    U radu se analizira pristup Europskog suda za ljudska prava predmetima koji se tiču izdvajanja djeteta iz obitelji. Mjera izdvajanja djeteta iz obitelji najintenzivniji je oblik intervencije nadležnih tijela u obiteljski život djece i roditelja koja, s obzirom na relativno široko područje primjene, utječe na različita prava i interese. U radu se razmatraju načelna stajališta Suda o pojedinim aspektima predmeta koji se tiču te mjere kao i njihova primjena u konkretnim slučajevima. Autorica drži da analiza sudske prakse u ovom vrlo osjetljivom području pokazuje da ona može pozitivno utjecati na razvoj pravne kulture, ali samo ako joj se pristupa kritičkiThis paper analyses the European Court of Human Rights' approach to the applications regarding the removal of the child from the family. The measure of removing the child from the family is the most intrusive form of interference of the competent authorities into family life that, considering its broad area of application, affects different rights and interests. This paper considers the Court's general principles on certain aspects of the cases regarding this measure, as well as their application in the concrete cases. The author is of the opinion that the analysis of the Court's case-law in this extremely sensitive area shows that it can have positive effect on the development of the legal culture, but only if it is approached critically

    Kosovo 1989: The (Ab)use of the Kosovo Myth in Media and Popular Culture

    The author explores the creation of public opinion in Serbia in the late 1980s and the (ab)use of the 600th anniversary of the Battle of Kosovo on 28 June 1989. As a result of Serbian president Slobodan Milošević’s carefully planned propaganda, a negative image of Albanians as well as a positive perception of Serbian nationalism were enforced. The media and popular culture played a particularly important role in reviving the Kosovo Myth, together with the leading Serbian (academic) institutions and influential intellectuals. Thirty-some years after 1989, the Kosovo Myth is presented in the media in a largely unchanged manner, while for Serbia the Kosovo problem remains unsolved

    THE CHANGES IN THE MATRIMONIAL PROPERTY REGIME IN CROATIA – THE UNFINISHED QUEST FOR IMPROVEMENT

    Croatian family legislation went through several reforms in the last twenty years and this paper focuses on the matrimonial property regime after the most recent legislative intervention in 2015. The Family Act 2015 tried to attach more importance to the matrimonial property relations, thus providing for some significant changes and novelties. While there were certainly legitimate aims behind the changes introduced, for example increasing the level of legal certainty in the real estate trading or the protection of the child\u27s wellbeing in the cases of breaking the family union with respect to its right to habitation, it is doubtful whether those aims are achieved. The relevant provisions of the Family Act 2015 raise some serious concerns and generate certain new problematic points but at the same time leave previously opened issues unresolved. The author analyses the regulation of the matrimonial property regime with the purpose of detecting its advantages and its shortcomings as well as indicating the possibilities for improving the existing situation

    Multimodal Media Tools of Popular Geopolitics: Russian Politics in Foreign Media Cartoons

    The article focuses on the political cartoons about Russia and analyzes the potential of multimodal media texts as the tools of popular geopolitics. The author also employs S. Hall’s concept of propaganda, considering the text of a caricature from semiotic perspective. The integration of the theoretical fields of popular geopolitics and propaganda is substantiated, since political cartoons not only form stereotypes about politics and international relations among media readers, but also perform propaganda functions, broadcasting the point of view of the information platform on Russian politics and Russia. The empirical base of the study embraces 242 political cartoons from Russian-language and English-language foreign media, posted in the public domain on the Internet in 2020-2021, the period of the COVID-19 pandemic. Political cartoons are analyzed with the method of expert evaluation and interdisciplinary classifier for the analysis of political cartoons. The obtained empirical results were subjected to statistical processing, including the identification of correlations. The results demonstrate that in foreign media political cartoons about Russia and Russian politics create two different images of Russia. The first description is typical for English cartoons where Russia appears in the context of international relations, mostly its ties with the United States; and the target character in English cartoon is the Russian president. Englishlanguage cartoons are more often focused on harsh criticism and the use of schematized images. Moderate criticism dominates in Russian-language cartoons of foreign media; the target characters are not only the president, but also other representatives of Russian society. Thematically, Russian-language cartoons are constructed in the context of Russia's internal political problems; the field of education is usually the most intentionally “negative”. According to the study, it is the Russian-language cartoons of foreign media that have the most complex and rich visual code and use Aesopian language. In conclusion, the author highlights the importance of further studies of the tools of popular geopolitics, as well as the need to improve the practice of creating multimodal media texts in the logic of the Russian understanding of geopolitics

    Legal Protection of Family Life in the Context of Foster Care

    Iako ne postoji univerzalno prihvaćena definicija „obitelji“ ni „obiteljskog života“, može se smatrati općeprihvaćenim da ti pojmovi nisu ograničeni isključivo na osobe povezane biološkim srodstvom. Oba ta koncepta, na međunarodnoj i europskoj razini, obuhvaćaju i udomitelje tj. udomiteljske obitelji. Ovo istraživanje usmjereno je ponajprije na ispitivanje pristupa Europskog suda za ljudska prava spram mogućnosti nastanka i zaštite obiteljskog života u kontekstu udomiteljstva. Iako ovaj Sud pruža zaštitu različitim oblicima bliskih osobnih veza, svrha i narav udomiteljstva te razlozi i način zasnivanja udomiteljskog odnosa nameću potrebu pobližeg pronicanja u pojedine aspekte obiteljskog života razvijenog u tom kontekstu, počevši već od modaliteta njihova nastanka – obiteljski život biološke obitelji može se smatrati danim, dok u udomiteljskoj obitelji obiteljske veze treba „izgraditi“. Cilj ovog rada jest identificirati pretpostavke nastanka obiteljskog života između udomitelja i udomljenog djeteta te sadržaj i doseg pravne zaštite prava udomitelja na obiteljski život u judikaturi Suda. Također, autorica se osvrće na pitanje zastupanja djeteta od strane udomitelja u postupku pred Sudom te problematiku instrumentalizacije udomiteljstva u svrhu legitimiranja protupravnih postupaka. Zaključci na koje ovo istraživanje upućuje trebali bi biti de lege ferenda smjernice državama u pogledu pristupa uređenju odnosa između udomitelja i udomljene djece.Although there is no universally accepted definition of “family” or “family life”, it can be considered generally accepted that these terms are not limited exclusively to persons connected by biological kinship. Both of these concepts, at the international and European level, also include foster parents, i.e., foster families. This research is primarily focused on examining the approach of the European Court of Human Rights to the possibility of creating and protecting family life in the context of foster care. Even though this Court provides protection for various forms of close personal ties, including those that develop between a foster parent and a foster child, the very purpose and nature of foster care, as well as the reasons and method of establishing a foster relationship, lead to the conclusion that there must be certain differences in comparison to the family life of biological parents and their children starting from the modality of their origin. Namely, the family life of the biological family can be considered as given, while in the foster family, family ties need to be “built”. The aim of this paper is to identify the conditions of the creation of family life between a foster parent and a foster child, as well as the content and scope of the legal protection of the foster parent’s right to family life in the jurisprudence of the Court. Also, the author considers the question of the child’s representation by the foster parent in proceedings before the Court as well as the issue of the instrumentalization of foster care for the purpose of legitimising illegal acts. The conclusions to which this research refers should be de lege ferenda guidelines for governments regarding the approach to regulating the relationship between foster parents and foster children

    Effects of Cell Phone Notification Levels on Driver Performance

    abstract: Previous literature was reviewed in an effort to further investigate the link between notification levels of a cell phone and their effects on driver distraction. Mind-wandering has been suggested as an explanation for distraction and has been previously operationalized with oculomotor movement. Mind-wandering’s definition is debated, but in this research it was defined as off task thoughts that occur due to the task not requiring full cognitive capacity. Drivers were asked to operate a driving simulator and follow audio turn by turn directions while experiencing each of three cell phone notification levels: Control (no texts), Airplane (texts with no notifications), and Ringer (audio notifications). Measures of Brake Reaction Time, Headway Variability, and Average Speed were used to operationalize driver distraction. Drivers experienced higher Brake Reaction Time and Headway Variability with a lower Average Speed in both experimental conditions when compared to the Control Condition. This is consistent with previous research in the field of implying a distracted state. Oculomotor movement was measured as the percent time the participant was looking at the road. There was no significant difference between the conditions in this measure. The results of this research indicate that not, while not interacting with a cell phone, no audio notification is required to induce a state of distraction.     The role of CardioMEMS HF in the management of chronic heart failure: An overview

    The global importance of heart failure has risen exponentially in recent years. This is partly due to its prevalence, as much as 2% of the total population, and the high cost of therapy and unfavorable prognosis define the need for modern and novel therapies with the aim of extending the life expectancy of the affected while improving quality of life as well. Telemedicine offers exciting perspectives in mitigating this global challenge. CardioMEMS HF, a recent development of Abott Laboratories, is an implantable sensor which enables the physician to take action in the earliest stages of the chain leading to the transition from stable to decompensated heart failure. Research materials for this study have been gathered from online scientific databases—PubMed and Cochrane Library. An array of studies, published in prestigious scientific journals indicate that CardioMEMS HF prolongs the median life expectancy, improves the quality of life and facilitates a more tailored to the needs of the patient pharmacotherapy. CardioMEMS is an effective, safe, and cost-effective method for patients suffering from heart failure regardless of the ejection fraction

