The Practice of Adoption in the Sasak Community and Its Implications for Marriage Law in Indonesia
Adopting a child is a tradition that has long been practiced by Arab society and continues to this day. The practice of adopting children when Islam came was then perfected by the Prophet Muhammad PBUH, so that it has a basis in Islamic law. This study explores adoption practices in contemporary Sasak society and their implications for reformulating Islamic Marriage Law. This research uses a normative juridical approach analyzed with the theory of maqāṣid al-sharī'ah. The data analyzed are laws, legal regulations and decisions of religious courts on the island of Lombok, West Nusa Tenggara regarding child adoption cases and norms regarding child protection as normative legal material. These data sources are collected through documentation techniques and analysed using data compaction, display, and conclusion-drawing stages, employing analogical and teleological legal interpretation approaches. The study identifies three classifications of adopted children based on marital status and the presence of biological parents: legitimate children, illegitimate children, and children with unclear status. The research upholds the Islamic legal principle that adoption does not sever the child's lineage from their biological parents, even if their existence is unknown, and does not establish a lineage between the adopted child and their adoptive parents. The study has three implications for Islamic marriage law in Indonesia: including adoption provisions in the Marriage Law, eliminating the article that allows polygamy as a solution for childless couples, and adding requirements for marriages involving "unclear children" as authentic evidence to prove no blood relation between the prospective bride and groom, thus preventing invalid marriages
Perspektif Ulama Perempuan Sasak terhadap Relasi Gender dalam Perkawinan Sasak
This study aims to describe and identify the form of gender relations in the practice of Sasak marriage and to describe and map the perceptions of female clerics about equal and fair gender relations. The subjects of this research are female Sasak clerics who have expertise in the field of religious knowledge, have social roles, and become administrators or leaders of Islamic community organizations. The main source of data in this study is the perception of female Sasak clerics who are oral, written and action, both those that have been documented by themselves or other parties or those that have not been then drawn conclusions using inductive-deductive techniques. The results of the study show unequal gender roles, ranging from arbitration, authenticity and selabaran, pisuke, marriage contracts (ijab-qabul, witnesses, dowries, marriage sermons), penghulu, marriage certificates and sorong-sarah-ajikrame. Even though the female Sasak clerics understand that in theory of gender justice, there are indeed many positions of women as parties that are not equal to men in terms of Sasak marriage customs and Islamic Marriage Law. However, for those who have never carried out the Sasak marriage custom and those who have lived it, they are of the view that the thing that must be achieved by marriage is its goal, namely to become a sakinah, mawaddah wa rahmah family, which will be felt by those who hold a marriage, namely husband and wife. his extended family and of course his descendants. Households formed through the institution of marriage (both using adat and fiqh and Islamic law) will become educational institutions that continuously strive to provide understanding, knowledge, experience and skills that will mature their managers (husband and wife) as well as their offspring as students
Eksistensi Kelembagaan Ulama Perempuan di Nusa Tenggara Barat
This study aims to map the forms, strategies and impacts of social roles that have been carried out by PW Muslimat NU NTB and PW Aisyiyyah NTB. The data collection methods in this study were intensive observation, in-depth interviews and documentation. The process of data analysis in this study will be carried out in an on-going process in the field, so that it is easy to dig up missing data or confirm data that is still unclear. The results of the study show that the social roles that have been carried out by PW Muslimat NU NTB and PW Aisyiyyah NTB in gender inequality and injustice in NTB at this time can at least be reduced due to the hard work of Aisyiah and Muslimat NU with other groups, for example with almost equal education participation rates. between men and women at the SD/MI, SMP/MTS and SMA/SMK levels, even to the tertiary level. The consistency and continuity of the Aisyiah and Muslimat NU movements in boosting the dignity of women in NTB is something more than these two organizations compared to women's organizations that fall into the category of NGOs and NGOs which tend to be programmatic, casuistic and highly dependent on donors. Even the institutional pattern of NGO women's groups continues to change according to the "internal needs" of the NGO group and the NGO itself or "external demands" from donor groups
