Il decreto di ammissione della causa alla trattazione con il Processus brevior: la soluzione del Tribunale Ecclesiastico Interdiocesano Siculo
La riforma del processo matrimoniale canonico, attuata con il M.P. Mitis udex Dominus Ieusus del 2015, presenta ancora oggi diversi problemi interpretativi e, dunque, applicativi che necessitano di adeguate soluzioni. Il chiarimento di questi dubbi ermeneutici è propedeutico al fine di dare concreta attuazione alla riforma, una volta trovato il necessario equilibrio nell’immanente bipolarismo esistente fra le esigenze pastorali e i principi giuridici posti a garanzia di un giusto processo. Tra le difficoltà ermeneutiche scaturenti dalla riforma, merita menzione quella presa in oggetto dal decreto del Moderatore del Tribunale Ecclesiastico Interdiocesano Siculo del 13 dicembre 2018 sopra riportato,il cui commento richiede, però, una breve analisi di alcune criticità della nuova procedura introdotta col M.P. Mitis Iudex
I limiti della libertà religiosa: le prefigurazioni di Francesco Scaduto
L’idea alla base del lavoro prende le mosse dalla considerazione che Scaduto, oltre un secolo fa, abbia prefigurato la ricorrenza di alcune reazioni da parte dello Stato a tutela di alcune proprie “somme” prerogative nei confronti delle confessioni religiose. L’analisi lungimirante del giurista siciliano appare, in particolare, sotto certi aspetti, quasi “profetica”, se si tengono in considerazione le perspicue differenze nel tessuto connettivo sociale, politico e, soprattutto, giuridico esistenti tra i tempi in cui l'A. scriveva e i nostri giorni (prima tra tutte l’entrata in vigore della Costituzione repubblicana). La prefigurazione qui portata in evidenza concerne, segnatamente, un modello di Stato di matrice giurisdizionalista che, nelle situazioni critiche, ritorna al presidio e alla tutela delle proprie prerogative di base, a costo di frizioni finanche con le direttrici costituzionali: individuando, al riguardo, tre ipotesi specifiche che appaiono costituire esemplificativa attuazione di tale (generale) "prefigurazione"
Due matrimoni alle origini dello scisma anglicano?.
The Anglican schism, solemnized by the Act of Supremacy in 1534 emerged from the European Protestant Reformation that at its beginning was a movement of dissent against the Roman Church. It spread throughout Europe thanks to political and economic support of many princes who transformed it into State religion. Movement’s success is strictly linked to the intention of individual States to claim their autonomy, unfettering themselves from external influences, such as the papacy, and thus creating State’s territorial Churches. The Church of England’s schism originates from this peculiar historical and religious scenario, and has its roots in a general process to claim sovereignty of the Kingdom against any external influence. Nevertheless, someone – especially English literature, still believes that the real reason behind Anglican schism is Pope Clement VII’s refusal to declare null the marriage of Henry VIII with Catherine of Aragon and consequently preventing him from marrying Anne of Boleyn. We deemed it necessary a critical examination of the matter concerning the refusal to grant nullity to Henry VIII’s marriage, in order to determine whether the underlying cause of the Act of Supremacy was a love story that turned out badly, or other more ordinary reasons. For this purpose, we have analysed an equally resounded, but lesser known trial. It regards the declaration of nullity of the marriage between Edward IV and Elizabeth Woodville, granted few decades earlier, as it represents a significant legal/matrimonial precedent of schismatic nature. We tried to evaluate the legal legitimacy, according to matrimonial canon law, in force at that time, to evaluate whether or not justice was done

Algorethics: On the Relationship Among Artificial Intelligence, Law and Religion
With the development of the digital age, artificial intelligence is increas- ingly present and pervasive in every aspect of daily life, both personal and social, affecting decision-making processes and stressing the already complicated relation- ship between science, law and religion. Hence the need to build an “algoretic,” understood as ethical reflection about the use of algorithms, in order to avoid their indiscriminate and potentially discriminatory use perhaps to the detriment of the frail and marginalized. Artificial intelligence can, in fact, be distorted through specific commercial and political interests with the risk of focusing algorithms on utility and profit through selection bias or distortion/corruption in data collection and coding prejudices. The analysis of the ethical and moral implications of artificial intelligence is also a challenge and an opportunity for religions, as evidenced by the recent signing (January 2023) of the “Rome Call for AI Ethics” at the Vatican by representatives of the three Abrahamic religions. In this field, religions have the opportunity and obli- gation to engage their teaching, voice and authority regarding the philosophical and anthropological challenges related to artificial intelligence that loom large in their impact on present rights and future opportunities. Indeed, the confrontation with a form of intelligence that is not human, or even biological, raises essential questions for metaphysics, epistemology, ethics, and political theory. The experience and expertise of religions in all these fields constitute invaluable assets to be used to assist society in adapting artificial intelligence or adapting to it. Religions are, therefore, called upon to listen, reflect and engage by proposing an ethical and spiritual framework within which to metabolize the enormous social impact that algorithm-based technological evolution will have on the universal community in the coming decades. By reasoning on these issues, one hopes to avert the risk of a role reversal typical of the Hegelian dialectic, that is, a subversion of servant-master (in our case algorithm-man) roles based on the servant’s acquired self-awareness (perhaps through the mechanism of machine learning), with an existential-type reversal, by virtue of which the servant, through acquired self-awareness, becomes free and the master becomes a servant
Transition to Circular Economy in the Water Sector by Legislative Perspectives for the Sicilian Region (Italy)
Water reuse practices still need to be consistently implemented across Europe and globally, primarily due to insufficient social trust and the complexities of governance surrounding water reuse techniques. Additionally, the need for uniformity in water reuse regulations is a significant factor. To address these challenges, the European Parliament recently passed Regulation 2020/741, which establishes minimum requirements for water reuse to standardise legal obligations for reclaimed wastewater. This regulation also mandates the development of Water Reuse Risk Management Plans (WRRMPs) for all Union reclamation facilities. This manuscript aims to provide an overview of the current regulations on water reuse in Europe, Italy and Sicily. A critical overview has also offered how the regulations changed over time. Moreover, a first attempt at developing WRRMPs for a Sicilian plant (Corleone) has been made. Results showed that the human health risk related to using an agricultural scope is equal to 4 and can be classified as low
Going Beyond Counting First Authors in Author Co-citation Analysis
The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation
counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed
Variations on the Author
“Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship
