutionally oriented

In this interview, Carla Trujillo discusses her roots, which include being born in New Mexico and growing up in Northern California. Carla received her M.S. and Ph.D. degrees in Educational Psychology from UW-Madison and became an established author. It will help determine which audio file(s) to download & listen to.Carla Trujillo was born to a working class family in New Mexico and grew up in Northern California. Her extended family and roots are New Mexican (Chicana). She received her B.S. degree in Human Development from UC Davis, and her M.S. and Ph.D. degrees in Educational Psychology from the University of Wisconsin, Madison. Her dissertation focused on assessing differential treatment of underrepresented students in college classrooms. She is the editor of Living Chicana Theory and Chicana Lesbians: The Girls Our Mothers Warned Us About (Third Woman Press), winner of a Lambda Book Award and the Out/Write Vanguard Award. Her first novel, What Night Brings (Curbstone Press 2003), won the Miguel Marmol prize focusing on human rights. What Night Brings also won the Paterson Fiction Prize, the Latino Literary Foundation Latino Book Award, Bronze Medal from Foreword Magazine, Honorable Mention for the Gustavus Meyers Books Award, and was a LAMBDA Book Award finalist. Carla has also written various articles on identity and higher education. Her latest novel, Faith and Fat Chances, was a finalist for the 2012 PEN Bellwether Prize for socially engaged fiction and is forthcoming from Curbstone/Northwestern University Press. Carla works as the Assistant Dean for Graduate Diversity Program at U.C. Berkeley and has focused some of her recent activities on improving the work and classroom climate using Interactive Theater. She has lectured in Ethnic Studies at U.C. Berkeley and Mills College, and in Women’s Studies at S.F. State University. She has also taught fiction for the Sandra Cisneros Macondo Writers Program and the Lambda Literary Foundation’s Emerging Writers Program
