    When Culture Touches an Object: The U.S. Antiquities Act as an Antiquated Tool: Case Study of Bears Ears National Monument

    For many, national monuments represent an excellent tourist place or a space packed with extractive resources that need to be exploited. For many Indigenous peoples, these areas contain a spiritual connection that needs to be preserved. Bears Ears national monument is an example of that cultural heritage encapsulated in a landscape. This paper analyzes the Antiquities Act and the powers that directly or indirectly “emanate” in favor of the President, Congress, and Native Nations in the United States. The aim is to question the presidential and congressional power over national monuments on Indigenous ancestral territories. By doing so, this paper will move from an “object” paradigm to a “cultural” paradigm, understanding national monuments as cultural spaces. I will question the faculty of determination and reduction of national monuments and the possibility of incorporating a substantial co-management of these areas between agencies and Native nations.     La industria minera está presente en el Perú desde el inicio de su historia y la promoción de su ejecución sigue generando un impacto positivo en nuestra economía hasta la fecha. Por esta razón, profundizar el estudio jurídico de las figuras administrativas que la conforman cobra una alta importancia. Bajo esta premisa, desde un punto a nivel doctrinario, se ha enfatizado el estudio jurídico de la “concesión minera”, relegando el análisis de otras figuras jurídicas que también se han regulado a efectos de permitir la ejecución del “ciclo minero”. Evidentemente, a partir de un mejor entendimiento de esta industria y los títulos habilitantes que la conformar será posible otorgar a los inversionistas una mayor claridad sobre el desarrollo de esta industria, promoviendo la inversión minera de forma eficiente; y encauzar reformas legislativas que sean consecuencia de un diagnóstico histórico-legal previo, más que solo pinceladas a la regulación minera vigente en base a un análisis casuístico inmediato. Así las cosas, al encontramos frente a un país que debe apostar por la innovación tecnológica y la reducción de la burocracia administrativa, en el sector minero, la “concesión de beneficio” se plantea como una alternativa de solución a efectos de repotenciar este negocio. Sin embargo, poco o nada se ha escrito sobre esta figura administrativa, en la medida que la principal atención de la academia se ha enfocado en la “concesión minera”. Ello a pesar que, es la actividad de beneficio aquella que le otorga un valor agregado al mineral, permitiendo ejecutar una actividad industrial minera con altas ganancias económicas. De esta manera, la presente investigación busca dar el primer paso en el análisis de la “concesión de beneficio” que sin lugar a dudas resulta ser pieza clave en el ciclo minero. Así, a partir de una contextualización del panorama minero, un entendimiento del tratamiento de los recursos naturales mineros y sus títulos habilitantes; y un análisis detallado del devenir histórico-legal que ha regulado a esta figura administrativa; la presente investigación busca elaborar un diagnóstico histórico-legal de este título habilitante, con el objetivo final de determinar la necesidad de su exigencia para la ejecución de un proyecto minero y con ello, identificar las oportunidades de mejora regulatoria desde el derecho, en favor del desarrollo de la industria minera de manera general, y específicamente, respecto a la actividad de beneficio.Tesi

    Este año se cumplen 25 años desde que el Perú ratificó el Convenio No. 169 de la Organización Internacional del Trabajo (OIT), sobre los Derechos de los Pueblos Indígenas y Tribales. Este Convenio tuvo por objetivo, entre otros, el reconocer derechos fundamentales a los pueblos indígenas vinculados con su participación en la vida política de un determinado país. Considerando lo anterior, la polémica sobre la aplicación del procedimiento de consulta previa para proyectos de inversión ha tomado una especial relevancia respecto a su análisis y desarrollo tanto a nivel doctrinal como jurisprudencial. En este contexto, el presente artículo buscará brevemente desarrollar las características del derecho a la consulta y su aplicación en la actualidad. Ello con el objetivo de extrapolar esta aplicación al sector eléctrico, diferenciando los casos en los que se ha ejecutado esta consulta y cuáles no, permitiendo así cuanto menos determinar los aspectos a mejorar y profundizar para la aplicación efectiva y eficiente de este derecho.This year marks 25 years since Peru ratified International Labour Organization (ILO) Convention No. 169 on the Rights of Indigenous and Tribal Peoples. The objective of this Convention was, inter alia, to recognize the fundamental rights of indigenous peoples linked to their participation in the political life of a given country. In view of the foregoing, the controversy over the application of the prior consultation procedure for investment projects has taken on special relevance with regard to its analysis and development at both the doctrinal and jurisprudential levels. In this context, this article will briefly seek to develop the characteristics of the right to consultation and its current application. The objective is to extrapolate this application to the electricity sector, differentiating the cases in which this consultation has been carried out and which have not, thus allowing us to determine at least the aspects to be improved and deepened for the effective and efficient application of this right

    Going Beyond Counting First Authors in Author Co-citation Analysis

    The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed

    “Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship

    Appropriate Similarity Measures for Author Cocitation Analysis

    We provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature.     Dispelling the Myths Behind First-author Citation Counts

    We conducted a full-scale evaluative citation analysis study of scholars in the XML research field to explore just how different from each other author rankings resulting from different citation counting methods actually are, and to demonstrate the capability of emerging data and tools on the Web in supporting more realistic citation counting methods. Our results contest some common arguments for the continued use of first-author citation counts in the evaluation of scholars, such as high correlations between author rankings by first-author citation counts and other citation counting methods, and high costs of using more realistic citation counting methods that are not well-supported by the ISI databases. It is argued that increasingly available digital full text research papers make it possible for citation analysis studies to go beyond what the ISI databases have directly supported and to employ more sophisticated methods
