    La sottrazione internazionale di minori: le madri in fuga da violenza domestica

    Lo studio si propone di analizzare il fenomeno della sottrazione internazionale di minori perpetrato dalle madri in fuga da violenza domestica. Si vuole offrire una panoramica della disciplina, mettendo in luce l’inadeguatezza della Convenzione dell’Aja del 1980 nonché dei regolamenti Bruxelles II bis e ter in termini di protezione della donna. L’applicazione dell’eccezione del “grave risk” solleva criticità sotto il profilo sia probatorio a carico della madre sia discrezionale in capo ai giudici. Al contempo, la direttiva 2011/99/UE nonché il regolamento (UE) n. 606/2013, si dimostrano nella prassi inefficaci a garantire la tutela della madre, che è quindi riconosciuta solo sul piano interpretativo. La ricerca si pone nell’ottica di ricercare una soluzione attraverso la Convenzione di Istanbul, cui l’Unione ha appena aderito, e la proposta di direttiva sulla lotta alla violenza contro le donne, fattori chiave nel contesto attuale. Le valutazioni sono elaborate mettendo in risalto le pronunce della Corte di Giustizia, della Corte europea dei diritti dell’uomo e delle corti nazionali.The present studio aims to analyze the international child abduction committed by mothers fleeing from domestic violence. It intends to provide an overview of the subject, pointing out inadequacy of the 1980 Hague Convention and the Brussels II bis and ter regulations with regard of the women protection. The “grave risk” exception implementation raises critical issues in terms of both evidence against the mother and discretion in the courts. Simultaneously, the 2011/99/EU directive and regulation (EU) n. 606/2013 are ineffective in practice to guarantee the mother protection, which is acknowledged only on the interpretative level. The research seeks to find a solution through Istanbul Convention, given the recent EU’s accession, and the proposal of directive on combating violence against women, key elements in the current context. The assessments are conducted emphasizing the Court of Justice, European Court of Human Rights and National courts decisions

    Antologías poéticas españolas : Las paradojas de un objeto

    Sin ninguna pretensión de exhaustividad, la propuesta de este trabajo es abordar las tendencias más relevantes de la producción poética de las últimas décadas en España, a partir de las antologías editadas a lo largo de los años ´90. De hecho, ninguna otra época literaria ha provocado tantas antologías coetáneas a su surgimiento como ésta, de los años ´80 y ´90; selección que lanza al mercado más de 200 nombres diferentes pero que permite, con todo, aglutinar ciertas tendencias. Sin embargo, si bien es cierto que las antologías parecen solidificar un panorma incierto por la multiplicidad de propuestas existentes, no es menos cierto que paradójicamente ellas mismas terminan contribuyendo en buena medida a multiplicar confusamente con sus tendencias y subtendencias, con sus taxonomías siempre cuestionables, un estado de cosas ya de por sí inclasificable.Fil: Ferrari, Marta Beatriz.     "Trenes de paso hacia ningún lugar" : sobre La vida de frontera de Carlos Marzal

    La vida de frontera, publicado en 1991, es el segundo libro del poeta español Carlos Marzal (Valencia, 1961). Todo el poemario es, en primera y última instancia, una íntima y honda reflexión sobre la existencia, sus límites -sus "fronteras"-, su sentido o mejor, su falta de sentido. El pensamiento poético de Marzal responde en este libro a una orientación claramente borgiana que incluye la meditación sobre la reversibilidad del tiempo y del espacio, la fusión entre sueño y vigilia, la contigüidad vertiginosa del Aleph que intenta desbaratar la inevitable sucesividad del tiempo humano, la indagación metapoética a través del tópico de la rosa, la cita de Schopenhauer que introduce el sobresalto metafísico del conflicto entre libre albedrío y predestinación, la pública declaración de amor a las bibliotecas, la fe en el azar, el balance existencial del Borges de "El remordimiento" espejado notablemente en "Acto de contrición". Las conclusiones apuntan a subrayar el carácter de tránsito que el texto exhibe desde su arranque experiencial (propio de la escritura de los '80) hacia una poética que podríamos denominar "del pensamiento."Fil: Ferrari, Marta Beatriz.     Carlos Marzal (Valencia, 1961) es uno de los poetas españoles de mayor renombre en estas dos últimas décadas. El propósito de esta ponencia es acercarnos a su último poemario Ánima mía publicado en el año 2009. Como veremos en este trabajo la escritura poética de Marzal adhiere a una vasta genealogía que arranca en el siglo XVII, con la elección de un tono de voz próximo a la contención y la reducción que caracterizaran al barroco tanto hispánico como sajón. Más que de lecturas o influencias, Marzal prefiere hablar de la voluntad de 'unir ciertos nombres al suyo propio'. Así, desde la publicación de Metales pesados, libro bisagra en su trayectoria escritural, hay que mencionar los nombres de San Juan de la Cruz y Heráclito, Hiedegger y Tertuliano, Emily Dickinson y George Santayana, Manrique y Juan Ramón Jiménez, Bécquer y Miguel Hernández, José Hierro, John Keats y Horacio.     Going Beyond Counting First Authors in Author Co-citation Analysis

    The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed

    Variations on the Author

    “Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship

    Appropriate Similarity Measures for Author Cocitation Analysis

    We provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature.     Dispelling the Myths Behind First-author Citation Counts

    We conducted a full-scale evaluative citation analysis study of scholars in the XML research field to explore just how different from each other author rankings resulting from different citation counting methods actually are, and to demonstrate the capability of emerging data and tools on the Web in supporting more realistic citation counting methods. Our results contest some common arguments for the continued use of first-author citation counts in the evaluation of scholars, such as high correlations between author rankings by first-author citation counts and other citation counting methods, and high costs of using more realistic citation counting methods that are not well-supported by the ISI databases. It is argued that increasingly available digital full text research papers make it possible for citation analysis studies to go beyond what the ISI databases have directly supported and to employ more sophisticated methods
