    PERTANGGUNGJAWABAN HUKUM KELOMPOK KERJA PEMILIHAN (POKJA) DALAM TINDAK PIDANA KORUPSI PENGADAAN BARANG/JASA PEMERINTAH(Studi Penelitian Daerah Hukum Kejaksaan Tinggi Aceh)Muhammad Kadafi*, Dahlan**, Darmawan***ABSTRAKBedasarkan Pasal 13 ayat (1) Peraturan Presiden (Perpres) Nomor 16 Tahun 2018 tentang Pengadaan Barang/Jasa Pemerintah, Kelompok Kerja (Pokja) pemilihan dalam pengadaan barang/jasa sebagaimana dimaksud dalam memiliki tugas, a. melaksanakan persiapan dan pelaksanaan pemilihan Penyedia, b. melaksanakan persiapan dan pelaksanaan pemilihan Penyedia untuk katalog elektronik; dan c. menetapkan pemenang pemilihan/Penyedia untuk metode pemilihan. Selanjutnya menurut menurut Pasal 84 Perpres ini, dalam hal pelelangan/seleksi/pemilihan langsung dinyatakan gagal, ULP segera melakukan, a. evaluasi ulang, b. penyampaian ulang dokumen penawaran, c. pelelangan/seleksi/pemilihan langsung ulang, d. penghentian proses pelelangan/seleksi/pemilihan langsung. Namun masih ditemukan modus-modus dalam proses e-procurement. Perkara yang terjadi daerah hukum Kejaksaan Tinggi Aceh Pengadaan Barang/Jasa Pemerintah pada 2018, berdasarkan Laporan Hasil Pemeriksaan (LHP) dari Badan Pengawasan Keuangan dan Pembangunan (BPKP) Pusat pada 2019 menunjukkan bahwa telah terjadi indikasi kecurangan yang diduga terkait dengan pelaksanaan e-tender atas pengadaan pekerjaan review design pembangunan terminal pelabuhan penyeberangan Balohan-Sabang 2016. Perkara kedua penyimpangan dalam Pekerjaan Perencanaan Pembangunan Gedung Kanwil Kemenag Provinsi Aceh Tahun 2015 terjadi pada tahap perencanaan anggaran kegiatan, tahap persiapan dan pelaksanaan pemilihan penyedia, tahap pelaksanaan pekerjaan, serta tahap penerimaan dan pembayaran hasil pekerjaan, hal ini menyebabkan kerugian negara sehingga menjadi perkara tindak pidana korupsi.Penelitian ini bertujuan untuk menjelaskan pertanggungjawaban hukum kelompok kerja pemilihan (Pokja) dalam tindak pidana korupsi pengadaan barang/jasa pemerintah, dan penyelesaian tindak pidana korupsi yang dilakukan oleh kelompok kerja pemilihan (Pokja) atas pengadaan barang/jasa pemerintah melalui jejak digital forensik.Jenis penelitian menggunakan yuridis empiris yakni, penelitian terhadap peranan penegak hukum dalam melaksanakan fungsinya, yang membahas bagaimana hukum beroperasi dalam instansi pemerintahan yaitu penegak hukum. Data yang digunakan adalah data primer dan data sekunder. Teknik pengumpulan data menggunakan teknik wawancara dan menelaah dokumen serta Undang-undang terkait dengan penelitian ini. Selanjutnya data diolah dan dianalisa dengan teknik analisis deskriptif kualitatif. Hasil penelitian ini menunjukan bahwa, bentuk pertanggungjawaban hukum kelompok kerja (Pokja) pemilihan dalam tindak pidana korupsi pengadaan barang/jasa pemerintah atas pekerjaan review design pembangunan terminal pelabuhan penyeberangan Balohan-Sabang 2016 yakni, Pokja telah mempertanggung jawabkan segala apa yang telah dikerjakan mulai dari awal pembukaan pelelangan sampai akhir sesuai dengan tahapan pelaksanaan evaluasinya secara administrasi, khususnya dalam pembuktian dokumen, kecurangan yang diidentifikasi telah dimintai keterangan sebagai saksi atas persekongkolan yg dibuktikan dengan pemakaian IP address yang sama setelah dilakukan LHP BPKP. Penyelesaian tindak pidana korupsi yang dilakukan oleh kelompok kerja pemilihan (Pokja) atas pengadaan barang/jasa pemerintah melalui jejak digital forensik dengan cara pembuktian harus ditempuh menggunakan alat bukti digital forensik, yang menentukan keabsahan suatu alat bukti elektronik di persidangan bahwa hakimlah yang menentukan keabsahan alat bukti, maka dari itu alat bukti elektronik yang telah melalui proses kajian oleh digital forensik terkait tindak pidana korupsi akan sangat menentukan untuk meyakinkan hakim dalam memberantas tindak pidana korupsi. Diharapkan adanya peraturan perundang-undangan memuat aturan yang mewajibkan Kelompok Kerja (Pokja) untuk berdiri secara indenpendensi, artinya tidak ada intervensi dari dalam maupun luar atas pelaksanaan tanggung jawab Pokja sehingga dapat memiliki integritas yang tinggi. Selanjutnya, kepada pihak yang terlibat langsung yakni, Pengguna Anggaran (PA)/Kuasa Pengguna Anggaran (KPA), Unit Layanan Pengadaan (ULP), Pejabat Pembuat Komitmen (PPK), dan peserta calon penyedia tidak ikut mencampuri urusan yang menjadi tanggung jawab masing-masing. Furthermore, according to Article 84 of this Press, in the event that the auction/selection/direct election is declared unsuccessful, ULP immediately performs, a. re-evaluation, b. submission of the bidding document, c. auction/selection/re-election, d. termination of the auction/selection/direct selection process. However, there are still modes in the e-procurement process. The case that occurred in the aceh prosecutor's office procurement of government goods/services in 2018, based on a letter from BPKP in 2019 shows that there has been an indication of fraud allegedly related to the implementation of e-tender for the procurement of work reviewing the design of the construction of balohan-sabang crossing port terminal 2016. The second case of irregularities in the Construction Planning Work of the Ministry of Aceh Provincial Development Building in 2015 occurred at the stage of planning the budget of activities, the stage of preparation and implementation of the selection of providers, the stage of implementation of the work, as well as the level of receipt and payment of the work, this caused the loss of the state so that it became a case of corruption.This research aims to find out and explain the legal accountability of the election working group (Pokja) in the criminal corruption of government procurement of goods/services, and the settlement of corruption crimes committed by the election working group (Pokja) for the procurement of government goods/services through a forensic digital footprint.This type of research uses empirical juridical, namely, research on the role of law enforcement in carrying out its functions, which discusses how the law operates in government agencies namely law enforcement. The data used is primary data and secondary data. Data collection techniques use interview techniques and study documents and laws related to this research. Furthermore, the data is processed and analyzed with qualitative descriptive analysis techniques.The results of this study show that, the form of legal accountability of the working group (Pokja) elections in the criminal act of corruption procurement of government goods /services in the case of procurement of goods / services of the Aceh Government on the construction of balohan-sabang port namely, Pokja is responsible for everything that has been done from the beginning of the opening of the auction to the end in accordance with the stages of its evaluation, and specifically in terms of the proof of documents, and if there is fraud about it can be held legally liable, and if there is a conspiracy evidenced by the use of the same IP address. Thus, Pokja may be held accountable according to the law if there is a conformity between the IP address between Pokja and the Prospective Provider. The settlement of corruption crimes committed by the election working group (Pokja) on the procurement of government goods/services through a digital trail of forensics by means of proof must be carried out using a digital forensic evidence tool, which determines the validity of an electronic evidence tool at the trial that the judge determines the validity of the evidence tool, therefore the electronic evidence tool that has gone through the process of review by digital forensics related to the crime of corruption will be very decisive to convince the judge in eradicating the crime of corruption. It is expected that the legislation contains rules that require the Working Group (Pokja) to stand independently, meaning that there is no intervention from inside and outside the implementation of Pokja's responsibilities so as to have high integrity. Furthermore, to the parties directly involved namely, KPA, PA ULP, PPK, and Participants do not interfere in the affairs that are their responsibility. It is expected that the results of forensic digital evidence analysis of Law Enforcement Officers (APH) for the resolution of corruption crimes should be included in the evidence tools as regulated and KUHAP and other Laws related to evidence tools, namely by including in the News of The Examination Event (BAP) of Witnesses, BAP Experts, Letters and BAP Suspects.Keywords: Legal Accountability, Election Working Group, Corruption Crimes, and Procurement of Government Goods/Services

