    The illegitimacy of the Russian Federation’s presence in the UN Security Council: the material and legal basis of the axiom and the assessment of the prospect of depriving it of its actual status

    The article deals with the legitimacy of the Russian Federation’s membership in the UN Security Council in connection with the armed aggression against Ukraine. The author makes a criminological assessment of the consequences of the armed aggression: social (loss of life potential due to the death of civilians, emergence of the category of internally displaced persons and refugees, forced deportation of children outside Ukraine) and economic (destruction of housing, losses for industry, energy, agriculture and land resources). The author summarizes and assesses possible ways to establish peace and restore the global security environment through: depriving Russia of the status of a permanent member of the UN Security Council and expelling it from the Organization as a whole; suspending its rights or privileges as a member of the Organization; expanding the membership of the UN Security Council and taking into account new centers of influence

    The activities of terrorist organizations is in direct connection with the aggravation of criminal situation, not only in areas under their control. Special resonance and widespread crimes of terrorist orientation aimed at destabilizing the socio-political situation; new impetus to the development of criminal fishing was associated with illicit trafficking in firearms and ammunition, drugs, smuggled movement of goods, illegal occupation of property.In order to ensure implementation of the state policy in the field of civil protection established criminal liability of citizens of Ukraine (Art. 3361), which are civil defense or signed contracts for the passage of such a service in a special (other than renewal) period and in the case of targeted mobilization for avoiding such service. According to the author, the exclusion of the legislator, when describing the circumstances of the crime, with the term «special period» of such component parts is groundless. From his position, «partly recovery period after the end of hostilities» actually is a peaceful time, while its possible duration is uncertain.     Дослідження має на меті визначення обсягу наслідків (втрат) України від збройної агресії. Напрями виявлення запропоновано об’єднати у гуманітарний, економічний, військовий, правоохоронний, природоохоронний і культурно-релігійний. Соціально-гуманітарні та економічні наслідки (втрати) деталізовано за рахунок зменшення життєвого потенціалу України, збільшення кількості внутрішньо переміщених осіб та біженців, прогнозованого зменшення ВВП, втрат у соціальному та продуктивному секторах та ін.; еколого-природоохоронні наслідки (втрати) розкрито за рахунок шкоди природно-заповідному фонду та іншим природоохоронним територіям, земельним та водним ресурсам від викидів небезпечних речовин у атмосферу, пошкоджень та втрат лісових масивів тощо. The purpose of the study is to outline the extent of the consequences of the armed aggression against Ukraine in the socio-humanitarian, economic and environmental spheres. The author states that the top leadership of the aggressor state, as well as the direct perpetrators of war crimes and crimes against humanity, committed the following: mass killings of civilians; creation of conditions aimed at their complete or partial destruction; forced deportation; destruction of the economic potential of the state. The author emphasizes the complexity of the task of establishing the scope of the consequences of the armed aggression against Ukraine, given the ongoing nature of the data obtained, the dispersion or lack of effective calculation methods, and other objective and subjective factors. The author proposes to combine the areas of damage and loss assessment in Ukraine into humanitarian, economic, military, law enforcement, environmental, cultural and religious ones. The author details the socio-humanitarian and economic consequences of the armed aggression due to a decrease in the vital potential of Ukraine, an increase in the number of internally displaced persons and refugees, a projected decrease in the country’s gross domestic product, and losses in the social (destruction of housing, healthcare facilities, cultural facilities, and educational infrastructure) and productive (losses to the assets of enterprises, retail trade, land and agriculture, and municipal infrastructure) sectors. The environmental and ecological consequences of armed aggression are detailed by: damage to the nature reserve fund; land and water resources; emissions of hazardous substances into the atmosphere; loss of forests; damage to infrastructure and industrial facilitie

    This article is written in memoriam of Ihor Skochylas, a historian and outstanding researcher. In 1993 he graduated from the Ivan Franko National University of Lviv. He worked at the Academy of Sciences of Ukraine and then at the Ukrainian Catholic University in Lviv. He was visiting professor at the Ukrainische Freie Universität in Munich. He is the author of 250 scientific publications on the history of the Ternopil region and, above all, the history of the Church in Ukraine in the broader perspective of the history of the First Republic and in connection with the universal Church. Innovative research by Ihor Skoczylas is related to the search for a “mental map”. The book by Ihor Skoczylas, co-authored with A.     The article is devoted to international legal and national aspects of the regulation of criminal liability for crimes against humanity, especially important in times of ongoing armed aggression against Ukraine, the course of which is accompanied by large-scale commission of war crimes (Article 438 of the Criminal Code of Ukraine), the crime of aggression (Article 437 of the Criminal Code of Ukraine), propaganda of war (Article 436 of the Criminal Code of Ukraine), crimes against humanity (Article 442-1 of the Criminal Code of Ukraine). Based on the analysis of the provisions of the Statutes of the Nuremberg Military Tribunal, the International Military Tribunal for the Far East, the Rome Statute of the International Criminal Court, a conclusion is made about the almost absolute reproduction of Article 442-1 of the Criminal Code of Ukraine through the understanding of the latter.The importance of establishing a contextual element when qualifying crimes against humanity is emphasized, which is proposed to be associated with the following features: 1) confirmation of the fact of a large-scale or systematic attack; 2) the object of the attack must be any civilian population; 3) the attack was carried out in support of the policy of a certain state or organization; 4) the perpetrator’s awareness that his unlawful behavior was carried out in the context of a large-scale or systematic attack

Автор досліджує семантику кольорів і музики в доантоничівський період, зіставляючи її з відповідною асоціативною навантаженістю образів поета, який “жив колись на вишнях”.The author of the paper brings forward his refl ections on West-Ukrainian poetic Secession of the fi rst decades of the 20th century, paying special attention to the place of Secession discourse within the literary process which covers a wide range of literary phenomena, from “Moloda Muza” (“The Young Muse”) to Bohdan-Ihor Antonych’s poetic heritage. In particular, the article analyses the semantics of colours and music before Antonych and compares it with the associations called up by the visual and auditive metaphors of the poet who “...used to live in the cherry trees”
