A (in)coerência no tratamento punitivo despendido às chamadas "mulas do tráfico"

Direito.O presente trabalho tem como objetivo abordar o crime de tráfico de drogas, em especial a conduta do agente que se restringe a transportar o material ilícito, adjetivado como “mula”; busca esclarecer se o tratamento punitivo despendido a ele é adequado. Para isso, buscou-se analisar a evolução legislativa do crime em questão, discorrendo acerca da política nacional de combate às drogas, bem como sobre os aspectos inovadores que salientam a nova Lei de Drogas. Em seguida, foi feito um breve exame das teorias que tratam do concurso de agentes, tendo sido aprofundada a teoria do domínio do fato e analisadas as diferentes formas do agente de realizar ou participar na empreitada criminosa. Ainda, fez-se o estudo discriminado do tipo penal previsto no art. 33 da Lei nº 11.343/06, denominado “tipo misto alternativo”. Finalmente, foi feita uma análise jurisprudencial dos julgamentos realizados pelo Supremo Tribunal Federal e do Superior Tribunal de Justiça. Nesse ponto, discorreu-se sobre os argumentos utilizados para o afastamento da benesse do § 4º, do artigo 33, da Lei 11.343/06 e, em seguida, destacou-se os posicionamentos favoráveis a tal aplicação. Viu-se, pois, que não há um entendimento pacificado acerca do tratamento punitivo aplicável à “mula”. A jurisprudência não trata da questão teórica do concurso de agentes em relação ao crime de tráfico de drogas, limitando-se a tipificar a conduta da “mula” como crime de tráfico, e aplicando-se a minorante em alguns casos. Sendo assim, verifica-se a necessidade de uma possível alteração do preceito legal, com vistas a especificar tal conduta
Atuação da ilegalidade e do tráfico na fronteira Brasil-Bolívia nos municípios de Corumbá e Ladário/MS através das chamadas “mulas”: PERFORMANCE OF ILLEGALITY AND TRAFFICKING ON THE BRAZIL-BOLIVIA BORDER IN THE MUNICIPALITIES OF CORUMBÁ AND LADÁRIO/MS THROUGH THE CALLED “MULES”
O presente artigo procura evidenciar os principais fatores socioeconômicos que motivam a entrada de indivíduos na ilegalidade e tráfico na fronteira Brasil-Bolívia nos municípios de Corumbá e Ladário, mais precisamente a ocuparem o cargo de mulas, responsáveis pelo transporte da droga. Para o desenvolvimento da pesquisa, utilizou-se do método qualitativo exploratório vinculado a pesquisa bibliográfica do tema. A metodologia utilizada consistiu em pesquisa bibliográfica de artigos científicos que tratam do tema para pesquisa e análise de dados socioeconômicos de relações de trabalho (empregos) que permitiram o delineamento da correlação entre a criminalidade e o desempenho ou não desempenho das relações de trabalho, permitindo dialogar com o objeto de pesquisa, através de dados de admissões e desligamentos. A pesquisa permitiu percepcionar o fato de serem as mulheres os indivíduos mais afetados na condição de mulas uma vez que estruturalmente são submetidas às menores remunerações juntamente ao físico que facilita o transporte, tal qual como o seio.

Parochial organization of the royal towns in the Diocese of León: Mansilla de las Mulas, Mayorga de Campos and Rueda del Almirante
El presente trabajo analiza los procesos de organización eclesiástica que tuvieron lugar en las villas nuevas reales de la diócesis de León a partir de la repoblación llevada a cabo en las últimas décadas del siglo XII por Fernando II y Alfonso IX, poniendo el foco de atención en los casos de Mansilla de las Mulas, Mayorga de Campos y Rueda del Almirante. La constitución de estas villas como pueblas reales y su consiguiente crecimiento demográfico hicieron necesaria una adecuación de las estructuras parroquiales a los nuevos patrones de poblamiento, lo que implicó la construcción de nuevas iglesias, la negociación de los derechos de patronato y del reparto de los diezmos, y la delimitación de los territorios parroquiales. Estos procesos fueron impulsados y controlados por el episcopado leonés; sin embargo, su dinámica y resultados estuvieron condicionados en gran medida por las relaciones establecidas con las élites urbanas.This paper analyzes the processes of ecclesiastical organization set in motion in the royal towns of the diocese of León with the repopulation carried out by Fernando II and Alfonso IX in the last decades of the 12th century. It focuses on the cases of Mansilla de las Mulas, Mayorga de Campos and Rueda del Almirante. The constitution of these places as royal towns and the subsequent growth of the population of these centers made it necessary to adjust the parish structures to the new settlement models. The adjustment involved the construction of new churches, the negotiation over patronage rights and tithe distribution, and the delimitation of parish boundaries. These processes were driven and controlled by the Leonese episcopate; however, their dynamics and results were conditioned, to a large extent, by the relationships established with urban elites.Fil: Pérez, Mariel Verónica. A CASE STUDY OF COLLAPSE DURING THE 2009 L’AQUILA (ITALY) EARTHQUAKE
A number of masonry and reinforced concrete (RC) buildings suffered failure during the magnitude Mw 6.3 earthquake that struck the city of L’Aquila (Italy) on April 6 2009.
