    Juridical Analysis on the Copyright of Modification and Customization of Android Software

    Abstract— Android is a mobile operating system developed by Google. It is usually used by several smartphones and tablets. The Android System (OS) is an open source, meaning developers can modify and customize the OS for each phone. Despite the fact that the creator of the Android system must have held the copyright on the appearance of the software which he created. This issue raises the problem: whether or not modifying and customizing the appearance of the Android System will infringe the copyright which is possessed by the holder. By researching, the author would seek on the status of the modified/customized Android Software and the legal consequences of the modified and customized Android System. The result of this legal research lies in the agreement that is proposed to modifier when they are about to download or install the software itself (by clicking yes/accept). This legal research is conducted by using normative legal research methods, using library research as a data collection technique and qualitative normative techniques as a data analysis technique, by juxtaposing legal theories as analytical knives.     This article explains the theory of international trade law as framework for trade agreements between nations. What began as a multilateral agreement for member states of World Trade Organization was then narrowed down into regional and bilateral agreements due to geographical, social and economical concerns. In such case, the Association of South East Asian Nation, including Indonesia has established a bilateral agreement with China under the Asean-China Free Trade Agreement (ACFTA) which opens numerous opportunities but also cumbersome trade negotiation scheme. The author intends to argue that free trade agreements had shifted overtime from a wider scope with less stringent rights and responsibilities to a more complex agreement with options of tariff and non tariff barrier removal. As such, government should scrutinize free trade agreements according to the national economic necessity as opposed to the international demand in order to avoid social and economic risks. Dalam hal demikian, Asosiasi Asia Tenggara Nation, termasuk Indonesia telah membentuk perjanjian bilateral dengan Cina di bawah ASEAN-China Free Trade Agreement (ACFTA) yang membuka banyak kesempatan tetapi juga skema negosiasi perdagangan rum it.     Theoretical Review on Indonesian Academic Legal Education in Conjunction with ASEAN Economic Community Era

    Indonesia will be welcoming the ASEAN Economic Community in 2015 as a multilateral agreement to create integrated regions such as: (a) a single market and production base, (b) a highly competitive economic region, (c) a region of equitable economic development, and (d) a region fully integrated into the global economy. These characteristics are interrelated and mutually reinforcing in a sense that overall development would not be complete without total completion of the previous sector. This article discusses the participation of Indonesia as part of ASEAN as a single market and production base, through free flow of services which targets higher education in law. The author researched that Indonesian higher education system still faces issues, especially in legal education. Compared to other states that manages higher education in a relatively guided term, Indonesian legal education is still regulated generally by the government, operated by state and private educational entity, and further trained by profession organization. Indonesian legal education standard has not been supported by proper accreditation bureaucracy from BAN-PT or fair treatment from the government between state and private university. As a result, the quality of Indonesian law graduate still varies. Indonesian legal education is special in nature since it is considered profession and regulated by code of ethic. According to the author, legal education should be integrated with profession organization so that upon graduation, law graduates can directly conduct internship according to their desired profession and compete against ASEAN law graduates

    Pembentukan Lembaga Pengawas Perlindungan Data Pribadi Di Era Ekonomi Digital : Kajian Perbandingan Dengan KPPU

