    Russkaya Pravda of Yaroslav Mudryi, the origins and traditions of national legislation

    Problem setting. The emergence of the first national legal code – Russkaya Pravda was associated with the name of Grand Prince Yaroslav Mudryi. Since the law is normative background of the whole legal system, scientific interest represents research of hereditary traits «legal rights» if Kievan Rus’ and modern Ukraine. Although the level of law development and legal consciousness, the place in society life, learning values and legal conditions for a thousand years in our country have changed drastically, but remained from past times in succession important principles, traditions and institutions. Recent research and publications analysis. The authors of fundamental monographs «Legal custom as a source of Ukrainian law» / By Edition of. I. B. Usenko (2006), «The legal system of Ukraine: history, status and prospects» : 5 t. Vol. 1 (2008), new articles in the book «Russkaya Pravda of Yaroslav Mudryi, the beginning of legislation of Kievan Rus’» (2014 ) examined the sources of law of Kiev Rus, the use of customary law in the legal system of Ukraine. In this article attention is focused brief analysis on certain principles of succession and norms of institutes of the Russkaya Pravda (RP) of Yaroslav Mudryi and modern Codes of Ukraine and their interpretation in scientific comments. Paper objective. «Truth» in Russia is understood as a law by common law – justice. It is in the law of justice – its universal and timeless value. Since the days of long RP customary law were on a par with the norms of written law. In Ukraine, the legal tradition is an additional source of law, its role is increasing in terms of expanding the scope of private law. The article analyzes the norms of articles Civil Code of Ukraine, the Family Code of Ukraine that provides, as in RP the application of customs, established in civil relations. Paper main body. By comparing articled of ancient code with the relevant articles of the Criminal Code of Ukraine, the author concludes: Old Russian and modern legislators consider the protection of human life as the major task, the same consider the actus reus of criminal act. RP is not only limited the use of blood revenge, but removed the death penalty from the list of punishments by princely court. This punishment was not allowed by the Criminal Code of Ukraine, thereby continuing the RP humane line in criminal law. Both legal acts, separated by a thousand years, settled two main objectives – protection of public relations from criminal offenses, the prevention of crime. RP envisaged the protection of individual human rights - the boyars, freemen, even dependent people (villains) and slaves. The legislator aimed to establish principles of equality in the state as it was understood that time. In times of Yaroslav Mudryi, Yaroslavichey and Vladimir Monomakh, Rus’ did not know persecution of people based on their religious beliefs, direct or indirect restriction of rights, or privileges on grounds of religious belief, gender, economic status or place of residence. Conclusions. It is concluded that the historical type of the Russkaya Pravda and modern domestic legal system, despite the past millennium, in total reflects – national traditions in legal understanding, evolution of legal consciousness and culture of the people, the principles of humanism, rule of law, legality, respect to human dignity etc. They reflect the continuity of the legal system of Ukraine initiated by customary law of Kievan Rus’, Russkaya Pravda of Yaroslav Mudryi.У статті на основі порівняльного аналізу визначено спільні спадкоємні риси «законодавчого права» Київської Русі й сучасної України.В статье на основе сравнительного анализа выделены общие преемственные черты «законодательного права» Киевской Руси и современной Украины

Sporting holidays: calendar, folklore, ceremonial, the days of name-days celebrations are held according to a Christian calendar (Christmas, Maslyana, Easter, Trinity).  They are formed on accessible to children material with the use of folk mobile games, funs, folk round dances, songs, attributes of national clothes, appliances. The use of folk physical training facilities during the realization of sporting holidays will enable not only to increase the efficiency of physical health-improving process but also will have a positive influence on the state of health and motive preparedness of senior children under school age, and also will form their interest to the systematic physical training lessons

    У статті проаналізовано різножанрові твори українських і зарубіжних письменників про доньок Ярослава Мудрого, які стали королевами європейських держав. Авторка осмислила художню інтерпретацію образу князя-реформатора і його доби в цих творах. Письменники різних національних літератур прагнули поєднати художню правду з історичною, неупере- джено зобразити відомі факти життя і діяльності Ярослава Мудрого. Образ великого князя київського у творах про його знаменитих доньок епізодичний. Переважно його зобража- ли глибокодумним державником, далекоглядним політиком, освітнім і культурним діячем. Доповнювали літописний образ прагнення авторів розкрити внутрішній світ князя Яро- слава, показати його звичайною людиною, чоловіком і батьком. Проблеми неповноти і супе- речностей історичних джерел письменники вирішували творчо. Письменники приймали або заперечували окремі версії подій, відсутні подробиці компенсували художніми домислами. Основними джерелами правдоподібності художньої оповіді в аналізованих творах були русь- кі літописи, іноземні хроніки, скандинавський фольклор, праці істориків-медієвістів. У худож- ній інтерпретації історичного минулого й історичних постатей митці різних літератур намагалися дотримуватися усталених в історіографії їхніх країн поглядів. Для українських письменників першорядним є прагнення здолати імперські міфи про Київську Русь, пробу- дити історичну пам’ять Нації, підвищити опірність національного організму до будь-яких імперських маніпуляцій.The article analyses the multi-genre works by Ukrainian and foreign writers about the daughters of Yaroslav the Wise, who became the queens of European states. The author comprehends the artistic interpretation of the prince-reformer image and his era in these works. The writers of various national literatures sought to combine artistic truth with historical, impartially depict the well-known facts of the life and work of Yaroslav the Wise. The image of the Kyiv Grand Prince is episodic in the works about his famous daughters. Mostly he is portrayed as a thoughtful statesman, a visionary politician, an educational and cultural figure. The chronicle image is supplemented by the desire of the authors to reveal the inner world of Prince Yaroslav, to show him as an ordinary person, husband and father. Writers solved the problems of incompleteness and contradictions of historical sources creatively. They accepted or denied separate versions of the events; the missing details were compensated by artistic guesses. The main sources of credibility of the artistic narrative in the analyzed works were Russian chronicles, foreign chronicles, Scandinavian folklore, and the works of medieval historians. In the artistic interpretation of the historical past and historical figures, writers of various literatures mainly adhered to the views established in the historiography of their countries. For Ukrainian writers, the paramount is the desire to overcome the imperial myths about Kievan Rus, to awaken the historical memory of the Nation, to increase the resistance of the national organism to any imperial manipulations

