LA «ANTESALA» CONCEPTUAL DE LA AZIONE DI CLASSE. UN APORTE AL ANÁLISIS COMPARATÍSTICO SOBRE LA TUTELA DE LOS ASÍ LLAMADOS ‘DERECHOS SUBJETIVOS HOMOGÉNEOS’.
The study analyses the linguistic usages dominant in the discourses of Italian
and American legal doctrine on the nature of the situations of advantage protected
in the normative context of collective procedural actions.
The aim of the analysis is to specify certain features of the conceptual
«antechamber» (conceptual premises) of azione di classe as envisaged by article
140bis of the Italian Consumer Code. Rather than analyse the legal doctrine on
azione di classe, the thesis deals mainly with the discourses and assumptions
implicit in the normative prescription of this institute within a legal culture
characterized, especially since the 1970s by (i) the constant use of locutions such
as ‘general interest’, ‘collective interest’, ‘collective right’, ‘supra-individual
interests’, etc., on the basis of (ii) a conceptual (or purportedly such) premise
according to which the collectivity is a rights holder.
Instead, as the fundamental argument of the study, the author maintains that in
a normative legal system every situation of advantage is always and only a
subjective right. Hence, the collectivity is not, nor can be, a rights holder.
Consequently, expressions such as general interest, collective interest,
collective right, supra-individual interests, etc., always and only denote a set of
subjective rights characterized, at most, by the fact that their object is the
enjoyment of a collective good (a good which, as such, does not admit to its
exclusive enjoyment nor rivalry in its consumption). That is to say, they always
denote homogeneous subjective rights.
Having argued for the erroneousness conceptual «antechamber» governing the
discourse on collective action in Italy, the thesis explores the development,
purposes and, above all, consequences of the permeability of doctrinal (and
subsequently jurisprudential and legislative) discourse to the collectivist ideology
in Italian legal culture, which is also influenced by a specific perception of the
American class action.
To this end, part of the thesis is also devoted to establishing, by means of the
same methodological analysis, whether American legal culture comprises an
analogous phenomenon in relation to the procedural mechanism of class action.
The analysis shows that there is evidence of a collectivist conception also in
American legal culture, particularly in light of the justificatory arguments adduced
for the ‘Private Attorney General’ and the consequent meaning attributed by
doctrine to the expression ‘public interest’.
Then, the influence of the collectivist ideology in American procedural
doctrine in regard to collective action is analyzed, highlighting its effects in
relation to the justificatory discourse on class action. In this regard, the thesis
emphasises marked differences from, but also important similarities with, the
Italian context. The most striking similarity is the employment of collectivist
discourses in both countries (in Italy also as a consequence of EC policy) in
normative and doctrinal statements intended to protect market rules

Conocer la capacidad de uso de la web 2.0en los estudiantes de la Unidad educativa “Luis Plutarco Cevallos” para gestionar un servicio edu-comunicacional con fines culturales, científicos y de desarrollo sostenible.Para la identificación del problema a investigarse se efectuó un sondeo rápido que permitió determinar la existencia de fallas en la calidad y en la accesibilidad a laboratorios activos con servicio de internet en la unidad educativa Luis Plutarco Cevallos de la parroquia de Quiroga del cantón Cotacachi. El origen de estos acontecimientos está relacionado a la situación geográfica donde se encuentra la institución ya que la mayoría de estudiantes que asisten al plantel provienen de comunidades circundantes a la parroquia, este hecho conlleva a la poca accesibilidad al servicio de internet. Una vez identificada la problemática se procedió a elaborar un banco de preguntas para ser aplicado a los estudiantes mediante un formato de encuesta. De tal manera que se pueda recabar información para saber los motivos precisos del porque se ha presentado el problema y posteriormente se establezca la mejor solución que cubra las necesidades y que contribuya a mejorar la accesibilidad de los estudiantes al servicio de internet en su institución con fines educativos y de investigación. Una vez aplicado el cuestionario se pudo determinar cuáles han sido las causas y por qué se ha presentado el problema, con los resultados logrados se procedió a elaborar cuadros estadísticos mediante los cuales se conoció el número de personas que se inclinaron por una u otra respuesta y el porcentaje que representa las frecuencias que se alcanzaron. Así se pudo efectuar un análisis que constituye la interpretación de cada una de las interrogantes con sus correspondientes deducciones a fin de conocer el nivel de accesibilidad que poseen los estudiantes a la red en su plantel, comunidad y hogar, para saber si conocen las nuevas tecnologías de comunicación e información y poder aplicarlos a la investigación como también al desarrollo del conocimiento, luego de identificar las causas que han originado el inconveniente presentamos la propuesta de solución, la cual ha sido realizada con la suficiente dedicación, estableciendo parámetros puntuales y precisos en todo el compendio. La red de herramientas interactivas que presentamos para el plantel consiste en un sitio web institucional que incluye una biblioteca on line que contiene 7000 archivos digitales que se puede descargar y compartir, un canal de YouTube, sistema de almacenamiento Dropbox y perfiles en red social. Este material resulta entendible e interesante para quien quiera darle uso y lectura en cualquier momento que requiera despejar dudas o actualizar sus conocimientos a nivel educativo medio y como una fuente de ayuda para poder prepararse y rendir las pruebas de admisión a las universidades
Going Beyond Counting First Authors in Author Co-citation Analysis
The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation
counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed
Variations on the Author
“Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship
Appropriate Similarity Measures for Author Cocitation Analysis
We provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature. Dispelling the Myths Behind First-author Citation Counts
We conducted a full-scale evaluative citation analysis study of scholars in the XML research field to explore just how different from each other author rankings resulting from different citation counting methods actually are, and to demonstrate the capability of emerging data and tools on the Web in supporting more realistic citation counting methods. Our results contest some common arguments for the continued
use of first-author citation counts in the evaluation of scholars, such as high correlations between author rankings by first-author citation counts and other citation
counting methods, and high costs of using more realistic citation counting methods that are not well-supported by the ISI databases.
