    Ryan Indemnity in Maritime Property Damage Cases: What of Proportionate Fault?

    In 1956 the Supreme Court in Ryan Stevedoring Co. v. Pan-Atlantic Steamship Corp. implied a warranty of workman-like performance in stevedoring contracts. The stevedore\u27s breach of this warranty entitled the shipowner to full indemnity for damages paid by the shipowner to injured longshoremen. This Article discusses the origin and development of the Ryan warranty and Ryan indemnity, focusing on post-Ryan statutory and decisional developments. The author advocates the application of principles of comparative negligence in maritime property damage cases

    The thesis synthetizes traceable information about Chris Landreth’s partly biographical film Ryan, as well as summarizes events preceding and concerning its creation. In the second part of the thesis I analyze especially psychorealism that links to the personality of Chris Landreth, but lacks clearly formulated definition. The first part emphasizes information quality about the author Ryan Lrkin and understanding of circumstances of the film creation. In the second part I put the film through analysis and then search for analogies with other episodes. Using subsequent synthesis I search for new evidence. It results in an attempt to define psychorealism. In order to familiarize with artistic movements and their means it is essential to describe them theoretically and psychorealism waved spluttered in void. I intent to change it with this thesis

    Power and Surveillance in YouTube’s Digital Neighborhood: A Case Study of College Students in the Bronx explores classic issues of power, surveillance and media use in the social-networking site YouTube. As articulated in its Empirical Model, this exploratory study utilizes a Cultural Studies approach and a Uses and Gratifications framework. These perspectives form the theoretical foundation for the research plan and mixed-method qualitative and quantitative research strategies structure the research protocol. Focus groups and a widely distributed survey were used to gather and analyze the raw data. In the Bronx YouTube study, the researcher posed the following research questions: ―What does posting on YouTube mean to users, ―Why or why don’t users post on YouTube, ―Do systems of power and surveillance operate within the YouTube digital neighborhood and if so, how do they operate and are users aware of them, and finally ―How does YouTube differ from other social networking sites? The study results indicate some potential areas for further research in terms of attitudes, beliefs, and behaviors. For instance, study participants were concerned about the privacy of their email address and financial information yet did not participate much in uploading videos themselves, nor were they concerned about gender, race, or education when correlated with YouTube DV’s. Study participants did, however, actively comment on other people’s videos and communicated with people they knew in real life (IRL) through YouTube’s SNS features. Study participants also expressed high-levels of concern about the collection and selling of their financial and email information by YouTube and its affiliates. Of particular note, the research results indicate that the Bronx YouTube study participants were aware of many online surveillance techniques utilized by YouTube, LLC and Google, actively protected themselves while in YouTube from that surveillance and even sought out specific ways to circumvent surveillance and seek opportunities to further their own personal or professional goals.Ph.     Alice Ryan and the Women of 8 Church Street Tipperary (Part One)

    Alice Ryan (Ailis ni Riain) was President of 4th Battalion Cumann na mBan during the War of Independence, and the 2nd Southern Division Cumann na mBan during the Civil War. Alice ran a newsagent, grocery, tearoom, and boarding business at 8 Church Street Tipperary with her younger sister Katie Ryan who was also active. Their home and business premises at 8 Church Street was used as a Republican HQ until forced to close in 1921. Alice and Katie's older sister Mary Quigley ran the Post Office and grocery at 238 Merrion Road in Dublin. Mary's eldest daughters Kathleen (grandmother of the author of this article) and May Quigley spent time with their Aunts in Tipperary, and Grandparents in Donohill. May met Sean Treacy at 8 Church Street and they formed a close relationship. Sean was killed in Talbot Street Dublin eleven days before their wedding. Alice Ryan's first cousins Maggie and Agnes V. Harding were also active in the Republican cause, Maggie in Tipperary Cumann na mBan and Agnes V. in Dublin, where her Monument Creameries were used as Republican bases. These two articles build a picture of the activities of these women and their associates and gives the wider context of their lives. Of particular interest is the full array of illustrations from family records. The starting point for this document was Kathleen Quigley (1894-1995) (Fig 01). Kathleen's stories and artefacts were added to other family and public records. Four books were especially useful. Mary Quigley wrote family details in the Merrion Road Post Office accounts book. Katie Ryan and May Quigley directly contributed to Desmond Ryan's 1945 biography of Sean Treacy. Alice Ryan contributed to Ide ni Riain's book on A. V. Ryan. Sister Eileen Ryan, niece to Alice and Katie, documented family history in her 1997 book Branches from an Ancient Tree. Alice Ryan, Katie Ryan, and Maggie Harding, contributed directly to the Military Pensions process, which archives have recently been made public.     Equilibrium transition study for a hybrid MAV

