No full textLe titre II de la loi n° 2015-991 du 7 août 2015 portant nouvelle organisation territoriale de la République dite "NOTRe" vise à renforcer l'intercommunalité. Près de cinq ans après l'adoption de cette loi, un bilan d'étape s'impose. A-t-elle atteint les objectifs escomptés ? Dans tous les cas, comment en améliorer l'application ? Malheureusement, il apparait que sa mise en œuvre s'effectue, et encore à ce jour, dans la douleur (Partie 1). En effet, non seulement la loi NOTRe génère de nombreux conflits entre ses différents acteurs que sont l'Etat, les intercommunalités et les communes (titre 1), mais surtout, son application, voire même son bien-fondé, interrogent (titre 2). Une marche arrière étant impossible, seules des pistes d'améliorations doivent être envisagées (Partie 2). Celles-ci sont abordées, de manière adaptée, par une profonde évolution du rôle de chacun des protagonistes de la loi NOTRe (titre 1), ainsi que par une réflexion d'envergure sur les intercommunalités et leurs compétences (titre 2)The purpose of the title II from the law n° 2015-991 (7 august 2015) dealing about the new territorial organization of the French republic, so called law NOTRe is to strengthen the intercommunal relations. Nearly five years after this law has be approved and promulgated, we need now to check the results. Can we admit that the goal has been reached ? And whatever the answer is, how can we improve its application? Unfortunately, we have to admit that it's difficult to bring the law enforcement measures into play, and even up till now, the results are at pain. In fact, not only this so called law NOTRe creates disputes between the different actors ; the French state, the local authorities, the associations of communes…, but even more, we can interrogate ourselves on its enforcement, and even on its rightfulness (or legitimacy). It's clearly not possible to step back. We can only go ahead and examine the different ways to improve the consequences of this law. We are therefore exposing these possible improvements on a symmetrical points of view, through first of all, the study of the deep evolution of the role of each one of the actors of this law (Title 1), and secondly through a major study of the intercommunal relations and the competences that were given to these actors ((title 2
