    A decisão judicial e a filosofia relativista de Hans Kelsen: uma abordagem hermenêutica

No primeiro momento expõe a concepção de decisão judicial no autor e as suas reformulações conceituais no decorrer das suas obras - as passagens do formalismo normativista das primeiras obras até o ceticismo de regras na Teoria geral das normas. Também propõe a dissolução entre as leituras formalistas e realistas através da possibilidade de uma leitura realista moderada. Após expõe a filosofia relativista do autor e seu resultado na exclusão dos elementos da moralidade do conceito de direito. Finalmente deduz regras de interpretação a partir de uma visão abrangente das obras do autor. O objetivo da dissertação, nesse sentido, é analisar a dinâmica da criação normativa pelo judiciário, a discricionariedade daí resultante e a possibilidade de interpretar os vários sentidos das normas sem recorrer a qualquer moralismo para tal.Abstract : The central theme of this thesis is the hermeneutic approach of the court decision in Hans Kelsen considering his philosophical relativism. In the first chapter exposes his conception of court decision and his conceptual reformulations - the normative formalism and the legal realism. Also proposes the moderate realism as a possible reading. After, in the second chapter, exposes the philosophical relativism and the exclusion of the morality elements of the concept of law. Finally deduces interpretation rules from a full view of the author's works. The aim of the thesis is analyze the dynamics of the normative creation by the judiciary, his discretionary consequences and the interpretation of the various sense of the norms without any moralism

    Going Beyond Counting First Authors in Author Co-citation Analysis

    The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed.     Variations on the Author

    “Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship

    Appropriate Similarity Measures for Author Cocitation Analysis

    We provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature.     Dispelling the Myths Behind First-author Citation Counts

    We conducted a full-scale evaluative citation analysis study of scholars in the XML research field to explore just how different from each other author rankings resulting from different citation counting methods actually are, and to demonstrate the capability of emerging data and tools on the Web in supporting more realistic citation counting methods. Our results contest some common arguments for the continued use of first-author citation counts in the evaluation of scholars, such as high correlations between author rankings by first-author citation counts and other citation counting methods, and high costs of using more realistic citation counting methods that are not well-supported by the ISI databases. It is argued that increasingly available digital full text research papers make it possible for citation analysis studies to go beyond what the ISI databases have directly supported and to employ more sophisticated methods

    Contact stress field analysis on a flat coated substrate

    To coat mechanical components, that will be subjected to contact load, has been a procedure aiming the reduction of the wearing in the substrate. However, these components could fail, generally by: excessive plastic flow, fracture, or delamination of the coat from its substrate. In this work, perfect interface between layer and substrate was considered. We have done a two-dimensional analysis, using finite element method, of the stress distribution arising when a plane coated body is subjected to a contact load by an elastic cylindrical indenter. We consider normal and tangential force. Both, substrate and indenter were made of Steel. Three different types of material were used as a coating: brass, ceramic and Steel. The last one was used for validation. The results are used to investigate the influence in the field stress from layer thickness, properties of the coating materiais and the friction coefficient that acts between the indenter and coating. The results show that there is an optimum thickness when the substrate is coated with ceramic. In this case, the substrate is more protected by the layer.Dissertação (Mestrado)A utilização de corpos revestidos sujeitos a tensões de contato tem sido uma opção importante na redução do desgaste superficial em uma vasta gama de corpos que vão desde órgãos humanos, passando por discos rígidos na computação até elementos de máquinas. Entretanto, mecanismos de falha podem ocorrer nestas situações. E ocorrem, geralmente, por três diferentes motivos: Escoamento plástico excessivo, fratura ou por delaminação do revestimento do seu substrato. Neste trabalho, considerou-se que uma interface idealmente perfeita existe entre o substrato e o revestimento. Face ao exposto, procedeu-se a uma análise bidimensional da distribuição das tensões de contato que surgem quando um semiplano infinito e revestido se sujeita ao contato de um indentador elástico e cilíndrico, utilizando-se o Método dos Elementos Finitos. Foram consideradas as situações em que havia carregamentos normal e tangencial. Três tipos de materiais foram usados como revestimentos: bronze, cerâmico (SiC) e aço. Este último foi utilizado na validação do modelo proposto. Os resultados foram utilizados para se investigar a influência que há no campo de tensões sempre que se variam os seguintes parâmetros: espessura da camada de revestimento, propriedades mecânicas dos materiais e coeficiente de atrito entre o revestimento e o indentador. Nas condições estudadas neste trabalho, foi possível observar que há uma influência muito pequena da força tangencial no campo de tensões de contato, quando o coeficiente de atrito é menor que 0,15. Os resultados mostram que há uma espessura ótima de camada quando o substrato é revestido com cerâmica, quando se mantém constante o coeficiente de atrito. Neste caso o substrato é melhor protegido pelo revestimento

    We have done our best to complete the author checklist relating to the use of animals in the hut study. Note that the objective for the hut study was to evaluate the IRS treatment applications for residual efficacy against Anopheles mosquitoes, including the local An. coluzzii mosquito population. Cows were only used to attract mosquitoes into the huts and no tests were carried out directly on the cows. The author checklist is intended for use with studies where experiments are carried out on animals, which is why we have had such difficulty in completing this for the hut study, as many of the questions do not relate to how the cows were used
