The role of Shari’a as a source of Law: looking for a pragmatic approach

    No full text
Starting from the second half of the last century, a great emphasis has been put on Shari’a as a central element in the legal system of many Muslim-majority states. The common approach to considering Islamic legal systems, however, is still dominated by a monolithical conceptualization of Islamic law, where the description of Shari’a is derived from abstract reasoning on what Shari’a is or ought to be. The aim of this article, after a discussion of the concept of law in Islamic legal thought and an overview of the different interpretations of Islamic law as elaborated within divergent cultures (Arab Republic of Egypt, UAE and Saudi Arabia), is to advance the idea of Islamic Law as an essentially contested concept, and to detach its analysis from any formalism in favour of an acknowledgment of its antagonistic, unfixed and ever-evolving natur

    No full text
One of Egypt\u27s most worked-on agendas is developing a new enhanced streets network, which directly impacts street users, city residents, and most certainly the economics of the country as a whole. Additionally, street design has an immense impact on developing livable and sustainable cities, since designing them sufficiently means that one-third of the city design is successful, with a tremendous effect on the remainder of the city, especially on already established cities and their residents. The crucial factor is to apply a comprehensive approach in planning or developing them, where all factors involved must be considered, including pedestrians, vehicles, parking slots, etc. This must be achieved without neglecting the important role of public participation in matters of concern. Thus, this study aimed at analyzing one of the newly developed streets in Nasr City, Cairo, to assess its achievement and if it needs enhancement from the public point of view. It was found that the latest development of the Mostafa El-Nahas Axis was favored by the majority of the study sample. However, some enhancements must be conducted on the detail level. For example, the study sample expressed the need for increasing plantations on the street and making it more pedestrian friendly
