    Opodatkowanie handlu kryptowalutami – kierunki i decyzje polityki podatkowej

    Taxation of trading in cryptocurrencies raised many doubtsby the end of 2018, in particular in light of the lack of special rules in relation to income taxes and tax on civil law transactions. Since1 January 2019, the Polish legislator has decided to introduce into the Polish tax systema new and comprehensive regime sanctioning tax effects related to the virtual currency business in relation to both income taxes, while in mid-2018 a decision was taken to abandon for one year the collection of tax on civil law transactions. Trading in virtual currencies also produces certain effects in relation to the value added tax (tax on goods and services), in relation to whichthe leading role should be attributed to the 2015 judgment of the Court of Justice of the European Union. The intention of this article is to presentan analysis of the rules related to the taxation of cryptocurrencies deepened by anindication of practical problems in their application and tax policy decisions, which in their assumption, were aimed to resolve these problems. Where appropriate, the author will also refer to tax situation before the changes were introduced.Opodatkowanie obrotu kryptowalutami do końca 2018 r. budziło wiele wątpliwości, w szczególności w świetle braku szczególnych zasad w podatkach dochodowych oraz podatku od czynności cywilnoprawnych. Od 1 stycznia 2019 r. polski ustawodawca postanowił wprowadzić do polskiego systemu podatkowego kompleksowy reżim sankcjonujący skutki podatkowe związane z obrotem walutą wirtualną w obydwu podatkach dochodowych, podczas gdy w połowie 2018 r. postanowił zaniechać na okres jednego roku poboru podatku od czynności cywilnoprawnych. Handel walutą wirtualną wywołuje określone skutki również w podatku od towarów i usług, gdzie wiodącą rolą w ich zdefiniowaniu przypisać należy wyrokowi Trybunału Sprawiedliwości Unii Europejskiej z 2015 r. Zamiarem niniejszego artykułu jest przybliżenie zasad związanych z opodatkowaniem obrotu kryptowalut ze wskazaniem na ich praktyczne problemy i decyzje polityki podatkowej, które w swoim założeniu miały te problemy usunąć.     Tematem rozprawy doktorskiej są regulacje kontrolowanych spółek zagranicznych (CFC). Regulacje CFC są ważnym narzędziem legislacyjnym, które pozwala zapobiec prawnemu przenoszeniu dochodu podlegającego opodatkowaniu do krajów o niskim poziomie opodatkowania, nakazując przypisać kwoty odpowiadające wysokości wytransferwanego dochodu do podstawy opodatkowania podatnika (osoby kontrolującej). Podstawowa teza badawcza niniejszej rozprawy osadza się na stwierdzeniu, iż istnieje istotny deficyt regulacyjny w ramach aktualnie obowiązujących polskich regulacji CFC. Konstrukcja tych przepisów nie zapewnia skutecznego mechanizmu przeciwdziałającego unikaniu opodatkowania przy wykorzystaniu konstrukcji spółki CFC z uwagi na liczne defekty konstrukcyjne oraz luki prawne. Autor zidentyfikował dwadzieścia pięć takich podstawowych defektów i luk. Drugą tezą do wykazania w rozprawie było twierdzenie, że polska Ustawa zasadnicza oraz umowy o unikaniu podwójnego opodatkowania, których stroną jest Polska nie wprowadzają zasadniczo ograniczeń w zakresie konstrukcji regulacji CFC. Autor miał na celu wykazanie, że zasada sprawiedliwości podatkowej stosowana abstrakcyjnie jako miara standardu konstytucyjności, czytana zarówno w wymiarze materialnym, jak i proceduralnym, nie stanowi ograniczenia w stosowaniu regulacji CFC w wersji przewidzianej przez obowiązujące w Polsce prawo podatkowe. Jeśli chodzi o umowy o unikaniu podwójnego opodatkowania, identyczna konkluzja dotycząca braku ogólnego konfliktu między regulacjami CFC a tymi traktatami opiera się na licznych argumentach wypływających z literalnej interpretacji poszczególnych postanowień tych konwencji, co znajduje poparcie w oficjalnym stanowisku OECD zawartym w komentarzu do Konwencji Modelowej OECD. Ponadto, autor postawił teże, że jeszcze przed wprowadzeniem Dyrektywy przeciwko unikaniu opodatkowania (Dyrektywy ATA) państwa członkowskie UE miały więcej swobody w stosowaniu regulacji CFC w sytuacjach wewnątrzwspólnotowych, tj. gdy spółki CFC były zlokalizowane w innych państwach członkowskich oferujących preferencyjne reżimy podatkowe. Na podstawie analizy orzecznictwa Trybunału Sprawiedliwości Unii Europejskiej, w szczególności wyroku w sprawie Cadbury Schweppes, autor próbował argumentować, że walka z nadużyciami w UE nie jest ograniczona do przypadków, w których spółki CFC stanowią wyłącznie sztuczne struktury, tj. nieistniejące podmioty w praktyce. W przeciwieństwie do powszechnego poglądu podzielanego przez opinię publiczną, przedmiotowe wyroki dawały podstawę prawną do stosowania bardziej proporcjonalnego podejścia w regulacjach CFC. Powiązaną tezą do udowodnienia było twierdzenie, iż polskie ustawodawstwo CFC nie powinno iść śladem brytyjskich przepisów CFC odnośnie do sposobu określania dochodu podlegającego opodatkowaniu u podatnika (dochodu CFC), pozostając w tym zakresie oparte