    Wind tunnel testing was performed on a VTOL aircraft in order to characterize longitudinal flight behavior during an equilibrium transition between vertical and horizontal flight modes. Trim values for airspeed, pitch, motor speed and elevator position were determined. Data was collected by independently varying the trim parameters, and stability and control derivatives were identified as functions of the trim pitch angle. A linear fractional representation model was then proposed, along with several methods to improve longitudinal control of the aircraft

    The All Whites are alright with us: An analysis of New Zealand national media coverage surrounding the 2010 All Whites World Cup finals campaign

    In June of 2010, the New Zealand men’s representative football team, the All Whites, contested the FIFA World Cup finals in South Africa for only the second time. Due to their credible on-field performances and unprecedented exposure in the national media, their campaign captured the attention of the New Zealand public like never before; surpassing even the national interest in the previous 1982 All Whites and their own storied World Cup finals campaign. Mainstream New Zealand’s sudden resurgence of interest and the accompanying rise in the All Whites’ media profile provided a rare opportunity to undertake a substantial survey of the media discourses surrounding the team in the hopes of better understanding the ways in which national audiences were likely to have (re)configured their understandings regarding the team and, in the broader sense, football’s place in the contemporary New Zealand socio-cultural landscape. Via an integration of poststructuralist textual analysis and content analysis, this thesis examined a sampling of national media coverage related to the All Whites’ 2010 World Cup campaign. Overarching themes relating to masculinity, nationalism and celebrity were identified, and I argue that audiences engaging with the media discourses surrounding these themes would likely have been encouraged to ascribe to the All Whites (a) an acceptably masculine status, (b) an authentic affiliation to New Zealand national identity, and (c) to ascribe to All Whites captain Ryan Nelsen a legitimated celebrity status. Furthermore, I suggest that these likely interpretations are indicative of an incremental but ongoing shift for football and the All Whites away from New Zealand’s socio-cultural periphery and towards its centre

    Theoretical studies of the historical development of the accounting discipline: a review and evidence

    Many existing studies of the development of accounting thought have either been atheoretical or have adopted Kuhn's model of scientific growth. The limitations of this 35-year-old model are discussed. Four different general neo-Kuhnian models of scholarly knowledge development are reviewed and compared with reference to an analytical matrix. The models are found to be mutually consistent, with each focusing on a different aspect of development. A composite model is proposed. Based on a hand-crafted database, author co-citation analysis is used to map empirically the entire literature structure of the accounting discipline during two consecutive time periods, 1972–81 and 1982–90. The changing structure of the accounting literature is interpreted using the proposed composite model of scholarly knowledge development

    Hallstrom v. Tillamook County: Interpreting the Notice Provisions of Environmental Statutes

    Notice requirements of citizen suit provisions in environmental statutes require that notice of an intention to bring a lawsuit for violation of an environmental statute be given at least sixty days prior to the filing of an action. Notice of such an intention must be given to the Environmental Protection Agency, the state in which the violation occurred, and the alleged violator. In Hallstrom v. Tillamook County, the Supreme Court held that the notice requirements for citizen suit provisions of environmental statutes must be strictly interpreted. According to the author, this decision exalts form over substance and does nothing to further the purpose of providing for citizen suits. This Note examines the Hallstrom decision and purposes behind notice provisions. The author concludes that these provisions should be pragmatically interpreted, providing courts with the discretion to modify or waive the notice requirements for a citizen suit depending on the individual circumstances of an individual case

    Co-contamination of Raw Vegetables with Meloidogyne spp. and Human Intestinal Parasites: An Emerging Insight in Public Health

    This study was aimed at detecting the parasitic contamination in raw vegetables sold in the four public markets in the city of Manila, Philippines. This cross-sectional study was carried out from March to September 2022. Observations on the personal hygiene of the vendors and environmental sanitation were conducted. A total of 87 fresh vegetable samples were  collected and processed for the detection of parasitic life forms using standard parasitological techniques for protozoa and helminth worms. The occurrence rate of at least one parasitic contamination of the vegetables was 39.1%, mostly with Meloidogyne spp. (26.4%). Other parasites detected are Ascaris lumbricoides (8.0%), hookworm (6.9%), Fasciola spp. (5.7%), Giardia spp. (2.3%), and Cyclospora spp. (1.1%). Other parasites are macroscopic (6.9%). Remarkably, a high level of contamination was detected in Chinese cabbage (Brassica rapa) 68.8%, cabbage (Brassica oleracea) 55.6%, lettuce (Lactuca sativa) 55.6%, ginger (Zingiber officinale) 44.4%, and carrots (Daucus caruta) 40%. The contamination rates of vegetables from the four public markets were analyzed and a significant difference was noted (x2 = 11.852, p = 0.007908) at p-value <.05. This implies that public markets in the city of Manila could play a role in the transmission of parasitic infections in the area. The high occurrence rate of Meloidogyne spp., which is a spurious parasite of man, was included in the analysis and discussions. It is in response to the emerging discussions regarding the reported passage of Meloidogyne spp. in human stool samples
