The vanishing author in computer-generated works: a critical analysis of recent Australian case law

The use of software is ubiquitous in the creation of many copyright works, yet the requirement in copyright law that every work have a human author who engages in independent intellectual effort means that its use may prevent copyright subsistence. Several recent Australian cases have refocused attention on authorship as an essential criterion of copyright subsistence, and these cases suggest that much computer-produced output may be authorless and thus lack copyright protection. This article, the first in a two-part series, analyses how each case deals with the question of authorship of computer-produced works and why the use of software diminishes copyright protection for a significant number of computer-generated works. The article critiques the application of conventional notions of human authorship developed in the pre-computer age to modern productions and suggests alternative approaches to authorship that satisfy both the major objectives of copyright policy and the need to adapt to the computer age. The article argues that, without a broader judicial approach to authorship of computer-generated works, Parliament must remedy the lacuna in protection for these ‘authorless’ works. Possible solutions for reform are suggested. In a forthcoming article, the author comprehensively examines those reform proposals

No full textIn Rahmen einer Feldstudie in einem Gymnasium in Norddeutschland wird mit Schülerinnen und Schülern erforscht, inwieweit „Lernen mit Lebensbezug“, „Lernen an Lebensthemen“ für die Schule und sie selbst, sinnvoll sein kann. Die Feldstudie stellt die „Liebe“ und hier speziell das Thema „Liebe und die Gestaltung von Liebesbeziehung“ in den Fokus der Aufmerk-samkeit. Mithilfe mehrperspektivischer, interdisziplinärer Quergänge wird die Beantwortung dieser Frage zunächst vorbereitet. Der Bildungsauftrag der Schulen in Niedersachsen wird überprüft, um die Frage der Zuständigkeit der Schule zu „Lernen mit Lebensbezug“ durch Hinzunahme von „Lebensthemen“ von Menschen zu klären. Inwieweit es sich beim Aufgreifen von speziellen „Lebensthemen“ wesentlich um Kulturarbeit handelt, wird diskutiert. Mit der Darstellung der Feldstudie und deren Auswertung wird der inhaltliche Diskurs, der auf drei Ebenen geführt wird – Liebesthema – Bildungsauftrag – Kulturarbeit – unterfüttert. Ab-schließend wird ein Ausblick auf die Zukunft von Schulprojekten gegeben und der Prozess zur Weiterentwicklung hin zum „Lernfeld Liebe und Lebenskunst“ mit der Vision eines mit Integrativen Inhalten angefüllten Schulfachs „Lebenskunst“, dargestellt.Within the scope of this field study in the north of Germany it is being explored with students to what extend „studying related to life“, „studying life-topics“ may be useful for education and the students themselves. Love and in this case particulary the topic „life and the creation of love relationships“ is in the focus of attention. This question is being approached by means of multi-perspectical and interdisciplinary approaches. In order to clear the question of the responsibility of school concerning „studying related to life“ by adding „life-topics“, the educational mission of schools in Lower Saxony is being examined. It is furthermore being discussed if the integration of particular „life-topics“ can be referred to as cultural work. The content discourse, which is being conducted on the three levels -love theme-educational mission-cultural work- will be supported by the field study and its evaluation. By inverting ab initio adhesive energy curves for the metal-MgO ceramic interfaces, We derive interfacial potentials between Ag and O2-, Ag and Mg2+, Al and O2-, Al and Mg2+. The interfacial potentials, obtained from this method, demonstrate general features of bondings between metal atoms and ceramic ions
Ab initio molecular dynamics study of AlCl4− adsorption on PEDOT conducting polymer chains
No full textIn the search for alternatives to lithium batteries, aluminium makes a promising negative electrode due to its high theoretical specific energy and energy density. One battery chemistry making use of an aluminium negative electrode is the aluminium–poly(3,4-ethylenedioxythiophene) (PEDOT) battery, which has been shown to have long cycle life and specific energy comparable to other aluminium rechargeable batteries. The battery stores AlCl4− anions in the PEDOT cathode when charged. However, the storage mechanism is not well understood. Here, ab initio molecular dynamics simulations (AIMD) are used to help understand the optimum (relaxed) configuration of AlCl4− anions when stored on a single chain of PEDOT. Two main conclusions arise. Firstly, it is generally not stable to have two anions adsorbed to one monomer unit, and this configuration can be avoided for future work. Secondly, AIMD does not find lower energy configurations for the PEDOT/AlCl4− system than DFT geometry relaxation, providing that the starting geometry does not have two anions on the same monomer unit. Based on our results, we believe it is likely that similar behaviour will be observed in other conducting polymer systems
Perceptions of pre- and post-event impacts of PEI 2014 year-long celebrations
No full textThis study examines Canadian perceptions of pre- and post-event impacts of the PEI 2014 Celebrations using the 2013 and 2015 surveys of PEI residents and other Canadians conducted by the Centre for Tourism Research. Overall, results indicate that Canadians’ awareness of, knowledge about, and attitudes toward the 1864 Charlottetown Conference and the PEI 2014 Celebrations increased and positively changed over time. The research also suggests that event organizers and/or destination tourism managers need to put greater emphasis on the “socio-cultural aspects” of the event such as community participation and cultural identity, and make an effort to increase tourism volume and value in order to obtain strong support from residents and be successful

No full textDiese Arbeit präsentiert Ergebnisse zur Competitive Balance in der Formel 1. Für den Zeitraum von 2008-2021 wurde die bedeutendste und nachhaltigste Regelveränderung bestimmt, und untersucht, ob diese positive Auswirkungen auf die Competitive Balance zeigt. Es wurde die Saison 2014 herangezogen, ab der ein neuer Hybridmotor zum Einsatz kam. Zu Beginn wurde der Hirschman-Herfindahl-Index für die Formel 1 als auch Formel 2 berechnet. In weiterer Folge wurde mit Hilfe eines Differenz-von-Differenzen-Ansatzes versucht, eine Kausalität festzustellen, ob die Einführung der neuen Motoren einen positiven Effekt aufweist. Die Überprüfung der Ergebnisse erfolgte anhand multipler linearer Regressionsanalysen und Tests auf Mittelwertunterschiede. Die Ergebnisse zeigten keinen kausalen Zusammenhang. No full textIn vielen Gesellschaften zeichnet sich seit Jahren der Trend eines sozialen Wandels ab. Man spricht von einem Umbruch der Gesellschaft. Zu den Ursachen der Veränderungen gehören der demographische Wandel, die Erosion des Solidaritätsgedankens und eine weit verbreitete Massenarbeitslosigkeit. Weitere Signale dieses gesellschaftlichen Wandels sind, nach Rolf Kramer, die Umgestaltungen des überlieferten Wertesystems, die Entstehung eines religiösen Pluralismus und die Wandlungen der Menschen im Verständnis ihrer Lebenseinstellung, des Alt-Werdens und Sterbens.Zu den Besonderheiten gehört eine Aushöhlung des christlich-humanistischen Fundaments. Hedonismus wird stattdessen besonders in der Jugend großgeschrieben. Globale Neuorientierung weist auf eine radikale Veränderung im ökonomischen Bereich hin.
