No full textEl derecho a la alimentación está reconocido en pactos y tratados internacionales sobre derechos humanos, suscritos y ratificados por Venezuela. El objetivo de este trabajo es analizar el derecho a la alimentación en la Constitución de la República Bolivariana de Venezuela de 1999, como un derecho humano, y las garantías que establece el Estado en el texto constitucional para el respeto de dicho derecho. Metodológicamente, constituye una investigación documental, usando el paradigma sociocrítico, el método hermenéutico y como técnica el análisis documental. Los resultados mostraron que, en Venezuela, aun cuando en la Constitución se garantiza el derecho a la seguridad alimentaria, es más bien una defensa de los derechos de los consumidores más que la garantía del derecho a la alimentación en los términos previstos en tratados internacionales en materia de derechos humanos, además de existir fallas en un control eficiente del Estado y los órganos encargados, aunadas a la falta de una participación más activa de la comunidad u organizaciones populares en la defensa del derecho a la alimentación y promoción de la garantía de seguridad alimentaria, por lo cual se concluye que debe constituirse una sinergia entre instituciones del Estado y organizaciones populares para la creación de nuevas políticas económicas que fortalezcan el derecho a la alimentación y a garantizar la seguridad alimentaria del pueblo venezolano, mediante políticas públicas de productividad agroalimentaria para mantener y desarrollar su propia capacidad para la producción de sus alimentos básicos

A discipline-based art education model for criticism and inquiry directed to non-western art
No full textThe purpose of this professional problem is to develop a discipline-based art education model for criticism and inquiry directed to non-Western art to be used at the college level. The study includes a review of the literature concerning art appreciation and art criticism/inquiry dating from 1900, and outlines models for art criticism/inquiry used by educators in the classroom. Throughout the review, a search was conducted for applications of models specifically intended for non-Western art, but it was found that current models are directed primarily to Western artworks.
The ten-step model developed for this study introduces novice art students to art criticism and inquiry through its application to non-Western art, and an exemplary application in the appendix is directed to an artwork from Afghanistan selected from a series of audio-visual presentations developed by the author.
Students are led to search for information in the form of both internal and external cues in forming premature and tentative decisions or evaluations before arriving at an informed, final judgment about an artwork. The model functions as a tool by providing a framework for viewing and analyzing these foreign and unfamiliar works derived from different cultural, religious and social perspectives, and is intended to encourage students to delay judgments until an optimum measure of information has been collected.
The procedural considerations concerning the methods through which criticism for non-Western art is generated and ordered include the following: the need for a critical theory of art that questions the appropriateness of traditional art models for non-Western art; the influence of cross-cultural interpretations for responding to, examining, analyzing and judging non-Western art; and the potential use of the model as a tool for encouraging appreciation of non-Western art.
In conclusion, this study has the potential to play a relevant role in teaching non-Western art appreciation as well as providing an impetus for educating Western students about the diversity of foreign cultures and the influences of the art from those cultures. Historically, emphasis in art appreciation has been placed on the use of models of criticism which exclude critical study of non-Western art. If education is to be meaningful and meet the needs of a culturally diverse nation and world, discipline-based art education must contain both the critical study of Western and non-Western art

No full textKecepatan perkembangan teknologi internet yang sangat cepat, tidak selaras dengan perkembangan hukum. Sesuai dengan motto dalam bahasa belanda “Het recht hink achter de feiten aan†yang jika diartikan menjadi “hukum tertatih-tatih mengikuti perkembangan masyarakatâ€. Hukum seringkali harus dibelokan dengan berbagai cara guna menjawab permasalahan yang terus meningkat. Ini tidak begitu berbeda dengan peraturan perundang-undangan mengenai hak cipta terkhusus di dunia Youtube. Pelanggaran-pelanggaran hak cipta dalam dunia Youtube dapat dilihat bermunculan konten-konten lagu yang di nyanyikan ulang oleh orang lain atau biasa dikenal dengan istilah cover. Cover lagu yang dilakukan dalam dunia Youtube seringkali tidak mencantumkan nama dari pencipta lagu yang dinyanyikan ulang. Berdasarkan latar belakang diatas maka permasalahan yang akan penulis bahas adalah bagaimana legalistas hak moral atas perlindungan hak cipta dalam konten cover di Youtube? Penelitian ini menggunakan metode penelitian yuridis empiris, dengan pendekatan sosiologis yuridis. Yakni suatu pendekatan dalam penelitian hukum yang bertujuan untuk mengidentifikasi dan mengkonsepkan hukum sebagai suatu institusi riil dan fungsional dalam kehidupan sehari-hari. Serta diharapkan menghasilkan pengetahuan hukum secara emporis dengan langsung ke objek. Berdasarkan ketentuan dari UU Hak Cipta telah mencantumkan hak moral dalam suatu ciptaan. Penjabaran pasal 5 UU Hak Cipta mengatur mengenai hak moral yang menyatakan bahwa hak moral adalah hak mutlak yang dimiliki oleh pencipta terhadap ciptaannya. Ketentuan hak moral ini melingkupi pencantuman nama atau alias, penggunaan nama judul, penuntutan ha katas penggunaan ciptaan yang distorsi dan dimutalasi oleh pihak lain. Implemntasi dari hak moral dalam UU Hak Cipta tidak hanya mengatur penggunaan ciptaan dalam kehidupan sehari-hari tetapi juga telah menyasar kepada dunia Internet secara khusus dalam media YouTube.Abstract
The speed of the development of internet technology is very fast, not in line with the development of law. In accordance with the motto in the Dutch language "Het recht hink achter de feiten aan" which translates to "law limping following the development of society". Laws must be twisted in various ways in order to answer the growing problem. This is not so different from the laws and regulations regarding copyright, especially in the world of Youtube. Infringement of copyright content in the world of Youtube can be seen in the emergence of song content sung by other people or commonly known as covers. The closing song that is performed in the world of Youtube does not require the name of the composer to be sung again. Based on the above background, the problem that the author will discuss is how the legalism of moral rights for copyright protection in cover content on Youtube?
