    ANALISIS YURIDIS PENJATUHAN PIDANA TERHADAP PEREMPUAN DALAM PERKARA TINDAK PIDANA KORUPSI: Studi Kasus Putusan Pengadilan Tinggi DKI Jakarta Nomor 10/Pid.Sus-TPK/2021/PT.DKI (Fernando Imanuel, 2020112059, Magister Ilmu Hukum, Fakultas Hukum Universitas Andalas, 124 halaman, 2022) ABSTRAK Hakim dalam menjatuhkan putusan mempunyai kebebasan atau memiliki sifat independen.Meskipun memiliki kebebasan, dalam menjatuhkan putusan harus didasarkan pada pertimbangan – pertimbangan yang cukup untuk mendukung putusan yang dijatuhkannya. Dalam Putusan Nomor 10/Pid.Sus-TPK/2021 Terdakwanya adalah seorang perempuan dan dalam perkara tersebut Hakim menjatuhkan putusan berupa pemidanaan dengan pidana penjara selama 4 (empat) tahun dan denda sebesar Rp600.000.000,- (enam ratus juta rupiah), dengan ketentuan apabila denda tersebut tidak dibayar diganti dengan pidana kurungan selama 6 (enam) bulan. Lamanya pidana yang dijatuhkan terhadap terdakwa berkurang selama 6 (enam) tahun dibandingkan dengan Putusan terhadap terdakwa di Pengadilan Tindak Pidana Korupsi Pada Pengadilan Negeri Jakarta Pusat yang menjatuhkan pidana penjara terhadap Terdakwa selama 10 (sepuluh) tahun dan denda sebesar Rp600.000.000,- (enam ratus juta rupiah), dengan ketentuan apabila denda tersebut tidak dibayar diganti dengan pidana kurungan selama 6 (enam) bulan. Pengurangan lamanya pidana yang dijatuhkan oleh majelis hakim pada Pengadilan Tinggi DKI Jakarta terhadap terdakwa perempuan patut untuk dikaji secara yuridis. Rumusan masalah penelitian ini adalah 1) Bagaimanakah pertimbangan Majelis Hakim untuk menjatuhkan pidana pada perkara tindak pidana korupsi dalam Putusan Pengadilan Tinggi DKI Jakarta Nomor 10/PID.SUS-TPK/2021/PT DKI? 2) Bagaimanakah penjatuhan pidana dalam Putusan Pengadilan Tinggi DKI Jakarta Nomor 10/Pid.Sus-TPK/2021/PT DKI ditinjau dari PERMA Nomor 3 Tahun 2017 Tentang Pedoman Mengadili Perkara Perempuan Berhadapan Dengan Hukum? Jenis penelitian ini merupakan penelitian hukum normatif dengan sifat penelitian deskriptif. Berdasarkan penelitian ini dapat disimpulkan bahwa pertimbangan Majelis Hakim pada Putusan Nomor 10/Pid.Sus-TPK/2021/PT DKI yang mengurangi lamanya pidana dari Putusan Nomor 38/PID.SUS-TPK/2021/PN Jkt.Pst menggunakan pertimbangan yuridis yang mengambil alih pertimbangan pada putusan tingkat pertama dan juga pertimbangan non yuridis. Selanjutnya dikaitkan dengan teori pemidanaan, Putusan Nomor 10/Pid.Sus-TPK/2021/PT DKI sesuai dengan teori relatif atau teori tujuan. Berdasarkan uraian dalam tesis ini juga disimpulkan Putusan Nomor 10/Pid.Sus-TPK/2021/PT DKI tidak selaras dengan PERMA Nomor 3 Tahun 2017 dan Konvensi Mengenai Penghapusan Segala Bentuk Diskriminasi Terhadap Wanita yang menghendaki tidak ada diskriminasi. Kata kunci : putusan, penjatuhan pidana, perempuan berhadapan dengan hukum, tindak pidana korupsi JURIDICAL ANALYSIS OF PUNISHMENT FOR WOMEN IN CORRUPTION CRIMINAL CASES: Case Study Decision of The DKI Jakarta High Court Number 10/Pid.Sus-TPK/2021/PT.DKI (Fernando Imanuel, 2020112059, Master of Law, Faculty of Law Andalas University, 124 pages, 2022) ABSTRACT Judges in making decisions have freedom or have an independent nature. Even though they have freedom, in making decisions, they must be based on sufficient considerations to support the decisions they make. In Decision Number 10/Pid.Sus-TPK/2021 the defendant is a woman and in that case the Judge handed down a sentence of imprisonment for 4 (four) years and a fine of Rp. 600,000,000 (six hundred million rupiah), with if the fine is not paid, it will be replaced with imprisonment for 6 (six) months. The length of the sentence imposed on the defendant was reduced by 6 (six) years compared to the decision at the Corruption Court at the Central Jakarta District Court which sentenced the Defendant to 10 (ten) years in prison and a fine of Rp. 600,000,000.