na mechanizmie pierwotnie wypracowanym w ramach amerykańskich regulacji CFC, przy czym rekomendowanym byłoby wdrożenie modelu amerykańskiego w pełni, które jest rozwiązaniem zdecydowanie bardziej precyzyjnym, a co za tym idzie bardziej proporcjonalnym do zamierzonego celu. Wreszcie, w oparciu o powyższe rozważania i bazując na doświadczeniu OECD z Projektu BEPS, autor zaproponował czterdzieści dwie zmiany natury de lege lata i de lege ferenda do polskich regulacji CFC, co uczyniłoby je bardziej wydajnymi i spójnymi. W pracy zastosowano następujące metody badawcze - metodę dogmatyczną, metodę teoretyczną, metodę porównawczą, metodę historyczno-prawną oraz metodę empiryczną. Dysertacja zawiera analizę następujących podstawowych materiałów źródłowych: aktów prawnych, interpretacji przepisów prawa podatkowego wydanych przez organy podatkowe, wyroków sądowych, dokumentów instytucji międzynarodowych (OECD i UE), literatury prawniczej w formie książek, czasopism i artykułów internetowych , źródeł historycznych oraz wyniki badań przeprowadzonych w oparciu o wywiad kierowany.The subject of the doctoral dissertation is the issue of controlled foreign company (CFC) regulations. CFC regulations are an important legislative tool allowing to prevent the legal relocation of taxable income to countries with low taxation by obliging the amounts corresponding to the transferred income to be claimed back to the tax base of the taxpayer (the controlling person). The basic research thesis of this dissertation is based on the statement that there is a significant regulatory deficit under the current Polish CFC regulations. The construction of these provisions does not ensure an effective mechanism to prevent tax avoidance using the CFC construction due to the numerous structural defects and legal gaps, which in turn may expose the state budget to significant losses due to reduced tax revenues. The author's identified the very basic twenty five such defects and gaps. The other thesis to demonstrate was that the Polish Constitution as well as the Polish double tax treaties do not generally introduce restrictions on the applications of the Polish CFC regulations. The author aimed to demonstrate that the tax justice standard applied in abstract as a measure of the standard of constitutionality, read both in the material and procedural dimension, does not constitute a constraint in the application of CFC regulations in the version envisaged by the current Polish tax laws. As regards the double tax treaties, identical conclusion on lack of the general conflict between the Polish CFC regulations and these treaties has basis in numerous arguments based on the literal interpretation of individual provisions of these conventions, supported by the official OECD’s position presented in the Commentary to the OECD Model Convention. The following thesis of the author was suggestion that even prior to the introduction of Anti-Tax Avoidance Directive (ATA Directive) the EU member states had more leeway in applying the CFC rules to intra-community situations, i.e. where CFCs were located in other member states offering preferential tax regimes. Based on the analysis of the European Court of Justice’s verdicts, in particular the Cadbury Schweppes judgement, the author tried to argue that fight against abuse within the EU does not to be limited to cases of CFCs constituting wholly artificial arrangements, i.e. non-existent entities in practice. Opposed to common view shared by the public, more proportional approach in the CFC regulations could have been applied and had good legal basis in these verdicts. The related thesis to prove was that the Polish CFC legislation should not follow the British CFC regime as regards the quasi-transfer pricing mechanism of determination of the taxable income of taxpayer (the CFC income), remaining in this respect based on the mechanism originally developed under the American CFC regulations, while the author recommended to implement the American model in full, i.e. switch from the current-in-force transactional-entity approach to pure version of the transactional approach. The latter approach is a more precise mechanism, and hence more proportional to the intended purpose. Finally, based on the above considerations and based on the experience of the OECD from the BEPS Project, the author proposed forty two changes of de lege lata and de lege ferenda nature to the Polish CFC regulations which would make them more efficient and consistent. The following research methods were applied in the work - dogmatic method, theoretical method, comparative method, historical-legal method and empirical method. The dissertation contains an analysis of the following basic source materials: legal acts, interpretation of tax law regulations issued by tax authorities, court verdicts, documents of international institutions (the OECD and the EU), legal literature in the form of books, magazines and online articles, historical sources as well results of the research conducted based on the interviews

