Application of Islamic Law in Courts

    No full text
From 26 to 28 October 2001, the ISIM, in collaboration with the University of Amsterdam and Cornell University, held an international conference in Leiden on the 'Application of Islamic Law in Courts'. The conference conveners, Muhammad Khalid Masud, Rudolph Peters and David Powers, invited historians, lawyers, anthropologists and sociologists to come to Leiden to engage in a discussion on the manner in which Islamic legal doctrine (fiqh) has manifested itself in daily practice as reflected in the activity of the qadi, or Muslim judge

Communities’ socio-economic status and environmental conservation behaviour in marine protected areas : A study of Malaysia / Muhammad Mehedi Masud

Environmental degradation creates adverse impacts on lives, livelihoods, development of human society and conservation of natural resources especially, for marine protected areas. This study examines the establishment of Marine Protected Areas (MPAs) in Malaysia with specific reference to the Tioman Island Marine Park, The Redang Islnad Marine Park and the Tinggi Island Marine Park off the east coast of Peninsular Malaysia. This study investigated the communities’ wellbeing, their perception on socio-economic development and environmental conservation behaviour (ECB) to recommend an integrated effective management policy framework. In order to achieve the objective of this study, mixed methods were applied. Qualitative method was conducted based on Focus Group Discussion (FGD) and quantitative based on survey questionnaire. After collecting the data, all the statistical analyses were carried out using Statistical Package for the Social Science (SPSS) (22.0 version) and Analysis of Moment Structures (AMOS) (22.0 version). Specifically, SPSS is used for analysing the statistics, testing of assumptions for normality, reliability, exploratory factor analysis and multiple regression analysis. AMOS is used for confirmatory factor analysis (CFA) and full-fledged structural equation modelling (SEM). The study revealed that Marine Park Community identified several vulnerability context to marine park community livelihoods, for instance, price hike for essential goods as the most important problem within MPAs, followed by the increase in waste generation by restaurants and tourists, the quality of water dropped, drought, heat and haze due to climate change and changing their occupation after the establishment of the MPA from fishing to other professions. From the findings of this study, we determined that the local community’s standard of living has important in terms of physical and social assets; but they have a substantial lack of human, financial and environmental iv assets. One of the main attributes of human assets is a community’s education level, yet this study shows that a significant number of respondents do not have formal education. This study found that socioeconomic factors have positive significant impact on environmental awareness, attitudes towards sustainable use of marine resources, and perceived impact of socioeconomic development. This study also revealed that perceived development of human capital (PHCD), perceived development of social capital (PSCD), perceived development of financial capital (PFCD) have greater significant influence on environmental awareness and attitudes and environmental conservation behaviour. It also indicated that environmental awareness and attitudes can play mediating role between perceived socio-economic development and environmental conservation behaviour. Finally, this study found that there is lack of effective management policy framework for management of marine resources. Hence, this study recommended an integrated management policy framework considering social, economic development, environmental issues, management issues and psychosocial factors for the socio-economic development of the local community and conservation of marine resources within MPAs. Therefore, this study will help policy makers to formulate better policies for conserving marine diversity, as well as to improve the socio-economic status of the local community

Rainfall Extremes: a Novel Modeling Approach for Regionalization

    No full text
The rainfall events of extreme magnitude over the past few decades have caused destructive damages to lives and properties, especially in the subcontinent (e.g. Pakistan, India, Bangladesh etc). Rainfall hazard maps for these areas can be of great practical and theoretical interests. In our work, we used extreme value analysis and spatial interpolation techniques to provide such maps through a combination of the Tropical Rainfall Measuring Mission Precipitation (TRMM) 3B42 product and raingauge data. This mixed approach takes advantage of both the long time series available at a limited number of stations, and the large spatial coverage of the satellite data which, instead, has a poor temporal extent. The methodology is implemented by (1) creating a unique growth curve for the homogeneous region by utilizing in-situ rainfall data and (2) mapping the parameters of intensity-duration functions for the entire length of the study area by using TRMM 3B42 product. The regional results obtained by using mixed approach and TRMM 3B42 are compared with the estimates obtained by using in-situ data. The comparison showed that the overall output of mixed approach is more consistent with what transpired by in-situ data for a pre-defined return period

THE ROLE OF MUSIC AND ART IN TAREQUE AND CATHERINE MASUD\u27S FILM MUKTIR GAAN The Bangladeshi documentary Muktir Gaan (Song of Freedom)(1) by Tareque & Catherine Masud earned international recognition as did the directors\u27 autobiographical Maatir Moyna (Clay Bird).(2) The statement of the juries of Film South Asia \u2797 reads: \u27For its powerful recreation of the euphoria of an event long forgotten by the world, the Jury would like to make a Special Mention of the film Muktir Gaan by Tareque and Catherine Masud.\u27(3) The euphoria of victory brought by Bangladesh\u27s Liberation War against Pakistan in 1971 was an event of profound political significance. The author aims to shed light on the form of realism the documentary presents, which is enhanced by its remarkable use of music and cinematic techniques. The discussion also brings out the question of cultural resistance of the Bengalis in what was..

Muslim Jurists' Quest for the Normative Basis of Sharia

    No full text
Muhammad Khalid Masud, ISIM Chair at Leiden University and Academic Director of the ISIM, delivered his inaugural lecture on 'Muslim Jurists' Quest for the Normative Basis of Sharia' on 20 October 2000. In the lecture, he argued that the conception of the S h a r ia as divine law has problematized the binding nature of law in Islam because it conceals its material bases in the social norms. It also obscures Muslim jurists' continuous efforts to maintain general acceptance of Islamic law by bringing the legal norms closer to social norms. He argued that the current debates on the Sharia are also triggered by this conception as it ignores the inner contradictions between legal and social norms emerging in contemporary Muslim societies. The following contains a few excerpts from this lecture

Exploring the new physics phases in 3+1 scenario in neutrino oscillation experiments

    No full text
© 2021, The Author(s).The various global analyses of available neutrino oscillation data indicate the presence of the standard 3 + 0 neutrino oscillation picture. However, there are a few short baseline anomalies that point to the possible existence of a fourth neutrino (with mass in the eV-scale), essentially sterile in nature. Should sterile neutrino exist in nature and its presence is not taken into consideration properly in the analyses of neutrino data, the interference terms arising due to the additional CP phases in presence of a sterile neutrino can severely impact the physics searches in long baseline (LBL) neutrino oscillation experiments. In the current work we consider one light (eV-scale) sterile neutrino and probe all the three CP phases (δ13, δ24, δ34) in the context of the upcoming Deep Underground Neutrino Experiment (DUNE) and also estimate how the results improve when data from NOvA, T2K and T2HK are added in the analysis. We illustrate the ∆χ2 correlations of the CP phases among each other, and also with the three active-sterile mixing angles. Finally, we briefly illustrate how the relevant parameter spaces in the context of neutrinoless double beta decay get modified in light of the bounds in presence of a light sterile neutrino.11Nsciescopu