- (six hundred million rupiah), provided that if the fine is not paid, it is replaced with imprisonment for 6 (six) months. The reduction in the length of the sentence imposed by the panel of judges at the DKI Jakarta High Court against female defendants deserves a juridical review.The formulation of the problem in this research is 1) What is the consideration of the Panel of Judges in imposing a sentence on a corruption case in the Decision of the DKI Jakarta High Court Number 10/PID.SUS-TPK/2021/PT DKI? 2) How is the sentence imposed in the DKI Jakarta High Court Decision Number 10/Pid.Sus-TPK/2021/PT DKI in terms of PERMA Number 3 of 2017 concerning Guidelines for Prosecuting Women in Facing the Law? This type of research is a normative legal research with a descriptive nature. Based on this research, it can be concluded that the consideration of the Panel of Judges in Decision Number 10/Pid.Sus-TPK/2021/PT DKI which reduces the length of punishment from Decision Number 38/PID.SUS-TPK/2021/PN Jkt.Pst uses juridical considerations that take over consideration in first-level decisions as well as non-juridical considerations. Furthermore, it is associated with the theory of punishment, Decision Number 10/Pid.Sus-TPK/2021/PT DKI is in accordance with the relative theory or the theory of objectives. Based on the description in this thesis, it is also concluded that Decision Number 10/Pid.Sus-TPK/2021/PT DKI is not in line with PERMA Number 3 of 2017 and the Convention Regarding the Elimination of All Forms of Discrimination Against Women who want no discrimination.     Going Beyond Counting First Authors in Author Co-citation Analysis

    The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed

    “Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship

    Appropriate Similarity Measures for Author Cocitation Analysis

    We provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature.     Dispelling the Myths Behind First-author Citation Counts

    We conducted a full-scale evaluative citation analysis study of scholars in the XML research field to explore just how different from each other author rankings resulting from different citation counting methods actually are, and to demonstrate the capability of emerging data and tools on the Web in supporting more realistic citation counting methods. Our results contest some common arguments for the continued use of first-author citation counts in the evaluation of scholars, such as high correlations between author rankings by first-author citation counts and other citation counting methods, and high costs of using more realistic citation counting methods that are not well-supported by the ISI databases. It is argued that increasingly available digital full text research papers make it possible for citation analysis studies to go beyond what the ISI databases have directly supported and to employ more sophisticated methods

    We have done our best to complete the author checklist relating to the use of animals in the hut study. Note that the objective for the hut study was to evaluate the IRS treatment applications for residual efficacy against Anopheles mosquitoes, including the local An. coluzzii mosquito population. Cows were only used to attract mosquitoes into the huts and no tests were carried out directly on the cows. The author checklist is intended for use with studies where experiments are carried out on animals, which is why we have had such difficulty in completing this for the hut study, as many of the questions do not relate to how the cows were used
