Lidiando con el 'efecto Funes': en torno de la posibilidad de una historia literaria
Get PDFThis work discusses the feasibility conditions for a literary history in the beginning of the 21st century, when many of this discipline's assumptions has been put at stake. Taking as a starting point David T. Gies' article ("The Funes effect: making literary history"), which homologates the situation of the literature historian with the character of Borges' story, overwhelmed by the accurate remembrance of every details and, therefore, unable to think. After going through all the apories and limitations that haunt anyone who dares to write literary history, Gies limits himself to point out the endurance of a practice as impossible as inevitable, since a reluctant offer is still surpassed by a persisting demand. This article attempts to go beyond Gies' pragmatic answer and proposes arguments for struggling with "the Funes effect" and supporting the historical-literary research motives. In order to do this, it focuses in two capital matters: the possibility of a historical contextualization of texts and the narratization of a literary past as a legitimate way of knowledge. The concrete exemplification reflects the specific field of studies of the author - Hispanic medievalism

No full textEl trabajo discute las condiciones de posibilidad de una historia literaria a comienzos del siglo XXI, cuando muchos de los presupuestos de esta disciplina han sido puestos en entredicho. Toma como punto de partida el artículo de David T. Gies ("The Funes effect: making literary history") que homologa la situación del historiador literario con la del personaje del cuento de Borges, abrumado por la exacta memoria de todos los detalles y, por ello, imposibilitado de pensar. Luego de pasar revista a todas las aporías y limitaciones que acosan a quien intenta escribir historia literaria, Gies se limita a señalar la pervivencia de una práctica tan imposible como inevitable, pues todavía una oferta renuente se ve superada por una demanda insistente. El trabajo intenta ir más allá de la respuesta pragmática de Gies y plantea argumentos para lidiar con el "efecto Funes" y sustentar la razón de ser de la investigación histórico-literaria. Para ello, se enfoca en dos cuestiones básicas: la posibilidad de una contextualización histórica de los textos y la narrativización de un pasado literario como forma legítima de conocimiento. Memória e esquecimento: o excedente de visão em Funes, o memorioso, de Jorge Luís Borges
No full textThis research analyzed the issues of memory and oblivion in Funes the Memorious, by Jorge Luis Borges, based on Bergson (2009), Halbwachs (1990) and Le Breton (1999), among other authors to discuss these issues. In addition, the main character’s reading was based on Mikhail Bakhtin’s concept of excess vision. The results of the analysis showed that the memory in Borges’ text is built by intense contact with the imagination and also that the excess of vision testifies that Funes, as he gains an extraordinary ability to remember, loses the ability to forget.Esta investigação analisou as questões sobre a memória e o esquecimento em Funes, O Memorioso, de Jorge Luis Borges, com base em Bergson (2009), Halbwachs (1990) e Le Breton (1999), entre outros para discutir estes temas. Além disso, a leitura do protagonista baseou-se no conceito de Mikhail Bakhtin do excesso de visão. Os resultados da análise mostraram que a memória no texto de Borges se constrói por um contato intenso com a imaginação e também que o excesso de visão testifica que Funes, à medida que ganha uma capacidade extraordinária para recordar, perde a capacidade necessária para esquecer

