    Nelle pagine che seguono si presenterà una prospettiva che integrerà le impostazioni concentratesi sul rapporto tra pena e struttura sociale con la teoria del ciclo lungo e con la considerazione dei fenomeni migratori, identificandone le relazioni con i tassi di carcerazione. Ciò anche in chiave comparatistica, considerando sia il nostro Paese che l’ambito degli USA. Che cosa significa, tuttavia, cercare i nessi tra la struttura sociale, i movimenti migratori, la criminalità, e i tassi di incarcerazione? A questo e ad altri interrogativi si vuole offrire un contributo che non dimentichi l’importanza delle politiche penali. Infine, se negli anni Settanta i movimenti migratori si erano ridotti al minimo in Italia, ai giorni nostri è evidente come il fenomeno abbia assunto contorni tali da non poter essere taciuto e come anzi s’imponga come lente con cui indagare le relazioni tra teoria dell’onda lunga, struttura sociale e tassi di carcerazione. Movimenti migratori che si potrebbero arrivare a concepire come un tentativo, da parte di coloro che si trovano al fondo della piramide sociale, di spostarsi da società ove la soglia di less eligibility è estremamente bassa verso situazioni in cui gli standard di vita sono più alti

    Overcoming the Crisis in Critical Criminology: Toward a Grounded Labelling Theory

    It has been said that critical criminology is in a state of crisis. The author contends that the theoretical roots of this crisis lie in the failure of critical criminology to come to terms with the interactionist tradition from within which it developed. He shows how the traditional critical-Marxist critiques of interactionsism have failed to comprehend the substance of this approach. Such substance is rooted in the social philosophy of pragmatism, especially in the thought of Mead, and in the reality of 20th-century social relationships. The author proposes that a renewed critical criminology should be based in a grounded labeling theory which is able to foster consideration of both practical and discursive forms of interaction

    In this paper, the author argues that, "in a given society, a process of increasing carceration occurs in cunjonction with situations perceived as critical for the maintenance of the elites' hegemony in that society (irrespective of "crimes rates"). He revisits the rich tradition inspired by Rusche's original hypothesis, but avoids the economist and instrumentalist temptations of that work. Evidence for the linkage between social structure and punishment is to be found in what he calls "vocabularies of punitive motive". He also shows that this theoretical reconstruction dovetails well with the crucial work of Foucault and other contributions to the sociology of law