Dilema Desentraliasi Pendidikan Ma’arif NU di Nusa Tenggara Barat
Kebijakan desentralisasi penuh dalam penyelenggaraan dan pengelolaan satuan pendidikan menjadikan PP LP Ma’arif NU menetapkan kebijakan bahwa setiap satuan pendidikan yang dikelola di bawah naungan LP Ma’arif NU mempunyai susunan organisasi yang sesuai dengan jenis, jenjang, ruang lingkup, bidang tugas, dan besarnya rombongan belajar/kelas masing-masing. Desentralisai kewenangan kepada lembaga pendidikan NU ini meliputi hak kepemilikan atas semua asset pendidikan termasuk pengadaan, pengelolaan dan pengembangannya, penentuan struktur organusasi di sekolah, keuangan, standar SDM tenaga pendidik dan kependidikannya, bahkan termasuk manajemen pembelajarannya; kurikulum, evaluasi dan sebagainya. Lantas, dimana dan bagaimana peran, tugas dan fungsi LP Ma’arif NU NTB yang dibentuk sebagai departementasi PWNU NTB bidang pendidikan? Inilah problem dasar yang digali dalam penelitian ini. Metode Pembelajaran Pendidikan Agama Islam bagi Anak Berkebutuhan Khusus di SLB Negeri 1 Lombok Barat
An important component in learning is the method. The success or failure of a learning activity depends on the method used. Because it is the method that determines how the learning process is carried out in the classroom. The PAI learning method for ABK is a method used by PAI teachers in SLB so that the material presented is easy to understand and understand, so that SLB students can implement their understanding in everyday life. This study aims to identify and analyze the PAI learning method for children with special needs at SLB Negeri 1 Lombok Barat for the types of disabilities who are blind, deaf, mentally retarded and physically disabled. This research is a field research with a qualitative approach. Data collection was carried out using observation, interviews and documentation techniques. The research process lasted for almost 4 months with research subjects being PAI teachers, school principals, curriculum assistants, students with special needs and student guardians. The data analysis technique used is data collection, data condensation, data presentation and drawing conclusions. While the object of research is the learning method of Islamic religious education for Children with Special Needs in the types of disabilities who are Blind, Deaf, Mentally Disabled and Physically Disabled in SLB Negeri 1 West Lombok. The results showed that: the PAI learning method used by PAI teachers for the type of visual impairment is the lecture and question and answer method, the deaf class uses the lecture and demonstration method, the mentally retarded class uses the lecture method and the disabled class uses the lecture and question and answer method
The Battle Between Moderate and Fundamentalist Islamic Groups in Covid-19 Memes on Social Media
The COVID-19 pandemic not only leaves grief for its survivors but also triggers the netizens to create memes containing religious narratives, especially Islam. This research focuses on uncovering meme narratives about COVID-19 which contain the content of religious thought battles between moderate Islamic groups and fundamentalist Islamic groups. The results show that the COVID-19 global disaster has been used as an arena for fighting as well as promoting the thoughts of moderate Islamic groups versus fundamentalists by using memes as an instrument. The thinking of moderate Islamic groups is represented through COVID-19 memes that are rational and tolerant, while COVID-19 memes containing radical thinking content and blasphemy against certain religions and countries mark the thinking of fundamentalist Islamic groups
Beragama di Pulau Pariwisata Internasional : Pengalaman Toleransi Komunitas Muslim di Lombok Nusa Tenggara Barat
Muslim residents in tourist destinations are often seen as victims of the socio-religious impact of the tourism industry in their area. In contrast to this view, this article sees Muslims as important actors in maintaining Islamic traditions amid the negative influence of the tourism industry. This qualitative study focuses on revealing the religious experiences of Muslims in three international tourism islands on Lombok Island, particularly in maintaining Islamic teachings and synchronizing them with tourism activities. The results showed that Muslim residents in Gili Trawangan, Gili Gede and Kuta Village implemented the teachings of tolerant Islam to accommodate religious and economic interests in tourism destinations. Islamic teachings are maintained through independent, institutional-based strengthening, and strengthening by the government. This study recommends the importance of maintaining a tolerant Islamic tradition in international tourism destinations to support tourism and maintain Islamic teachings
Going Beyond Counting First Authors in Author Co-citation Analysis
The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation
counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed
Variations on the Author
“Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship
