    Safeguarding Children from Online Sexual Exploitation: A Legal and Maqāṣid al-Sharī’ah Approach

    Advancements in technology have eased access to information but also heightened children’s vulnerability to sexual exploitation in digital spaces. Indonesia ranks among the top 10 countries with the highest incidences of online child sexual abuse, according to ECPAT data. This article examines legal protections for children against sexual exploitation online from the perspectives of positive law and maqāṣid al-sharī’ah (objectives of Islamic law) using a normative juridical approach. Findings reveal that, despite existing laws such as the Child Protection Act and the Electronic Information and Transactions (ITE) Law, cases of abuse persist. Islamic teachings, rooted in the maqāṣid al-sharī’ah, prioritize the protection of religion, life, intellect, lineage, and property, offering complementary principles for addressing this issue. By integrating statutory regulations with Islamic jurisprudence, a more comprehensive framework for safeguarding children can be established. This approach not only strengthens existing legal measures but also aligns them with universal values, ensuring a balanced and effective response to the challenges of digital-era child protection

    Beyond Islamic Legal Principle: Social Justification of Adolescent Forced Marriage after Sexual Intercourse

    The social justification for the practice of forced marriage among adolescents engaged in premarital sexual activity reveals a clear contradiction between prevailing social norms and the principles of Islamic law. However, this phenomenon tends to be overlooked in previous studies. In addition to responding to the shortcomings of existing studies, this study also aims to explain the characteristics of forced marriage practices for adolescents who engage in sexual activity outside of marriage. This research is a descriptive qualitative study that uses a case study approach. The findings indicate that forced marriage among adolescents is frequently employed as a means of safeguarding both individual and familial honor within the prevailing social value system of the community. There are three main findings that support this conclusion. First, the decision to arrange a forced marriage is usually made by the family without considering the teenager\u27s personal wishes. Second, the reason this practice is accepted by the community is because it is believed to uphold shared moral values and standards of proper behavior. Third, the controversies that arise reflect the contradictions between the social system and the principles of Islamic law. The significance of this study rests in its contribution to enriching the discourse of Islamic law through a social reality-based approach, thereby creating space for contextual reinterpretation of the law with an emphasis on the welfare of its subjects

    Di era milenial sekarang santri lebih banyak mencari pengetahuan, pemahaman dan referensi tentang agama di media sosial dengan mengabaikan peran guru dan referensi buku. Hal ini menjadikan beberapa santri memahami agama secara garis keras atau secara sekuler, dan santri mudah termakan hoaks dan sering bertindak emosional, bahkan pemahaman agama santri terkadang menyimpang karena mendapat panduan dari media sosial tersebut. Menyikapi hal tersebut santri membutuhkan pendidikan spiritual salah satunya melalui ajaran tarekat dalam mengatasi modernisasi tersebut agar setiap perilakunya mampu berjalan sesuai ajaran agama dan terus mendekatkan diri dengan Allah SWT dan santri mampu menetralisir budaya yang masuk dan juga dapat dijadikan cek and balance bagi maraknya budaya barat yang masuk. Permasalahan yang diteliti dalam penelitian ini adalah bagaimana peran pendidikan tarekat pada santri di era milenial? Hasilnya bahwa pendidikan tarekat berarti sistem dalam rangka mengadakan latihan jiwa, membersihkan diri dari sifat-sifat yang tercela dan mengisinya dengan sifat-sifat yang terpuji, yang berperan bagi santri di era milenial sebagai petunjuk dan bimbingan dari kehidupan dunia hingga akhirat sehingga akan menimbulkan kebahagian dan ketenangan hidup di dunia dan akhirat

    Going Beyond Counting First Authors in Author Co-citation Analysis

    The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed.     “Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship

    Education For Women in The Global Era of Islamic Perspectives

    Some civilizations consider women second-class human beings compared to men; others view women and men as equal and equal. The first creates a negative stigma for women who are socially active, resulting in restrictions on access to education. The second view gives rise to an excessive attitude that women must be the same as men. This research aims to explore, study, and discuss Islamic views on the position of women. The Islamic view in question was based on the texts of the Al-Qur’an and hadith, in which classical and contemporary Muslim intellectuals gave adequate explanations or interpretations. This study was a type of library research where the researcher used a descriptive-analytical method by adopting Maudlu’i interpretation in the study of the Al-Qur’an and hadith with a hermeneutical approach. The researcher's procedure was to start the study with a historical study of women’s education in various world cultures and civilizations, continue with women’s Islamic perspective, and continue with studies on the position of women in Islam and women’s education from an Islamic perspective. An in-depth analysis of women's education's global relevance and implications was conducted. This research concluded that Islam views women as having the same dignity and worth as men. Many verses of the Al-Qur’an and hadiths of the Prophet Muhammad SAW explain the position of women and that there was no discrimination in them, as well as in matters of education. No verses in the Al-Qur’an or Hadith of the Prophet Muhammad SAW specifically specified education for men only and excluded women

    Appropriate Similarity Measures for Author Cocitation Analysis

    We provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature.     Dispelling the Myths Behind First-author Citation Counts

    We conducted a full-scale evaluative citation analysis study of scholars in the XML research field to explore just how different from each other author rankings resulting from different citation counting methods actually are, and to demonstrate the capability of emerging data and tools on the Web in supporting more realistic citation counting methods. Our results contest some common arguments for the continued use of first-author citation counts in the evaluation of scholars, such as high correlations between author rankings by first-author citation counts and other citation counting methods, and high costs of using more realistic citation counting methods that are not well-supported by the ISI databases. It is argued that increasingly available digital full text research papers make it possible for citation analysis studies to go beyond what the ISI databases have directly supported and to employ more sophisticated methods
