    L’articolo è un commento di Teologia politica e diritto di Geminello Preterossi, evidenziandone la qualità metodologica ed il contributo alla comprensione della secolarizzazione del politico. Poiché l’opera dimostra come la teologia politica resti elemento inestinguibile della sostanza del potere, si è provato ad evidenziare la tensione fra approcci gnoseologici e materialismo politico in tema di contratto sociale, fra razionalizzazione giuridica e valore del mito fondativo dello Stato. Attraverso un’illustrazione della regalità romana da un lato e dello sterile tecnicismo del potere amministrativo contemporaneo, Preterossi viene riletto quale autore in grado di superare il nichilismo giuridico della post-modernità.The article is a commentary on Teologia politica e diritto by Geminello Preterossi, highlighting its methodological quality and contribution to understanding the secularization of politics. Since the work demonstrates how political theology remains an inextinguishable element of the essence of power, an effort has been made to emphasize the tension between epistemological approaches and political materialism in the context of the social contract, as well as between legal rationalization and the foundational myth of the State. Through an analysis of Roman kingship on one hand and the sterile technicism of contemporary administrative power on the other, Preterossi is reinterpreted as an author capable of transcending the legal nihilism of postmodernity

    La sentenza della Corte Costituzionale n. 69/2024 ha dichiarato l’illegittimità costituzionale dell’articolo 3 della legge regionale Puglia n. 13/2023, ribadendo come la protezione dei dati personali rientri nella competenza esclusiva statale in materia di «ordinamento civile». Tale norma regionale, volta a regolamentare l’installazione di sistemi di videosorveglianza nelle strutture socio-sanitarie per prevenire abusi, è stata giudicata dalla Consulta lesiva delle disposizioni europee e nazionali sul trattamento dei dati personali, nonché invasiva delle competenze statali per la sua regolamentazione autonoma e selettiva delle fonti normative. La sentenza, che poco innova rispetto ai precedenti della Corte, è un utile pretesto per sollevare una riflessione di sistema: la Corte richiama come parametro di legittimità anche i provvedimenti generali del Garante per la protezione dei dati personali, peraltro aboliti dal GDPR, ciò comportando l’inquietante ed improprio riconoscimento di una competenza normativa del Garante, che dovrebbe piuttosto evidenziare l’assenza di una normativa organica nazionale sulla videosorveglianza. Tale lacuna, elusa per decenni dal Legislatore, ha generato un cortocircuito normativo, delegando a tribunali e autorità amministrative bilanciamenti sociali e scelte politiche che spetterebbero al Parlamento.The Constitutional Court’s ruling no. 69/2024 declared Article 3 of the Puglia Regional Law no. 13/2023 unconstitutional, reaffirming that the protection of personal data falls under the exclusive jurisdiction of the State in matters of “civil law.” This regional law, aimed at regulating the installation of video surveillance systems in socio-healthcare facilities to prevent abuse, was deemed by the Court to be in violation of European and national provisions on data processing and an overreach into State competences due to its autonomous and selective regulation of legal sources. The ruling, which introduces little innovation compared to the Court’s previous decisions, provides an opportunity to raise a systemic concern: the Court, as a parameter of legitimacy, references the general provisions issued by the Italian Data Protection Authority (Garante), despite these being effectively overridden by the GDPR. This results in a troubling and improper recognition of a regulatory power by the Garante, which should instead highlight the lack of a comprehensive national framework on video surveillance. This legislative gap, ignored for decades by lawmakers, has created a normative deadlock, delegating to courts and administrative authorities the responsibility for balancing social interests and making political decisions that should rightly belong to Parliament

    Going Beyond Counting First Authors in Author Co-citation Analysis

    The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed

    “Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship

    Appropriate Similarity Measures for Author Cocitation Analysis

    We provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature.     Dispelling the Myths Behind First-author Citation Counts

    We conducted a full-scale evaluative citation analysis study of scholars in the XML research field to explore just how different from each other author rankings resulting from different citation counting methods actually are, and to demonstrate the capability of emerging data and tools on the Web in supporting more realistic citation counting methods. Our results contest some common arguments for the continued use of first-author citation counts in the evaluation of scholars, such as high correlations between author rankings by first-author citation counts and other citation counting methods, and high costs of using more realistic citation counting methods that are not well-supported by the ISI databases. It is argued that increasingly available digital full text research papers make it possible for citation analysis studies to go beyond what the ISI databases have directly supported and to employ more sophisticated methods