    Numerical Simulation of Taylor—Couette—Poiseuille Flow at Re = 10,000

    A fully developed turbulent flow in a concentric annulus, Re =10,000, ri/ro=0.5, with an inner rotating cylinder in the velocity range N=Uω/Ub=0÷4, is studied via a large-eddy simulation. Also, for comparison, simulations by steady-state, unstatiounary RANS k-ω SST (URANS), and Elliptic Blending Model (EBM) were made. The main focus of this study is on the effect of high rotation on the mean flow, turbulence statistics, and vortex structure. Distribution of the tangential velocity and the Reynolds stress tensor change their behaviour at N>0.5∼1. With rotation increases, the production of tangential fluctuation becomes dominant over axial ones and the position of turbulent kinetic energy maximum shifts towards the wall into the buffer zone. URANS and EBM approaches show good agreement with LES in mean flow, turbulent statistics, and integral parameters. The difference in pressure loss prediction between LES and URANS does not exceed 20%, but the average difference is about 11%. The EBM approach underestimates pressure losses up to 9% and on average not more than 5%. Vortex structures are described well by URANS

    THE MOTIVE OF CATASTROPHISM IN THE DYSTOPIAN GENRE POETICS: KAZUO ISHIGURO AND YAROSLAV MELNIK

    The article examines the concept of catastrophe as an art theme, which is extremely relevant in our time and is also marked by the entropy features. We can confirm that this phenomenon grows and affects many spheres of human life, both external (global, social) and internal (psychological). The author of the article focuses on how modern dystopia reflects an awareness of a catastrophe, which is happening or has already happened. We have analyzed two novels from this point of view: “Masha, or the Fourth Reich” by the French writer of Ukrainian origin Yaroslav Melnyk and “Never Let me Go” by the English writer of Japanese origin Kazuo Ishiguro. The article emphasizes that the dystopias of our time correct classical dystopia attitudes, because they tend to the diffusion of new genres, acquiring the features of a parable novel, a myth novel, an alternative history fiction, and a philosophical novel. We have also noted the controversial nature of new formations, which combine signs of utopia and dystopia. Regarding the ideological and thematic component, the author of the article states that Ya. Melnyk and K. Ishiguro focus on the traditional problems of humanism and the relationship between “man and society” and on individual’s catastrophic depopulation issues in the conditions of nowadays turbulent challenges. The purpose of the article is to study the specificity of catastrophism artistic embodiment in the novels “Masha, or the Fourth Reich” by Yaroslav Melnyk and “ Never Let me Go ” by Kazuo Ishiguro and its functions in the structure of the dystopia genre. To achieve this goal we used historical-literary, cultural-historical and hermeneutic research methods. It was determined that the catastrophism motif realization in the dystopia genre contributes to searching for new experimental forms, activates the processes of transformation and diffusion in the genre creation field, paradoxically and organically combines classic and modern elements of dystopia, renewing the poetics of the genre. Conclusion. Kazuo Ishiguro’s novel “Never Let me Go” demonstrates a powerful example of genre synthesis: “stream of consciousness” coexists with the classic English estate novel, which is emphasized by confessional and allegorical intonations and does not prevent the writer from resorting to some possibilities of a detective story. Features of the traditional parable form and mythological genre are also observed. Fantastic elements are interspersed with realistic ones. But allegorical, mythological, fantastic, and realistic features organically coexist in the novel, reinforcing the author’s main ideas. Yaroslav Melnyk in his novel “Masha, or the Fourth Reich” successfully synthesizes an alternative history novel, an adventure novel and a classic philosophical novel. Here conflicting utopia and dystopia also organically coexist, reinforcing each other. A dystopia genre structure becomes open and acquires unlimited hybridization, losing its classical features and even postmodern boundaries. Thus, the catastrophic reality of the 21st century promotes the search for new experimental forms, activates unpredictable processes in the genre creation field, and paradoxically and organically combines classical and modern elements of literary art. Once again, modern dystopian literature shows that “common issue” as a social slogan cannot satisfy individual human needs. The problem of egocentrism with the insufficient development of the political machine is becoming more and more acute. As a general phenomenon, consumer society does not justify itself and makes the lives of its sons doomed. Unfortunately, the heroes of modern dystopias less and less often choose to fight and more often to humble themselves or flee, which is the main difference from their classical predecessors. The prospects of further work are to deepen the understanding of the causes of stylistic and substantive differences in dystopias, the influence of socio-cultural reality on modern dystopias genre synthesis, the differences in the methods of utopian representation and artistic means of enhancing catastrophization within stories framework