This study uses a juridical empirical research method, with a sociological juridical approach. Namely an approach in legal research that aims to identify and conceptualize law as real and functional in everyday life. And it is hoped that it will produce empirical legal knowledge directly to the object.
Based on the provisions of the Copyright Law, moral rights have been increased in a creation. The elaboration of article 5 of the Copyright Law provides guidance on moral rights which states that moral rights are absolute rights owned by the creator to his / her creation. This provision of moral rights covers the inclusion of names or aliases, use of title names, prosecution for the use of works that are distorted and mutated by other parties. The application of moral rights in the Copyright Law does not only use works in everyday life but has also targeted the Internet world specifically in the media of YouTube.

Pemberian Hak Restitusi Terhadap Anak Sebagai Korban Tindak Pidana Kekerasan Seksual
No full textPada masa sekarang ini masih banyak anak yang menjadi korban tindak pidana, salah satunya yaitu tindak pidana kekerasan seksual. Kekerasan seksual terhadap anak dapat menyembabkan dampak pada kesehatan anak dan trauma yang berkepanjangan bahkan sampai anak tersebut tumbuh dewasa. Bentuk perlindungan hukum bagi anak yang menjadi korban tindak pidana yaitu dengan memberikan restitusi terhadap anak tersebut. Restitusi merupakan pembayaran ganti kerugian yang dibebankan kepada pelaku berdasarkan putusan pengadilan yang berkekuatan hukum tetap.
Penelitian ini bertujuan untuk mengetahui bagaimana pengaturan restitusi bagi anak yang menjadi korban tindak pidana kekerasan seksual dan untuk mengetahui penerapan hak restitusi terhadap anak korban tindak pidana kekerasan seksual di Kabupaten Merauke. Penelitian ini merupakan jenis penelitian yuridis empiris, dengan teknik pengumpulan data secara kepustakaan, dan lapangan serta menganalisis data secara kualitatif.
Hasil penelitian yang dilakukan penulis bahwa dasar hukum untuk melaksanakan permohonan restitusi adalah Undang-Undang Nomor 35 Tahun 2014 tentang Perlindungan Anak dan Peraturan Pemerintah Nomor 43 Tahun 2017 tentang Pelaksanaan Restitusi Bagi Anak Yang Menjadi Korban Tindak Pidana. Kepada pemerintah atau penegak hukum dapat memberikan sosialisasi kepada masyarakat terkait aturan tentang tindak pidana kekerasan seksual pada anak. bahwa anak yang telah menjadi korban tindak pidana memiliki hak-hak yang telah diatur dalam Perundang-Undangan. Dan di Kabupaten Merauke untuk penerapan hak restitusi terhadap anak korban tindak pidana kekerasan seksual masih belum terpenuhi, karena masih ada terdapat beberapa kendala salah satunya yaitu di Kabupaten Merauke sendiri belum adanya LPSK yang membuat penuntut umum kesusahan untuk menentukan jumlah biaya dari restitusi. Pemerintah diharapkan dapat membuka perwakilan LPSK di Kabupaten Merauke sehingga pemberian kompensasi dan/atau restitusi ini dapat berjalan dengan efektif dan efisien. There are still many children who are victims of crime, one of which is the crime of sexual violence. Sexual violence against children can impact children's health and cause lasting trauma even until the child grows up. The form of legal protection for children who are victims of crime is by providing restitution for the child. Restitution is a compensation payment charged to the offender based on a court decision with permanent legal force.
This study aims to determine how restitution is arranged for children who are victims of sexual violence and to find out the application of the right of restitution to child victims of sexual violence in the Merauke Regency. This research is a type of empirical juridical research, with bibliographical and field data collection techniques and analyzing data qualitatively.
