THE ROLE OF LEGAL CULTURE IN THE ADMINISTRATION OF NATIONAL LAW IN A PHILOSOPHICAL POINT OF VIEW
The legal point of view is often divided into two major views, namely the juridical view and the sociological view, both points of view cannot be separated from the role of legal culture, legal culture can be said to be the pulse, and the joints of the law itself, the law that processes in such a way, unites with time, within a certain period of time, making the legal culture very inherent in society, both in behavior, habits, and legal views, in fact, legal culture is often a benchmark for whether a rule can process correctly or not, the purpose of this study is to find out how the role of legal theory in legal culture problems, and the second is how the implications of regulations from the point of view of legal culture. The research method used in this study is a normative juridical research method, which is a research method that makes secondary data as the main data, for then the data comes from legislation, books, and accredited journals both offline and online. Which of course leads to the main discussion about the role of legal culture itself. The application of law cannot be separated from the so-called legal culture, along with the legal structure and legal susbtantion, these three things are factors in how sociologically the community will see the law. Philosophically, legal theory is to be an analysis knife of all legal rules that will later be made or applied, legal theory greatly determines whether the legal rules implemented have clear targets or not, then consistency becomes a big thing in the implications of legal culture that is in direct contact with the rules that are also applied in a region
JURIDICAL REVIEW OF GLOBAL TRENDS RESTRUCTURING THE BILATERAL INVESTMENT TREATY MODEL IN THE POINT OF VIEW OF THE INDONESIAN LEGAL SYSTEM
The economic growth of a country is inseparable from the economic system adopted by the country, not only that tactical and targeted steps are also important in increasing economic growth in a country, therefore in international associations, collaboration between countries is needed, with various forms, along with the times, treaty models and collaboration models, one of which is bilateral investment agreements. The purpose of this study is to find out what is the qualification of the Bilateral Investment Treaty itself, and how is the application of the Bilateral Investment Treaty between countries carried out by Indonesia. The research method used in this study is a normative juridical method, which prioritizes secondary data, such as legal rules, books and legal journals, both online and offline. The restructuring of this bilateral investment treaty is the key to the success of collaborative relations between States, this creates a stigma that large countries can no longer depend on clauses that are not in accordance with the times, or are no longer relevant to the current situation. This is a good momentum because relations between countries are no longer biased when making a treaty, but as the name implies, international agreements between two countries at this time can be truly bilateral, fair and agreed to find solutions that benefit both parties
Going Beyond Counting First Authors in Author Co-citation Analysis
The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation
counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Variations on the Author
“Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship
Kewenangan Kepala Desa dalam Pengalihan Tanah Kas Desa Ditinjau dari Undang-Undang Nomor 32 Tahun 2004 tentang Pemerintahan Daerah Juncto Undang-Undang Nomor 6 Tahun 2014 tentang Desa Dadn Undang-Undang Nomor 5 Tahun 1960 tentang Peraturan Dasar Pokok-Pok
Otonomi desa memberikan kewenangan terhadap kepala desa dalam mengelolah kekayaan desa secara mandiri, untuk mengatur secara penuh urusan pembangunan desa. Pengalihan tanah kas desa merupakan kewenangan kepala desa yang sebelumnya telah memperoleh persetujuan dari Bupati dan Gubernur sesuai dengan Peraturan Menteri Dalam Negeri Nomor 4 Tahun 2007 Tentang Pedoman Pengelolaan Kekayaan Desa. Tujuannya untuk pembangunan desa. Dengan lahirnya UUPA tanah bengkok merupakan hak pakai, sehingga peralihan hak terhadap tanah bengkok mengikuti aturan peralihan hak atas tanah hak pakai yaitu Peraturan Pemerintah Nomor 40 Tahun 1996 Tentang Hak Guna Usaha, Hak Guna Bangunan, dan Hak Pakai Atas Tanah. Masalah hukum yang terjadi adalah belum berjalan dengan baik sistem pendataan kekayaan desa yang dikelola oleh desa maupun yang telah dialihkan kepada pihak ketiga sesuai dengan peraturan perundang-undangan. Penelitian ini bersifat deskriptif analisis yang dilakukan dengan pendekatan yuridis normatif.Sumber data diperoleh dengan mengumpulkan data primer dan data sekunder, pengumpulan data primer dilakukan dengan wawancara dengan narasumber sedangkan data sekunder diperoleh dari peraturan perundang-undangan dan literatur. Selanjutnya data dianalisis secara kualitatif. Hasil penelitian ini menunjukkan belum berjalan dengan baik kewenangan kepala desa dalam pengelolaan dan pengalihan tanah kas desa. Pengalihan tanah kas desa yang dilakukan oleh kepala desa banyak yang tidak sesuai dengan peraturan perundang-undangan yang ada, seperti pengalihan tanah kas desa kepada pihak ketiga tanpa adanya dasar hukum yang jelas, sehingga tidak adanya kekuatan hukum bagi pemerintahan desa maupun pihak ketiga. Pengalihan tanah kas desa yang dilakukan oleh kepala desa sesuai dengan peraturan perundang-undangan sendiri tidak didukung dengan sistem administrasi yang baik oleh kantor pemerintahan desa, sehingga memungkinkan timbulnya sengketa jual beli terhadap tanah kas desa yang telah dialihkan kepada pihak ketiga
Appropriate Similarity Measures for Author Cocitation Analysis
We provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature. Dispelling the Myths Behind First-author Citation Counts
We conducted a full-scale evaluative citation analysis study of scholars in the XML research field to explore just how different from each other author rankings resulting from different citation counting methods actually are, and to demonstrate the capability of emerging data and tools on the Web in supporting more realistic citation counting methods. Our results contest some common arguments for the continued
use of first-author citation counts in the evaluation of scholars, such as high correlations between author rankings by first-author citation counts and other citation
counting methods, and high costs of using more realistic citation counting methods that are not well-supported by the ISI databases. It is argued that increasingly available digital full text research papers make it possible for citation analysis studies to go beyond what the ISI databases have directly supported and to employ more

We have done our best to complete the author checklist relating to the use of animals in the hut study. Note that the objective for the hut study was to evaluate the IRS treatment applications for residual efficacy against Anopheles mosquitoes, including the local An. coluzzii mosquito population. Cows were only used to attract mosquitoes into the huts and no tests were carried out directly on the cows. The author checklist is intended for use with studies where experiments are carried out on animals, which is why we have had such difficulty in completing this for the hut study, as many of the questions do not relate to how the cows were used
