Going Beyond Counting First Authors in Author Co-citation Analysis
The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation
counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed
Адміністративна процедура за законодавством України та окремих зарубіжних країн (порівняльно-правове дослідження)
The relevance of the research topic is due to the need to analyse the experience of regulatory definition of administrative procedures in foreign countries. It characterizes models of systematizing procedural legislation in certain developed countries worldwide and in Ukraine. Emphasis is placed on Ukraine adopting a model of systematizing administrative procedural legislation that involves the adoption of a general act on administrative procedure with the preservation of the priority of special legislation. This approach aligns with the recommendations of the institutions of the Council of Europe and the European Union, particularly Recommendation CM/Rec(2007)7 of the Committee of Ministers of the Council of Europe of June 20, 2007, to member states on good administration, and the European Parliament Resolution of January 15, 2013, with recommendations from the Commission on Administrative Procedure Law in the European Union. The latter document envisages that the general act on administrative procedure should contain a universal set of principles and outline a procedure applicable as de minimis provisions when there is no lex specialis. The purpose of the article is to reveal the peculiarities of legal regulation of administrative procedures under the laws of foreign countries. It is argued that updated legislation should include referral norms that clearly address the legal practitioner (other subjects endowed with administrative-procedural legal status) to a specific procedure defined by sectoral legislation. This is particularly relevant to cases handled by administrative authorities on their own initiative. The study uses the comparative legal method to establish the common and distinctive features of legal regulation of administrative and procedural legislation of foreign countries. The author examines the peculiarities of legal regulation of administrative procedures in certain European countries. It is noted that the implementation of legislation on administrative procedure in Ukraine should be carried out using the existing experience of countries where the relevant changes have already been implemented. It is emphasized that in the future, attention should be focused on the formation of a homogeneous national law enforcement practice, which is determined by a unified approach to the interpretation of procedural law. Based on the study, the author formulates the following conclusions and makes recommendations: at the initial stage, it is worthwhile to establish communication between representatives (officials) of administrative bodies and judges of administrative courts with a view to taking a number of measures to ensure effective implementation of domestic administrative procedure legislation; to ensure data exchange within the administration and to identify practical problems which may arise in the process of harmonization of the entire array of legal acts around the basic Law of Ukraine "On Administrative Procedure".Актуальність теми дослідження зумовлено необхідністю проведення аналізу досвіду нормативного визначення адміністративних процедур у зарубіжних країнах. Охарактеризовано моделі систематизації процедурного законодавства в окремих розвинених країнах світу та в Україні. Наголошено, що Україна обрала модель систематизації адміністративного процедурного законодавства, якою передбачено прийняття загального акта про адміністративну процедуру із збереженням пріоритету спеціального законодавства. Наведений підхід відповідає рекомендаціям, ухваленим інституціями Ради Європи та Європейського Союзу, зокрема Рекомендації CM/Rec(2007)7 Комітету міністрів Ради Європи від 20 червня 2007 р. державам-членам щодо доброго адміністрування та Резолюції Європейського парламенту від 15 січня 2013 р. з рекомендаціями Комісії з адміністративно-процедурного права в Європейському Союзі. В останньому документі передбачено, що загальний акт про адміністративну процедуру повинен містити універсальний набір принципів і окреслювати процедуру, яка застосовується як положення de minimis, якщо не існує lex specialis. Мета статті полягає в розкритті особливостей правового регулювання адміністративних процедур за законодавством зарубіжних країн. Доводиться, що оновлене законодавство повинно містити відсильні норми, які чітко адресуватимуть правозастосовувача (інших суб’єктів, наділених адміністративно-процедурним правовим статусом) до конкретної процедури, визначеної галузевим законодавством. Особливо наведене стосується справ, які вирішуються адміністративним органом з власної ініціативи. Під час дослідження застосовано порівняльно-правовий метод для встановлення спільних та відмінних ознак правового регулювання адміністративно-процедурного законодавства зарубіжних країн. Розглянуто особливості правового регулювання здійснення адміністративних процедур в окремих європейських країнах. Зазначено про те, що впровадження законодавства про адміністративну процедуру в Україні слід здійснювати із застосуванням наявного досвіду країн, в яких відповідні зміни вже впроваджено. Наголошено, що в подальшому варто зосередити увагу на формуванні однорідної вітчизняної правозастосовної практики, що обумовлюється єдиним підходом до тлумачення норм процедурного законодавства. На підставі проведеного дослідження сформульовано висновки та надано такі рекомендації: на початковому етапі варто налагодити комунікацію представників (посадових осіб) адміністративних органів та суддів адміністративних судів з метою проведення низки заходів щодо ефективного забезпечення впровадження вітчизняного адміністративно-процедурного законодавства; забезпечити обмін даними всередині адміністрації та виокремити практичні проблеми, які можуть виникнути в процесі гармонізації всього масиву нормативно-правових актів навколо базового Закону України «Про адміністративну процедуру»; продовжувати здійснювати наукові дослідження з метою виявлення загальних тенденцій впровадження такого законодавства та, по можливості, вирішувати окремі аспекти, запозичуючи міжнародний досвід
Variations on the Author
“Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship
Appropriate Similarity Measures for Author Cocitation Analysis
We provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature. Dispelling the Myths Behind First-author Citation Counts
We conducted a full-scale evaluative citation analysis study of scholars in the XML research field to explore just how different from each other author rankings resulting from different citation counting methods actually are, and to demonstrate the capability of emerging data and tools on the Web in supporting more realistic citation counting methods. Our results contest some common arguments for the continued
use of first-author citation counts in the evaluation of scholars, such as high correlations between author rankings by first-author citation counts and other citation
counting methods, and high costs of using more realistic citation counting methods that are not well-supported by the ISI databases. We have done our best to complete the author checklist relating to the use of animals in the hut study. Note that the objective for the hut study was to evaluate the IRS treatment applications for residual efficacy against Anopheles mosquitoes, including the local An. coluzzii mosquito population. Cows were only used to attract mosquitoes into the huts and no tests were carried out directly on the cows. The author checklist is intended for use with studies where experiments are carried out on animals, which is why we have had such difficulty in completing this for the hut study, as many of the questions do not relate to how the cows were used