    The Noble Radinić Family, a Branch of the Kačići of Nadin

    Na temelju objavljene i neobjavljene izvorne građe iz Državnog arhiva u Zadru, Arhiva HAZU u Zagrebu i Znanstvene knjižnice u Zadru, autor novim saznanjima nadopunjuje prethodno objavljeni rad u broju 23 ovog zbornika, te u vrelima identificira pripadnike plemićkog roda Kačića potekle od Radina Kačića. Pozornost je pri tome usmjerena genealoškim pitanjima vezanim za rod, te nekim pitanjima nasljeđivanja. Također se govori o pitanju pripadnosti rodu Kačića, Mihovila pokojnog Ivana Mihaljevića iz Nina. U prilozima radu nalaze se prijepisi dokumenata te revidirano rodoslovlje plemićkog roda nadinskih Kačića. U kratkim ekskursima iznose se neka dodatna zapažanja o datiranju kaptolskih dokumenata te sustavu nasljeđivanja na području zadarskog zaleđa u kasnomu srednjem vijeku.Based on both the published and the unpublished sources (kept in the State Archive of Zadar, the Archive of the Croatian Academy of Sciences and Arts in Zagreb, and the Scholarly Library of Zadar), the paper brings out new facts concerning the members and genealogy of the Kačić kindred, and thus amplifies the earlier published paper in the previous volume of Zbornik. Special attention is paid to the identification of the branch descended from Radin Kačić and its members (Peter, Vlatko and Klapac, and their sons, especially Michael, Gregory and George). Some inheritance disputes within the kindred are also discussed, as well as the connection of Michael Mihaljević from Nin, son of the late John, and his forebears, with the Kačić kindred. The author concludes that the aforementioned John and a person named Peter, most probably his brother, were in fact Radin’s brothers. As an appendix to the paper, the author provides a transcript of the two documents concerning members of the kindred, as well as a reconstruction of the family tree with all members identified, up to now, of the Kačić kindred of Nadin

    Knjiga Crashing Thunder: The Autobiography of an American Indian je zasigurno najpopularnije i verovatno najkontroverznije delo Pola Radina. Po vremenu nastanka, ona spada u boasovsku antropologiju i konvencionalno se svrstava u pravac kultura i ličnost. U doba poststrukturalizma i postmodernizma, kritičke analize izazivaju krizu poverenja u sam tekst i autoritet antropologa kao njegovog priređivača. Novi činovi čitanja dovode u sumnju antropološka i književno-naučna shvatanja autobiografije Crashing Thunder-a kao autentičnog etnografskog dokumenta, lične ispovesti ili religijskog narativa, otkrivajući i naglašavajući implicitna, simbolička i performativna značenja prirođena nativnom tekstu i njegovom kulturnom zaleđu. U ovom ogledu polazi se od doživljaja dela i teksta u recepciji antropološkog čitaoca kao narativa o verskoj konverziji i ličnoj ispovesti. Argumenti koji podupiru interpretaciju tako shva- ćenog značenja nalaze se u etnografsko-antropološkoj relevantnosti religije pejota kao teme u Radinovom vinebaškom opusu; vrlo verovatnoj, mada ne i eksplicitno formulisanoj, zamisli antropologa da na konkretnom primeru-slučaju, tj. životnoistorijskom svedočanstvu informanta i subjektivnog aktera, pokaže mikro-aspekte proučavanog procesa, kulturne i religijske promene u vinebaškim zajednicama na prelazu iz XIX u XX vek; i obeležjima autobiografske strategije nativnog pisca i naratora.The book "Crashing Thunder: The Autobiography of an American Indian" is surely the most popular and likely the most controversial work of Paul Radin. Chronologically, it belongs to Boasian anthropology and is conventionally placed in the trend of culture and personality. In the times of post-structuralism and post-modernism, critical analyses cause a crisis of trust in the mere text and authority of an anthropologist as its author-editor. New acts of reading cause suspicion in anthropological and literary-scientific understanding of the autobiography of Crashing Thunder as an authentic ethnographic document, personal testimony or religious narrative, while revealing and highlighting implicit, symbolic and performative meanings inherent to the native text and its cultural background. In this experiment, the starting point is the experience of the work and text in the reception of an anthropological reader as a narrative about religious conversion and personal testimony. Arguments which support the interpretation of a meaning comprehended in this manner are found in the ethnographic-anthropological relevance of Peyote’s religion as a topic in Radin’s Winnebago opus; a rather likely, but not explicitly formulated idea of the anthropologist to display on a concrete example-case, i.e. life historical testimony of the informant and subjective actor the micro-aspects of the inspected process, cultural and religious changes in Winnebago communities at the turn of the 19th to the 20th century; and features of the autobiographic strategy of the native writer and narrator
