No full textThe procedures for the coming into force oflaws in Chad were originally inspired by French Law. Since the Administration was not in a position to comply with the required formalities, this System was altered in 1967. The new procedure is iniquitous because it allows the Authorities to alter the rights and obligations of the citizen withouthis knowledge. In fact, knowledge of the law stems from a legal fiction : the documents are supposed to be public. It is difficult to get hold of legal information elsewhere. All in all, Chad's legal System is hard to identify, uncertain and obscure. But it is possible to clarify the state of the law. First, by compiling a legal data-base. Then by making it compulsory for all the rules and regulations to be indexed by the data-base. Finally the procedure for the publicising of rules and regulations should be modified since it is one of the reasons for the uncertain state of the law.La procédure d'entrée en vigueur des actes normatifs au Tchad a d'abord été déterminée par une réglementation qui s'inspirait du droit français. L'Administration n'ayant pas été en mesure de respecter les formalités requises, cette réglementation a été redéfinie en 1967. La nouvelle procédure est inique car elle permet aux pouvoirs publics de modifier les droits et obligations des citoyens à leur insu. En effet, la connaissance du droit résulte d'une fiction juridique : les textes sont réputés publics. Il est par ailleurs difficile de se procurer l'information juridique. Au total, l'ordre juridique tchadien est difficilement identifiable, incertain et obscur. Mais il est possible de clarifier l'état du droit. D'abord, en créant une banque de données juridiques. Ensuite, en conférant un caractère obligatoire à l'ensemble des normes inventoriées par la banque de données. Enfin, il conviendrait de modifier la procédure de publicité des actes normatifs car elle est l'une des causes qui font que l'état du droit est incertain.Moyrand Alain. Réflexions sur l'introduction de l'État de droit en Afrique noire francophone
No full textIn view of the failure of the autoritarian political regimes in Africa, many would like to introduce the rule of law on that continent. This concept, however, which was born in Europe, is deeply rooted in specific culture and ideology which are not part of the african experience. Consequently, a simple transfer runs a serious risk of failure.
In this paper, the reasons for transferring the rule of law principles (of occidental and european intellectuals and the practice of french and african governments) are analysed. In addition, the obstacles to the flourishing of the rule oflaw are emphasized. Those obstacles are essentially cultural : they are existing in those societies which are structurée on a segmental model.Face à l'échec des régimes autoritaires en Afrique, nombreux sont ceux qui souhaitent introduire le concept d'État de droit sur ce continent. Or, ce concept, né en Europe, est profondément lié à une certaine culture et idéologie qui ne font par partie du vécu africain. De ce fait, le transfert risque d'être encore un échec.
Cette étude analyse les raisons du transfert des principes de l'État de droit (des intellectuels africains, occidentaux et la pratique des gouvernements français et africains). Puis, elle met en exergue les obstacles à l'épanouissement de l'État de droit. Ceux-ci sont essentiellement d'ordre culturel : liés à la conception du droit et de la justice que se font ces sociétés stucturées sur un mode segmentaire.Moyrand Alain. He is also cofounder and partner of Carbone 4, a consultancy firm focusing on energy transition and adaptation to climate change. The interview first revolves around the academic content Alain Grandjean considers as the bare necessities to be taught in higher education, no matter the curriculum. This should take the form of a basic synthetic training which takes into account the major environmental issues without too much technicality as well as lessons in accounting and economics, which he considers essential. The interview also looks more specifically at engineering and business schools.