    Going Beyond Counting First Authors in Author Co-citation Analysis

    The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed

    “Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship

    Appropriate Similarity Measures for Author Cocitation Analysis

    We provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature.     Dispelling the Myths Behind First-author Citation Counts

    We conducted a full-scale evaluative citation analysis study of scholars in the XML research field to explore just how different from each other author rankings resulting from different citation counting methods actually are, and to demonstrate the capability of emerging data and tools on the Web in supporting more realistic citation counting methods. Our results contest some common arguments for the continued use of first-author citation counts in the evaluation of scholars, such as high correlations between author rankings by first-author citation counts and other citation counting methods, and high costs of using more realistic citation counting methods that are not well-supported by the ISI databases. It is argued that increasingly available digital full text research papers make it possible for citation analysis studies to go beyond what the ISI databases have directly supported and to employ more sophisticated methods

    We have done our best to complete the author checklist relating to the use of animals in the hut study. Note that the objective for the hut study was to evaluate the IRS treatment applications for residual efficacy against Anopheles mosquitoes, including the local An. coluzzii mosquito population. Cows were only used to attract mosquitoes into the huts and no tests were carried out directly on the cows. The author checklist is intended for use with studies where experiments are carried out on animals, which is why we have had such difficulty in completing this for the hut study, as many of the questions do not relate to how the cows were used
