Going to American Jesuit missionary schools in his home town of Jaipur, he was well acquainted with cowboy movies, American slang, and chewing gum but nothing prepared him for Hawaii. Kuldeep Singh Sengar case shows why POCSO must recognise legislators as public servants
On December 29, the Supreme Court stayed the Delhi High Court’s order granting bail to former UP MLA Kuldeep Singh Sengar under the POCSO Act, 2012. The bench noted, “There are substantial questions of law involved, which require consideration by this Court”. The intervention by the apex court has rightly shown its judicial discomfort with the High Court’s limited interpretation of “public servant” in the POCSO Act.
The High Court relied on R S Nayak v. A R Antulay (1984), where the Supreme Court held that an MLA is not a “public servant” under Section 21(12)(a) of the Indian Penal Code (IPC). That decision was rendered in the context of section 2 of Prevention of Corruption Act, 1947, which expressly tethered the meaning of “public servant” to Section 21 IPC. That judgment should be looked through the eyes of the constitutional position of legislators vis-à-vis the executive. To mechanically transpose that reasoning into POCSO without interrogating the distinct object and structure of the statute is legally impermissible

Whistleblowing research from 1970 to 2021: a review and synthesis of the literature / K.S. Kuldeep
This study examined the whistleblowing literature from the period of 1970-2021. It was done for the purposes of understanding what the various whistleblowing themes were. The need for this study is attributed to the expanding nature of whistleblowing research at the expense of consistency and continuity. Using a structured methodology, this study used search protocols based on structured words and phrases to fin d relevant publications. A coding discipline was then applied to identify and catalogue the records into specific themes. Ten distinct sets of themes emerged. Although there is an element of commonality, the distinction of these sets allows them to be separately determined. Other findings include author publication related data and a focus on emerging subject trends in whistleblowing. This study shows the topical points which have been covered allowing for an assessment of areas understudied or to bring a differing theoretical approach into areas already reviewed. This study updates the current literature and identifies new and upcoming trends, which provides opportunities for future areas of research in whistleblowing

A passive morphing wing configuration is studied in the current work with a bi-stable trailing edge that can snap through instabilities to two different configurations. This passive morphing is capable of toggling to different configurations based on the perceived pressure field. A load cell is used to measure forces and moments on the wing. The objectives of the overall study are: (i) To develop and characterize an experimental setup for future unsteady aerodynamics studies. (ii) To determine the aerodynamic loading experienced by the wing and capture the dynamic loading experienced during the snap-through process. (iii) To understand the performance of the morphing under varied conditions to enable improved iterations of the wing. The current study will focus on results from load cell measurements for both static and passively morphing airfoils