    In recent years, the advancement of information and communication technology has made the circulation of personal data in Indonesia difficult to control, and cases of personal data breaches that harm consumers have often occurred. As a country that has specific regulations protecting personal data, there is a need for an overseeing institution to monitor the circulation of such personal data. However, up to this day, the government has not established this institution, causing uncertainty regarding the implementation of Law 27/2022. In conducting this research, the Author adopted a normative juridical research method, involving various approaches such as statute approach, conceptual approach, and comparative approach, with the aim of gaining a deeper and more comprehensive understanding of the analyzed issue. Based on the conducted analysis, the Author finds that the establishment of a Personal Data Protection Supervisory Institution would bring about numerous positive benefits, therefore this institution needs to be established promptly for Indonesia to achieve adequacy status. However, the form of this institution is still under debate as attaching it to the Ministry of Communication and Informatics may lead to a conflict of interest. In essence, Indonesia already has several independent state institutions, one of which is the Indonesia Competition Commission. Indonesia Competition Commissionis an independent state institution with a quasi-judicial model that cannot be intervened by any party in its handling, decision-making, or investigation of competition cases. Hence, drawing lessons from Indonesia Competition Commission, the Author's view is that the Personal Data Protection Supervisory Institution should ideally be established as an independent state institution due to the similarities it shares with Indonesia Competition Commission. Sebagai negara yang telah mempunyai regulasi khusus yang melindungi data pribadi tentunya membutuhkan suatu lembaga yang berperan mengawasi peredaran data pribadi tersebut. Namun, hingga hari ini lembaga tersebut belum dibentuk oleh Pemerintah sehingga menimbulkan ketidakpastian terhadap implementasi UU No. 27 Tahun 2022. Dalam proses penyelenggaraan penelitian ini, Penulis mengadopsi jenis penelitian yuridis normatif, yang melibatkan pendekatan beragam seperti statute approach, conceptual approach, dan comparative approach, dengan tujuan untuk mendapatkan pemahaman yang lebih mendalam dan komprehensif mengenai isu yang sedang dianalisis. Berdasarkan analisis yang telah dilakukan, Penulis menemukan bahwa kehadiran Lembaga Pengawas PDP memiliki banyak manfaat positif sehingga lembaga ini harus segara dibentuk agar Indonesia mencapai status adequacy. Meski demikian, bentuk dari lembaga ini masih diperdebatkan karena apabila dilekatkan dengan Kominfo maka dapat menimbulkan conflict of interest. Sejatinya, Indonesia sendiri telah memiliki sejumlah lembaga negara independen yang mana salah satunya adalah KPPU. KPPU sendiri merupakan lembaga negara independen dengan model quasi-judicial yang tidak bisa diintervensi oleh pihak mana pun dalam melakukan penanganan, pengambilan keputusan, atau penyelidikan terhadap perkara persaingan usaha. Oleh karena itu, berkaca dari KPPU maka Penulis berpandangan bahwa Lembaga Pengawas PDP haruslah dibuat dalam bentuk lembaga negara independen sebagai bentuk paling ideal karena memiliki sejumlah kemiripan antara KPPU dan Lembaga Pengawas PDP.     The Analysis of the Role & Obligations of Notaries in Protecting Data Security Based on the Personal Data Protection Law

    Notaries as public officials who are authorized to make authentic deeds carry out their duties and authorities inseparable from the processing of Personal Data, both physical and electronic. Notaries process Personal Data not only for Personal Data subjects, namely Clients, but also for workers or interns, or third parties whose information is provided by the Client. Since the enactment of the PDP Law, Notaries as officials who make authentic deeds in processing Personal Data are not only obliged to maintain the confidentiality of Personal Data, but there are also several other obligations regulated in the PDP Law as an effort to prevent and eradicate potential cybercrime. In this study, the author will dissect the role and obligations of Notaries in the security of Personal Data based on the PDP Law. The study used a normative legal method with a statutory approach and a conceptual approach. Through this study, it is concluded that a Notary as an official who makes authentic deeds has a crucial role, namely as a Personal Data Controller who can determine the purpose and method of processing personal data. Notaries have several obligations as regulated in the PDP Law, including having a basis for processing, ensuring the security of personal data, assessing the impact of Personal Data Protection, recording all personal data processing activities, appointing Personal Data Protection officials, fulfilling the rights of personal data subjects, and others. The ultimate goal of this study is expected to provide knowledge and legal certainty related to Personal Data Protection in notarial practice

    As a result of the influence of world globalization, with the rapid development of international relations and the development of information technology, the need to know the law of other legal systems in the world is increasingly felt so that lately the development of knowledge about comparative law is very fast. That is what is felt closely related to PT XYZ with PT ABC Sdn. Bhd. in Malaysia. So that in the end raises the problem of how the construction of digital product sales cooperation agreements with the Multi-Level Marketing (MLM) system between the two companies and what the implementation of the partnership between the two companies is like. Therefore, the purpose of the problem is to find out and describe in detail the model of the digital product sales agreement with the MLM system and how the implementation of the cooperation agreement should be carried out in the perspective of rules in Indonesia and Malaysia. If the existing law does not explicitly determine the cancellation of the prohibited agreement, it is not necessary and will be confusing to find the cause of the cancellation of the agreement (i.e., because of the prohibited cause). The agreement was canceled not based on the provisions of article 1335 and 1337 of the Indonesian Criminal Code, but based on the provisions of the law which stated it. The cause of the agreement is the purpose of the agreement made by the parties. However, it cannot be said that if the parties agree means the purpose of the parties is an act (which is without a false or prohibited cause).
