    Penerapan Restorative Justice dalam Penyelesaian Perkara Tindak Pidana Penipuan dan Penggelapan di Polrestabes Medan

    In the implementation of restorative justice or the settlement of cases outside the court, no longer recognize criminal cases are light, but also include cases such as insults, ill-treatment, fraud and embezzlement, neglect resulting in injury, unpleasant acts, even theft, and gambling. The final goal of the restorative concept is to expect a reduction in the number of prisoners in prison; eliminate the stigma or stamp and return the perpetrators of crimes to normal human beings; the perpetrators of crimes can realize their mistakes, so that they do not repeat their actions and reduce the workload of the police, prosecutors, detention centers, courts and penitentiaries; saving state finances does not cause resentment because the perpetrators have been forgiven by victims, victims quickly get compensation; empower the community in overcoming crime; and reintegration of perpetrators of crime in society. Based on the foregoing, the study entitled: "The Application of Restorative Justice in Settling Cases of Fraud and Embezzlement in Medan District Police", deserves further study. The problems that can be formulated, namely: legal arrangements for handling cases of fraud and embezzlement in Medan Policerest; settlement through restorative justice in Medan Police Station to eliminate the crime, or not; and Investigator's obstacle in handling cases of fraud and embezzlement through restorative justice in Medan District Police. This research is normative legal research. The nature of the research is descriptive research. The approach used is the statutory approach. The data source used is secondary data supported by empirical data. Secondary data were collected using literature study techniques, while empirical data were collected by interview techniques using the in-depth interview method. Data analysis was performed with qualitative analysis. The results showed that: Settlement of fraud and embezzlement criminal cases through restorative justice does not yet have a legal basis for its implementation, Medan District Police Investigators use police discretion based on Law No. 2 of 2002 concerning the Indonesian National Police; Settlement of fraud and embezzlement cases through restorative justice in Medan Regional Police does not eliminate criminal acts; and obstacles for the Medan Police Resort Criminal Investigator in handling cases of fraud and embezzlement using the principle of restorative justice, namely: a) The family demands of the victim are too large; b) The time required for the process of restorative justice is relatively short, namely 2 (two) months from detention; c) Perpetrators of fraud and embezzlement are other offenders.Dalam pelaksanaan restorative justice atau penyelesaian perkara di luar pengadilan, tidak lagi mengenal perkara pidana serba ringan, tetapi juga mencakup perkara seperti penghinaan, penganiayaan, penipuan dan penggelapan, kelalaian mengakibatkan orang luka, perbuatan tidak menyenangkan, bahkan pencurian dan perjudian. Sasaran akhir konsep restorative ini mengharapkan berkurangnya jumlah tahanan di dalam penjara; menghapuskan stigma atau cap dan mengembalikan pelaku kejahatan menjadi manusia normal; pelaku kejahatan dapat menyadari kesalahannya, sehingga tidak mengulangi perbuatannya serta mengurangi beban kerja polisi, jaksa, rutan, pengadilan, dan lembaga permasayarakatan; menghemat keuangan negara tidak menimbulkan rasa dendam karena pelaku telah dimaafkan oleh korban, korban cepat mendapatkan ganti kerugian; memberdayakan masyarakat dalam mengatasi kejahatan; dan pengintegrasian kembali pelaku kejahatan dalam masyarakat. Berdasarkan hal-hal tersebut di atas, maka penelitian berjudul : “Penerapan Restorative Justice Dalam Penyelesaian Perkara Tindak Pidana Penipuan dan Penggelapan di Polrestabes Medan”, layak untuk dikaji lebih lanjut. Adapun permasalahan yang dapat dirumuskan, yaitu: pengaturan hukum penanganan perkara tindak pidana penipuan dan penggelapan di Polrestabes Medan; penyelesaian melalui restorative justice di Polrestabes Medan menghapuskan tindak pidana tersebut, atau tidak; dan hambatan Penyidik dalam penanganan perkara tindak pidana penipuan dan penggelapan melalui restorative justice di Polrestabes Medan. Penelitian ini adalah penelitian hukum normatif. Sifat penelitian adalah penelitian deskriptif. Pendekatan yang digunakan adalah pendekatan peraturan perundang-undangan. Sumber data yang digunakan adalah data sekunder yang didukung data empiris. Data sekunder dikumpulkan dengan menggunakan teknik studi kepustakaan, sedangkan data empiris dikumpulkan dengan teknik wawancara menggunakan metode wawancara mendalam. Analisis data dilakukan dengan analisis kualitatif. Hasil penelitian menunjukkan bahwa: Penyelesaian perkara tindak pidana penipuan dan penggelapan melalui restorative justice belum memiliki dasar hukum untuk pelaksanaannya, Penyidik Polrestabes Medan menggunakan diskresi kepolisian berdasarkan Undang-Undang No. 2 Tahun 2002 tentang Kepolisian Negara Republik Indonesia; Penyelesaian perkara tindak pidana penipuan dan penggelapan melalui restorative justice di Polrestabes Medan tidak menghapuskan tindak pidana; dan hambatan bagi Penyidik Satreskrim Polrestabes Medan dalam menangani perkara tindak pidana penipuan dan penggelapan menggunakan prinsip restorative justice, yaitu :a) Tuntutan keluarga korban terlalu besar; b) Waktu yang diperlukan untuk proses restorative justice relatif singkat yaitu 2 (dua) bulan sejak penahanan; c) Pelaku tindak pidana penipuan dan penggelapan merupakan pelaku tindak pidana lain.229 HalamanTesis Magiste

    Going Beyond Counting First Authors in Author Co-citation Analysis

    The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed.     “Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship

    Appropriate Similarity Measures for Author Cocitation Analysis

    We provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature.     Dispelling the Myths Behind First-author Citation Counts

    We conducted a full-scale evaluative citation analysis study of scholars in the XML research field to explore just how different from each other author rankings resulting from different citation counting methods actually are, and to demonstrate the capability of emerging data and tools on the Web in supporting more realistic citation counting methods. Our results contest some common arguments for the continued use of first-author citation counts in the evaluation of scholars, such as high correlations between author rankings by first-author citation counts and other citation counting methods, and high costs of using more realistic citation counting methods that are not well-supported by the ISI databases. It is argued that increasingly available digital full text research papers make it possible for citation analysis studies to go beyond what the ISI databases have directly supported and to employ more sophisticated methods

    We have done our best to complete the author checklist relating to the use of animals in the hut study. Note that the objective for the hut study was to evaluate the IRS treatment applications for residual efficacy against Anopheles mosquitoes, including the local An. coluzzii mosquito population. Cows were only used to attract mosquitoes into the huts and no tests were carried out directly on the cows. The author checklist is intended for use with studies where experiments are carried out on animals, which is why we have had such difficulty in completing this for the hut study, as many of the questions do not relate to how the cows were used