The results of the research conducted by the author show that the legal basis for carrying out requests for restitution is Law Number 35 of 2014 concerning Child Protection and Government Regulation Number 43 of 2017 concerning Implementation of Restitution for Children who are Victims of Crime. The government or law enforcers can provide socialization to the public regarding the rules regarding criminal acts of sexual violence against children. Children who have become victims of criminal acts have rights regulated in laws and regulations. And in Merauke Regency, the implementation of the right of restitution for child victims of sexual violence has not yet been fulfilled because there are still several obstacles, one of which is that in Merauke Regency itself, there is no LPSK which makes it difficult for the public prosecutor to determine the amount of the cost of restitution. The government is expected to be able to open LPSK representatives in Merauke Regency so that the provision of compensation and reimbursement can run effectively and efficiently
Los juegos matemáticos en la enseñanza-aprendizaje de la matemática: una revisión bibliométrica en Scopus
No full textThe objective of this research was to carry out a bibliometric study in Scopus based on mathematical games for learning through mathematics, from 2000 to 2024. To do this, a bibliometric method and a quantitative approach were used. From this, 232 documents were chosen from the Scopus database. The results show that of all countries, the United States recorded the largest increase in scientific output at 15.1% between 2016 and 2024, contributing to a total increase of 71.1%. In addition, social sciences (33.8%) and computer science (19%), were the most relevant fields of study, while the main author with the most citations was Fessakis, G. with 308 citations and the most prominent source was Computers And Education with 12 published papers. It is concluded that research on mathematical games for education has progressed in terms of the breadth of topics covered, participation and collaboration among authors, the level of institutional cooperation, and the availability of relevant data. Therefore, the results point to a growing trend in the use of games in the classroom, with an emphasis on collaborative and interdisciplinary tactics, which has an impact on students' attitudes and behaviors towards mathematics. Therefore, this bibliometric analysis establishes a basis for other studies in the future.
La presente investigación tuvo como objetivo realizar un estudio bibliométrico en Scopus basado en los juegos matemáticos para el aprendizaje por medio de la matemática, desde el 2000 al 2024. Para ello, se utilizó un método bibliométrico y un enfoque cuantitativo. A partir de esto, se eligieron 232 documentos de la base de datos Scopus. Los resultados muestran que de todos los países, Estados Unidos registró el mayor aumento de la producción científica con un 15.1% entre 2016 y 2024, contribuyendo a un aumento total del 71.1%. Además, las ciencias sociales (33.8%) y la informática (19%), fueron los campos de estudio más pertinentes, mientras que el autor principal con más citas fue Fessakis, G. con 308 citas y la fuente más destacada fue Computers And Education con 12 documentos publicados. Se concluye que la investigación sobre juegos matemáticos para la educación ha progresado en cuanto a la amplitud de los temas tratados, la participación y colaboración entre autores, el nivel de cooperación institucional y la disponibilidad de datos pertinentes. Liderazgo pedagógico-directivo en instituciones educativas de educación básica: un análisis de la red bibliométrica
No full textThe objective of this research is to carry out an analysis of the bibliometric network in Scopus on managerial pedagogical leadership in basic education educational institutions, between 2008-2024. The methodology used was the bibliometric study. Using the keywords in English: managerial pedagogical leadership and basic education, data from 54 documents in Scopus were selected for the indicators of scientific production. The results demonstrate that there is a growing interest in this area, as indicated by the 81.5% increase in the number of papers published between 2019 and 2024. Spain is the country with the highest rate of scientific production (12.5%) while the sources with the most publications are Psicoperspectivas and Revista Complutense De Educación. On the other hand, the most referenced author was Alemán De la Garza, L. with forty citations. In addition, 88.7% of the publications were scientific articles, with 42.6% in the field of social sciences. With this, it is concluded that research on managerial pedagogical leadership in basic education educational institutions is going through a period of growth, this is possible thanks to the participation of authors and countries, connections within institutions, easily accessible resources and the variety of publication sources, because managerial pedagogical leadership is essential to improve educational quality. In this sense, the following bibliometric research can lay the foundations for future studies.El objetivo de la presente investigación es realizar un análisis de la red bibliométrica en Scopus sobre el liderazgo pedagógico directivo en instituciones educativas de educación básica, entre 2008-2024. La metodología empleada fue el estudio bibliométrico. Utilizando las palabras clave en inglés: managerial pedagogical leadership y basic education, se seleccionaron los datos de 54 documentos en Scopus, para los indicadores de producción científica. Los resultados demuestran que hay un interés creciente en esta área, como indica el aumento del 81.5% en el número de trabajos publicados entre 2019 y 2024. España es el país con mayor índice de producción científica (12.5%) mientras que las fuentes con más publicaciones son Psicoperspectivas y Revista Complutense De Educación. Por otro lado, el autor más referenciado fue Alemán De la Garza, L. con cuarenta citas. Además, el 88.7% de las publicaciones fueron artículos científicos, con un 42.6% en el campo de las ciencias sociales. Con esto se concluye que la investigación sobre el liderazgo pedagógico directivo en las instituciones educativas de educación básica atraviesa un período de crecimiento, esto es posible gracias a la participación de autores y países, las conexiones dentro de las instituciones, los recursos de fácil acceso y la variedad de fuentes de publicación, debido que el liderazgo pedagógico directivo es fundamental para mejorar la calidad educativa. En ese sentido, la siguiente investigación bibliométrica puede sentar las bases para futuros estudios
