Il concetto di costituzione in Franco Modugno, fra positivismo giuridico e “giusnaturalismo"
Nel pensiero di Franco Modugno il problema costituzionale essenziale è quello relativo al suo fondamento. L’autore tiene conto della costruzione kelseniana ma se ne distacca, criticandone l’assenza di considerazione della realtà concreta e del contenuto del dato normativo. Lo stesso giudizio costituzionale mostra, al contrario, come il fatto e il diritto si incontrano e si raffrontano, determinando il significato della disposizione normativa. Franco Modugno, proprio a questo riguardo, prende a modello la sintesi hegeliana, sebbene egli ritenga un pregiudizio l’esclusiva statualità del diritto, ritenendo che i contenuti assiologici di un ordinamento siano pre-normativi ma non per questo meta-giuridici. Interessante è poi confrontare la concezione costituzionale di Franco Modugno con il giusnaturalismo. Al riguardo occorre innanzitutto essere consapevoli della difficoltà di accertare quali siano gli elementi caratterizzanti di questa corrente di pensiero, storicamente contrapposta al positivismo. In una prospettiva unitaria, sembra da accogliere la proposta di chi considera giusnaturalista ogni posizione teorica in cui si riconosca la domanda sul fondamento del diritto, la risposta riferita alla natura, comunque intesa e, infine, la forza vincolante di quest’ultima sull’attività normativa dell’uomo. Ebbene, per quanto in Franco Modugno sia presente la critica nei confronti di un certo giusnaturalismo e per quanto egli abbia espressamente negato l’idea del fondamento naturale o extrapositivo dei diritti inviolabili di cui all’art. 2 della Costituzione italiana, le tesi che ha sostenuto non appaiono in definitiva lontane dal giusnaturalismo. Oltre alla domanda sul fondamento dell’ordinamento giuridico, vi è infatti la difesa della possibilità razionale di trascendere l’ordinamento positivo e di ricercarne oltre la validità. Egli ha inoltre ritenuto che il potere di revisione costituzionale è condizionato dalle scelte assiologiche, irretrattabili anche da parte di maggioranze politiche. Ha poi affermato che l’attività ermeneutica è un momento di scelta fra possibili significati normativi, tutt’altro che arbitraria o indipendente dalla realtà e che l’interprete è vincolato a considerare la struttura assiologica immanente nell’ordinamento. In definitiva la stessa continua interazione fra essere e dover essere che Modugno ha costantemente sostenuto, risulta coerente con la concezione del diritto naturale secondo cui, nella dialettica fra Sollen e Sein, il referente ineliminabile è situato al livello del Sein, ossia dell’essere uomo, sia pure inteso non in senso ontologico ma in senso fenomenologico, come capacità della ragione umana di comunicare, persuadere, accettare, aderire e consentire e di ricavare, nella sintesi e nel giudizio, vere e concrete leggi universali o razionali.In the thought of Franco Modugno the constitutional problem is related to its essential foundation. The author takes account of Kelsen's construction, without accepting it, criticizing his lack of consideration of reality and the legal content of the data. His views on constitutional problems show, on the contrary, how facts and the law come together and are compared by determining the meaning of each legal provision. Modugno, precisely in this respect, models his approach on the Hegelian synthesis, although he accepts as a premise the exclusive nature of statehood, arguing that the contents of an axiological order are pre-normative but not for this reason meta-juridical. It is interesting to compare Modugno's constitutional conception with natural law. First, it is necessary to clarify the salient features of this current of thought, historically opposed to positivism. Reproductive biology characteristics of red mullet (
The main important reproductive aspects of Mullus barbatus, one of the most important target species for the fishery in the Mediterranean basin, have been studied on the basis of MEDITS trawl survey and sampling of commercial landing. The total length (TL) of females has been demonstrated to be positively correlated with egg sizes and plasmatic concentration of vitellogenin. The possible implications of these aspects on the management of red mullet resources are discussed in this work. Moreover, the relationship between TL and fecundity follows an exponential pattern with a temporal trend during the spawning season. These results represent an important input for more effective management measures, such as the seasonal closure of fishery in summertime. The frequency distribution of the oocytes’ diameters showed an asynchronous ovarian organization with batch spawning pattern. Monthly variations in the gonadosomatic index and maturity stages percentage showed that males spawn during almost the entire year showed an increasing trend from November to June and a decreasing trend from July to October, while females in spawning phase are recorded from April to July, with peaks in May and June. The length at 50% maturity (L50) estimated respectively for females and males are 12.1 cm (±0.083) and 10.1 cm (±0.073)

Financed design research made by Universities: some considerations about the protection of results
The gradual decrease of the public funding of research, is counterbalanced by an increasing interest by part of the politic power to foster collaboration between universities and industry for development of competitive innovation. In the United States the Bayh–Dole Act of 1980 allowed university patenting, by granting ownership and copyrights of inventions to universities and changing the way public organizations conceive the applied research. The patent has become an increasingly significant indicator of scientific productivity, and seems to be able to grant the kind of protection required by the Industry to cooperate with the University in funding research aimed to innovation. WET ARCHAEOLOGICAL WOOD: CHEMICAL STUDY OF DEGRADATION AND EVALUATION OF CONSOLIDATION TREATMENTS
The present work describes a thoroughly analytical study of the chemical changes produced in waterlogged woods collected from different different archaeological sites. This study is very important in order to develop appropriate measures for the conservation of historical wooden artifacts. The chemical changes produced in the waterlogged woods were studied by different pyrolytic techniques: direct exposure electron ionization-mass spectrometry (DE-MS), pyrolysis coupled with gas chromatography-mass spectrometry (Py-GC/MS) and Py-GC/MS in the presence of hexamethyldisilazane (HMDS) as a derivatising agent. The study concluded that the main structural changes occurring in waterlogged woods are the removal of carbohydrates. The lignin moiety remains largely unaltered, although some small changes could also be observed, such as depolymerisation, demethylation of methoxyl groups and some evidences of a slight oxidation of α-carbon of the lignin side-chain.
