“Tailor-made laws” in public law – introductory note
The theory of public law has traditionally provided for a rather clear distinction between the functions of the legislative and the executive power. In the past, the “tailor-made laws” had been frequently subject of academic interest in the German scholarship of public law. In Italy, legal scholars started to analyse “tailor-made laws” since the birth of Italian public law doctrine, suggesting nomenclatures and, above all, eligibility limits. The legislation of the Czech Republic has also some experience with the “tailor-made laws”. The article introduces some issues on “tailor-made laws” in Italy and in Czech Republic

Consular and Visa Services of Czech Diplomatic Missions Abstract The master's thesis, supervised by Professor Jakub Handrlica, provides an in-depth examination of the consular and visa activities of Czech diplomatic missions from the perspective of international administrative law and its implementation within the Czech legal system. It focuses on analyzing the legal frameworks and procedures that Czech diplomatic missions apply when carrying out their consular and visa functions, thoroughly exploring not only their international dimension but also their anchoring and regulation within Czech administrative law and the legal system in general. The thesis offers a a comprehensive overview of the functioning of the consular and visa agenda of Czech diplomatic missions, with an emphasis on the administrative aspects of these activities, drawing on relevant legal regulations and treaties that are part of the Czech legal order. The thesis also provides an analysis of the relationship between domestic regulations and international treaties while considering the specifics of applying Czech administrative law to foreign conditions. Konzulární a vízová činnost českých zastupitelských úřadů Abstrakt Diplomová práce pod odborným vedením prof. Jakuba Handrlici se podrobně zabývá konzulární a vízovou činností českých zastupitelských úřadů z pohledu mezinárodního práva správního a jeho implementace v rámci českého právního řádu. Zaměřuje se na rozbor právních rámců a postupů, které české zastupitelské úřady aplikují při vykonávání svých konzulárních a vízových funkcí, přičemž podrobně rozebírá nejen jejich mezinárodní rozměr, ale především jejich zakotvení a regulaci v českém správním právu a obecněji v právním systému. Práce nabízí ucelený pohled na fungování konzulární a vízové agendy českých zastupitelských úřadů s důrazem na správní aspekty těchto činností, přičemž se opírá o relevantní právní předpisy a smlouvy, které jsou součástí českého právního řádu. Práce rovněž poskytuje analýzu vztahu mezi vnitrostátními předpisy a mezinárodními smlouvami, a zároveň zohledňuje specifika aplikace českého správního práva na podmínky v zahraničí. “Inter-administrative Tie” of Administrative Acts in the European Union Law
The presented paper deals with specific phenomenon of the “inter-administrative tie” which some of the norms of the European Union law award to administrative acts issued by national administrative authorities. This “inter-administrative tie” implies the fact that legal consequences of these acts are not limited to the territory of a single state, but they constitute legal effects also in the territory of other states. The phenomenon isn’t based on a mere fiction, but rather on transboundary effects of certain administrative acts. Consequently, the “inter-administrative tie” implies a specific relation of reciprocity between the states concerned. Such reciprocity implies that a state issues administrative acts, having implications outside its own territory, and, at the same time, the state accepts implications of foreign administrative acts in its own territory. Act on Civil Liability for Nuclear Damage and Its Financial Coverage as a New Source of the Slovak Liability Nuclear and Civil Legislation
The study is dedicated to the key amendments of legislation regarding civil liability for nuclear damage occurring as of the effective date of January 1st, 2016, by virtue of new law which regulates civil law aspects of compensation of nuclear damage and related issues. Based on detailed analysis of new legislation the authors offer their opinion to the realized amendments, whereas they are trying to assess their actual impact on the aggrieved persons on one side as well on operator as a liable person on the other side. The authors do not avoid demonstration of possible application complications, whether persisting from the original Atomic Act or those which may arise out of the new legislation