Many of the RC buildings were designed and built between the late fifties and the early seventies. The partial collapse of the “Casa dello Studente” (Student House) building in L’Aquila,
with its high death toll of eight students killed and one suffering serious injury, is paragdimatic on one hand of the possible fragility of reinforced concrete construction of that period,
on the other hand of failure due to an adverse sequence of events.
The legal authority appointed a forensic team, lead by the first author, for investigating the causes and the mechanism of the collapse. During a six-months period, the team had a unique
chance to analyze in a thorough way the collapse causes. The joint efforts of the forensic team led to a complete explanation of the collapse and highlighted the sequence of missed opportu-
nities that let this happen. Collapse took place within part of the North wing trough a twofold mechanism: a weak-story mechanism, which involved collapse of all the columns at the first story, and the complete collapse of three columns located close to the floor center. The two mechanisms were due to an initial design error, never discovered during the subsequent ren-
ovations of the building, whose effects were adversely amplified by a non-structural fire-proof wall inserted in recent times to comply with fire safety requirements. This imposed unforeseen
strength and ductility requirements on members not specifically designed for this.
This paper presents some of the result of the studies that, not strictly necessary for legal reasons, were only performed after completing the report for the legal authority. Carta a un oficial real no identificado en la cual el Padre Serra informa sobre su viaje por mar a Monterrey, la entrega de provisiones y el estado de las misiones en el área. Comienza informando sobre la llegada de la fragata a Monterey y la descarga y distribución de suministros muy necesarios. Describe su trayectoria hasta la Misión de Carmel y menciona la llegada del Capitán Don Fernando Rivera. Indica que los frailes están teniendo dificultades para llevar su parte de los suministros a sus respectivas misiones debido a la escasez de mulas. Informa haber visitado todas las misiones durante su viaje desde San Diego, elogiando el progreso realizado tanto espiritual como materialmente y prometiendo informar sobre cada misión por separado. Explica el nombramiento del Padre Juan Crespí como nuevo capellán de la expedición debido a la enfermedad del original; el Padre Tomás de la Peña acompañaría a Crespí. Serra describe en detalle una misa y un sermón de Acción de Gracias que dio durante el viaje. El autor señala la ejecución de las regulaciones reales en beneficio de las misiones, excepto por la llegada retrasada de ganado, artículos comprados y suministros desde Baja California. —— Letter to an unidentified royal official in which Fr. Serra reports on his sea voyage to Monterey, delivery of provisions, and the state of the missions in the area. He starts by reporting on the frigate’s arrival in Monterey and the unloading and distribution of much-needed supplies. He describes his trajectory to Mission of Carmel and notes the arrival of Captain Don Fernando Rivera. He mentions the friars are having a difficult time taking their share of the supplies to their respective missions due to the scarcity of mules. He reported visiting all the missions throughout his journey from San Diego, praising the progress made both spiritually and materially and promising to report on each mission separately. He explains the appointment of Fr. Juan Crespí as the new chaplain for the sea expedition due to the illness of the original nominee; Fr. Tomás de la Peña will accompany Crespí. Serra describes in detail a Thanksgiving mass and sermon he gave during the journey. Fiscal Adjustments and the Short-Term Trade-Off Between Growth and Equality
This article examines the short-term economic impact of alternative fiscal adjustment strategies, with an especial focus on their effect on economic growth and income distribution. Based on a sample of 53 adjustment episodes occurred in the fifteen EU Member States between 1960-2000, this article shows that different strategies of fiscal adjustment bring about different economic consequences. Expenditure-based adjustments that are preceded by bad economic and fiscal initial conditions, that are accompanied by a devaluation, and that succeed in cutting the least productive expenditures of the budget, are likely to have anti-Keynesian effects and to be expansionary. Nevertheless, they do so at the expense of increasing income inequality. The opposite is true for revenue-based consolidations. The nineties epitomize the story of expansionary fiscal consolidations via strong wealth and credibility effects, but also the rebirth of the trade-off between growth and equality, mediated by fiscal polic