In the last chapter, the author also describes the morphology of degraded archaeological waterlogged woods and the evolution of penetration of different wood impregnants by the use of X-ray synchrotron radiation microtomopraphy (SR-μCT), which gives useful insights into the use of different consolidation treatments
CONTRIBUTO ALLA CONOSCENZA DELL'AZIONE SVOLTA DAI NEMICI NATURALI DEGLI AFIDI DEL MANDORLO (AMYGDALUS COMMUNIS) IN AGRO DI BARI
Thc author examines the effects of predarors and parasites of almond aphids in an orchard where insecticides are not used. In 1970-71 some observations wcre carried out near Modugno (Ba), but in 1972-73 owing ro the very low infestation of aphids at Modugno, these srudies were conrinued in the <<Campus» of rhe Agricultural Faculty of the Universiry of Bari, where there is a collection of almond trees. Sarnples of infested rrees were taken weekly. The Jarvae of predarors and parasites were reared and the aphids were counted. A list of species of aphids, predators and parasires is reported. The observarions indicated that the action of predators and parasites is not sufficienr to control aphid infestations to almond trees; infact, at the end of the infestation, the trees were badly damaged.Dal 1970 al 1973 sono state eseguite osservazioni sulle infestazioni di Afidi sui mandorli (Amygdaius commtmis) allo scopo di evidenziare quale fosse l'azione svolta dai predatori e dai parassiti di questi fitofagi e per accertare se fossero in grado di limitare i danni alle piante.Nei primi due anni indagini sommarie furono eseguire in agro di Modugno, in una zona definita << naturale» in quanto non erano effettuati trattamenti antiparassitari che potessero alterare le osservazioni. Negli anni successivi (1972 e 1973), a causa della diminuizione di infestazione afidica in agro di Modugno, le osservazioni ed i campionamenti furono spostati in una collezione di mandorli in condizioni « naturali » nel « Campus » della Facoltà di Agraria dell'Università di Bari. I campionamenti furono effettuati settimanalmente prelevando a caso dei rametti di 10-15 cm di lunghezza dagli alberi maggiormente infestati degli Afidi. Gli stati preimmaginali dei predatori e dei parassiti furono allevati in laboratorio per la determinazione delle specie mentre gli Afidi, spennellati in alcool, furono inseguito contati al microscopio stereoscopico. Nel lavoro viene riportato l'elenco delle specie degli Afidi trovati sugli alberi di mandorlo, dei predatori e dei parassiti. A conclusione delle osservazioni è emerso come l'azione dei predatori e dei parassiti non sia sufficiente a limitare i danni degli Afidi ai mandorli ecome, alla fine della infestazione afidica, queste piante mostrino evidentissimi segni di danni ed un elevato deperimento
Introduction to the theory of semi-holonomic jets
this paper is to explain how semi-holonomic jets occur naturally in Differential Geometry and to serve as an elementary introduction to the works devoted to semi-holonomic jets; we leave to the reader the task of studying these papers. Among the mathematicians who have investigated semi-holonomic jets are C. Ehresmann pupils (J. Pradines and the author, P. Ver Eecke, P. C. Yuen). A very important contribution has been made by I. Kol'ar and his co-workers, especially concerning natural transformations and higher order connections, as well as G. Virsik and M. Modugno. For instance I. Kol'ar has introduced the notion of equivalence with respect to curves for semi-holonomic jets; in the case of holonomic jets, equivalent jets coincide. Modeling climatic, terrain and soil factors using AHP in GIS for grapevines suitability assessment
The study carried out in Matera, Italy, used multi-criteria decision-making techniques and geographic information systems to identify optimal area management for sustainable grape production. Terrain parameters such as temperature, pH, humidity, soil texture, slope, altitude, nutrients and precipitation were considered. ArcGIS maps were created, and the northwest part of the field was identified as a favorable area. Fuzzy maps were generated, and measurements were taken in each area to determine optimal land management. The results revealed that 51% of the area was very highly suitable for agricultural activities, and 49% was considered high suitable. Receiver operating characteristic (ROC) analysis of the AHP results demonstrated a high level of accuracy, as indicated by the area under the curve (AUC). The produced maps indicated a similar trend of increasing zone management priorities for physico-chemicals as depth fluctuate. Additionally, results showed that remote sensing indices were the most important variables to predict physico-chemicals zone management. The study also highlighted that the majority of the area supported plant growth due to favorable temperature and humidity conditions, with only a small portion in the northwest showing less favorable results. By identifying management zones, the study aimed to protect crops, better use of irrigation water and improve yields. This study highlights the potential of integrating satellite remote sensing, GIS technology and AHP as a valuable tool for agricultural land use planners and policy makers in identifying optimal locations for managing grape production. © 2024 The Author(s).