Public administration in railway transport - changes in legislation
The law of railway transportation is a phenomenon affecting several other law branches in particular European Law, Commercial Law and Administrative Law. This thesis focuses on the last mentioned branch, i.e. Administrative Law. This thesis does not cover this issue comprehensively; however, it gives fundamental and comprehensive views on the issue. In addition to information on current legal situation and its background it provides information about the history of law of railway transportation and includes the topic of public transport services. In last twenty years the initiator of changes in law of railway transportation is mainly the European Union, which gradually liberalizes the railway transportation. Both national legislation and public services reflect and adapt to these changes. After summarising the history of law railway transportation this thesis gives overview on the important European legislation which determines national legislation in the Czech Republic. The main part of this thesis is about legislation issues in law of railway transportation in the Czech Republic. It focuses on the organisation of public administration according to the Railway Act and the jurisdiction of the Rail Administrative Authority including some aspects of the administrative proceedings there. Obligatory publication of information
Duty to Publish Information (Abstract) I chose as my topic the obligation to publish official records, its legal grounds and connections with other areas. The analysis includes practical aspects and takes into account rapid changes in technology and the much slower development of ad- ministrative law institutes. In this frame I wanted to develop a procedural plan to make the public authority fulfill its duty to publish information, using legal means. I chose as my topic the duty to publish records, since I believe it to be the easist, most economical and effective way to make public records available to the citizens. This is currently a hot political topic, since new legislatation is being prepared in this area both in the Czech Republic and in the European Union, which is a response to the rapid technological progress. Nevertheless, the jurisprudence has devoted much less attention to the obligation to publish information than to disclosing the records upon a request to an individual. The thesis is divided to introduction, theoretical part, practical part and conclusion. THE RIJEKA DRAFT OF A CONVENTION ON THE LIABILITY OF OPERATORS OF NUCLEAR SHIPS: A VERY LATE REQUIEM
Sessant’anni fa dal 20 al 26 settembre del 1959 si tenne a Fiume la novantesima Conferenza del Comitato marittimo internazionale (Comité Maritime International). Nell’approcciarsi alle sfide derivanti dai piani contemporanei di usare l’energia nucleare nel trasporto marittimo (in particolare di usare i reattori nucleari quale fonte per il trasporto sia di navi civili, che militari), la Conferenza adottò un disegno di convenzione avente lo scopo di porre in rilievo la questione della responsabilità degli
operatori di navi nucleari. Il disegno di convenzione manifestò il fatto che le questioni della responsabilità derivanti dalle navi nucleari differiscono considerevolmente rispetto a quelle questioni derivanti dalle operazioni dei reattori nucleari su terraferma. Tale disegno di convenzione, che successivamente divenne noto nella letteratura giuridica come “the Rijeka Draft”, offrì i principi fondamentali in materia