Promoción y formalización de las relaciones laborales en Argentina
Get PDFLas relaciones laborales que vinculan a empleadores y empleados en Argentina pueden ser de múltiples formas, cada una de ellas con sus rasgos distintivos. Durante muchos años el fenómeno de la informalidad ha afectado estas relaciones, logrando instalarse cada vez con mayor fuerza en nuestro país, lo que representa un gran desafío de lucha para el gobierno nacional y la sociedad. La presente investigación se propone ahondar en esta problemática, analizando la normativa vigente de aplicación, las causas que la generan y el rol que cumple el Estado para afrontarla, desde el punto de vista de la detección como de su promoción. Partimos de un marco teórico amplio y profundo, cargado de definiciones y normativa, para poder determinar las características más importantes del fenómeno sometido a análisis. Se busca conocer los factores que intervienen, sus cualidades y su dinámica. Para el desarrollo del trabajo tomamos como fuente de información libros de especialistas en materia laboral y la complementamos con noticias de actualidad, todo referido al contexto argentino. Luego del análisis destacamos las siguientes conclusiones: 1) el fenómeno de la informalidad en las relaciones laborales argentinas puede darse de manera voluntaria o involuntaria por parte de los trabajadores, teniendo también influencia el factor cultural del país; 2) la informalidad no es la única que afecta al empleo en Argentina, existen relaciones formales con índices de precariedad y carecen de los rasgos que definen a un “trabajo decente"; 3) el rol del Estado es fundamental en la aplicación de políticas y programas que luchen contra la reducción de los niveles de trabajos informales, la mejora en la fiscalización laboral y el aumento de la promoción de la formalización son objetivos clave que deben ser impulsados por el gobierno, pero acompañados por la sociedad en su conjunto.Fil: Hazim, Leandro Matías. Get PDFStudies the presence of the feminine behavior in the twine poetry of Leandro Gomes de Barros, from the brazilian cultural revalorizes in its multiple looks, which if they had reflected, in the diverse scientific, educational and social fields. For in such a way, it establishes the boarding of literary and social analysis from the perception of the feminine universe in the twine. It points out the sprouting of the twine literature, with the focus directed to its characteristics and formal structure. Feminist verifies the epistemological analysis – that she confers practical the feminine behavior as contributing in cultural the popular author twine, the source of the woman participant author and not personage of the twine. From this context, concernment‘s questions to the resistance of the twine literature will be displayed until the contemporary, and the relation of the author twine with the presence of the constituent woman while and/or to be constituted. They will not leave of being boarded: the analysis of the feminine image printed in twines, from the technique and aesthetic xylographical; the presentation of biographical peculiarities of Leandro Gomes de Barros and analysis of the feminine behavior in infancy, adolescence, maturity and oldness. Also relative attributions to the relation will be made man/woman, characterized for the seduction and feminine devoir of the twine literature using itself of concepts of being able constituent, common singularity and.Estuda a presença do comportamento feminino na poesia de cordel de Leandro Gomes de Barros, a partir da revalorização cultural brasileira em seus múltiplos olhares, os quais se refletiram, nos diversos campos científicos, educacionais e sociais. Para tanto, estabelece a abordagem de análise literária e social a partir da percepção do universo feminino no cordel. Situa o surgimento da literatura de cordel, com o foco voltado às suas características e estrutura formal. Verifica a análise epistemológica feminista que confere o comportamento feminino como contribuinte na prática cultural popular cordelista, na vertente de a mulher autora participante e não personagem do cordel. A partir desse contexto, serão expostas questões concernentes à resistência da literatura de cordel até a contemporaneidade, e a relação dos cordelistas com a presença da mulher enquanto ser constituinte e/ou constituída. Não deixarão de ser abordados: a análise de Barros e análise do comportamento feminino na infância, adolescência, maturidade e velhice. Também serão feitas atribuições relativas à relação homem/ da imagem feminina impressa nos cordéis, a partir da técnica e estética xilográfica; a apresentação de peculiaridades biográficas de Leandro Gomes mulher, caracterizada pela sedução e pelo devir feminino da literatura de cordel valendo-se de conceitos de poder constituinte, singularidade e comum.

Amending the European Insolvency Regulation to Strengthen Main Proceedings
No full textThe EC Regulation No 1346 on insolvency proceedings allows for the coexistence of different proceedings with respect to the same debtor. This triggers certain problems in terms of efficiency of the insolvency administration within the European Judicial Space, thus menacing the effet utile of the Regulation.
The article focuses on such problems, explaining the shortcomings which affect the Regulation and wondering whether the ECJ case-law managed a solution for them.
As a matter of principle, preventing the opening of secondary proceedings seems in several cases to be a suitable means for protecting the main proceedings’ purposes. However, at the same time, not opening secondary proceedings could hamper the interests of local creditors, which rely on it to safeguard their rights on the grounds of the local lex concursus. The author addresses the main aspects of this tension.
The Regulation is under revision as result of a Proposal of the European Commission, which, inter alia, aims to strike a balance between the aforesaid interests at odds. The author, hence, carries out a critical appraisal of the envisaged amendments having also regard to the recent reactions of the other European Institutions