    CFC Regulations in Light of the Other OECD’s Recommendations from the BEPS’s Project - Relation of Convergence, Exclusion and Parallelism

    The subject of the article is to present the OECD’s recommendations issued within the Base Erosion and Profit Shifting (BEPS) project as regards the relation between CFC regulations and the other action points from this project. The analysis reveals that such recommendations do not have a holistic nature, i.e. they do not envisage an explicit hierarchy between them, and that the impact of CFC regulations on the BEPS phenomenon has in majority of cases a subsidiary character in light of the primary recommendations, such as, for instance, the ones on neutralizing tax hybridization, limiting tax deductibility of financial payments or fighting harmful tax regimes.Przedmiotem artykułu jest omówienie rekomendacji OECD wydanych na tle projektu Base Erosion and Profit Shifting (BEPS) odnośnie do relacji regulacji CFC z innymi działaniami w ramach tego projektu. Analiza wytycznych przedstawionych przez OECD do projektu BEPS pokazuje, iż nie mają one charakteru holistycznego, czyli nie przewidują one wyraźnej hierarchizacji tych wytycznych, oraz że oddziaływanie regulacji CFC na zjawisko BEPS ma większości przypadków charakter subsydiarny względem tych innych podstawowych rekomendacji, jak przykładowo wskazówek dotyczących neutralizacji hybrydyzacji podatkowej, ograniczenia potrącalności podatkowej płatności finansowych czy też zwalczania szkodliwych reżimów podatkowych

    Going Beyond Counting First Authors in Author Co-citation Analysis

    The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed

    “Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship

    Appropriate Similarity Measures for Author Cocitation Analysis

    We provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature.     Dispelling the Myths Behind First-author Citation Counts

    We conducted a full-scale evaluative citation analysis study of scholars in the XML research field to explore just how different from each other author rankings resulting from different citation counting methods actually are, and to demonstrate the capability of emerging data and tools on the Web in supporting more realistic citation counting methods. Our results contest some common arguments for the continued use of first-author citation counts in the evaluation of scholars, such as high correlations between author rankings by first-author citation counts and other citation counting methods, and high costs of using more realistic citation counting methods that are not well-supported by the ISI databases. It is argued that increasingly available digital full text research papers make it possible for citation analysis studies to go beyond what the ISI databases have directly supported and to employ more sophisticated methods