di responsabilità che si sarebbero dovuti applicare agli operatori delle navi nucleari. Il “Rijeka Draft” divenne di importanza cruciale per i successivi sviluppi nel campo del diritto nucleare internazionale ed in ispecie per l’adozione della Convenzione di Bruxelles sulla responsabilità delle navi nucleari all’undicesima sessione della conferenza diplomatica sul diritto marittimo nel 1962. Ad ogni modo, esso influenzò anche il contenuto di alcuni altri accordi bilaterali. Il sessantesimo anniversario del “Rijeka Draft” offre una buona opportunità per rivisitare i principi offerti dal disegno di convenzione, come anche per rivisitare l’impatto di questo disegno sul futuro sviluppo del diritto nucleare internazionale.Die Neunzehnte Konferenz des Internationalen Seeschifffahrtsausschusses (Comité Maritime International) wurde vor sechzig Jahren vom 20. bis zum 26. September 1959 in Rijeka gehalten. Als Antwort auf die Herausforderungen bezüglich der Nuklearenergienutzung in der Seeschifffahrt (insbesondere bezüglich der Nutzung von Kernreaktoren als Transportquelle für sowohl Passagier- als auch Militärschiffe), nahm die Konferenz einen Entwurf an, mit dem Ziel, die Haftung der Betreiber von Nuklearschiffen anzusprechen. Dieser Entwurf wiederspiegelte die Tatsache, dass die
Haftung, die sich aus Nuklearschiffen ergibt, sich von der mit der Betreibung von landgestützten Kernreaktoren verbundenen Haftung wesentlich unterscheidet. Dieser Entwurf, der später auch als „Rijeka-Entwurf“ in der Rechtsliteratur bekannt wurde, hat grundlegende Haftungsgrundsätze für Betreiber der Nuklearschiffe vorgesehen. Der Rijeka-Entwurf spielte eine große Rolle bei späteren Entwicklungen
im Bereich des internationalen Nuklearrechtes, insbesondere bei der Annahme des Brüssel-Übereinkommens über die Haftung von Betreiber der Nuklearschiffe auf der Elften Tagung der Diplomatischen Seerechtkonferenz in 1962. Er hat aber auch den Inhalt von einigen anderen bilateralen Übereinkommen beeinflusst. Das sechszigste
Jubiläum des Rijeka-Entwurfs bietet die Gelegenheit an, die Grundsätze des Entwurfs sowie auch sein Einfluss auf weitere Entwicklungen des internationalen Nuklearrechts erneut zu überprüfen.U Rijeci je pred šezdeset godina od 20. do 26. rujna 1959. održana devetnaesta konferencija Međunarodnog pomorskog odbora (Comité Maritime International). Suočavajući se s izazovima proizašlim iz korištenja nuklearne energije u pomorskom prijevozu (posebice vezano uz korištenje nuklearnih reaktora kao izvora prijevoza u putničkim i vojnim brodovima, na konferenciji je usvojen jedan nacrt, čiji je cilj
bio dotaći se odgovornosti poduzetnika-brodara nuklearnih brodova. Taj je nacrt reflektirao činjenicu da se odgovornost poduzetnika-brodara nuklearnih brodova znatno razlikuje od odgovornosti koja proizlazi iz nuklearnih reaktora smještenih na čvrstom tlu. Ovaj nacrt, koji je kasnije u pravnoj literaturi postao poznat kao „Riječki nacrt”, predvidio je temeljna načela odgovornosti za poduzetnike-brodare nuklearnih
brodova. Odigrao je i veliku ulogu u kasnijem razvoju međunarodnog nuklearnog prava, posebice pri usvajanju briselske Konvencije o odgovornosti poduzetnika-brodara nuklearnih brodova na jedanaestoj sjednici Diplomatske konferencije za pomorsko pravo 1962. godine. Utjecao je i na sadržaj nekih drugih bilateralnih sporazuma. Šezdeseta obljetnica Riječkog nacrta izvrsna je prilika za preispitivanje njegovih načela kao i njegovog utjecaja na daljnji razvoj međunarodnog nuklearnog prava.Sixty years ago, from 20th to 26th September 1959, the Nineteenth Conference of the International Maritime Committee (Comité Maritime International) was held in Rijeka. Facing the challenges arising from contemporary plans to use nuclear power in marine transport (in particular to use nuclear reactors as a source of transport for both civil and military ships), the Conference adopted a draft of a convention that aimed to address the issue of liability of the operators of nuclear ships. The draft convention reflected the fact that liability issues arising from nuclear ships considerably differ from those issues, arising from the operation of land-based nuclear reactors. This draft convention, which
became later widely known as “the Rijeka Draft” in legal literature, provided for basic liability principles that were to be applied to operators of nuclear ships. The Rijeka Draft became crucial for the later developments in the field of international nuclear law, in particular for the adoption of the Brussels Convention on the Liability of Nuclear Ships at the Eleventh Session of the Diplomatic Conference on Maritime Law in 1962. However, it also influenced the content of several other bi-lateral agreements. The 60th anniversary of the Rijeka Draft allows a good opportunity to revisit the principles provided by the draft convention as well as to revisit the impact of this draft on further
development of international nuclear law
