No full textIn diesem Beitrag thematisieren wir, welche impliziten Logiken und Strukturen die Care-Praxis in Live-in Betreuungsverhältnissen mitkonstituieren und wie dies die Wirkungsmacht von gesetzlichen Regulierungen beeinflusst. Anstatt sich lediglich funktionalistisch auf die rechtlichen Rahmenbedingungen als «Hintergrundvariable» (Kretschmann 2018, 139) zu beziehen, gilt es die Wirkmächtigkeit rechtlicher Bedingungen in der alltäglichen Arbeitspraxis im Haushalt in den Blick zu nehmen. Insofern sehen wir es als unsere Aufgabe, die Debatte um die Möglichkeitsbedingungen einer wirksamen Regulierung von Live-in Care-Arrangements zu verkomplizieren.
Im Beitrag gehen wir zunächst auf die Eckpunkte der rechtlichen Regulierung von Live-in Arbeitsverhältnissen in der Schweiz ein und zeichnen in groben Zügen deren Entwicklung in den letzten 15 Jahren nach (2). Vor diesem Hintergrund diskutieren wir an zwei empirischen Fallbeispielen arbeitsrechtliche Aushandlungen (3). Dabei beziehen wir uns auf jüngere Gerichtsurteile zur Live-in Betreuung. Der erste Fall bezieht sich auf ein privates Arbeitsverhältnis zwischen der polnischen Care-Arbeiterin Edyta Wierczok und einer Schweizer Familie. Beim zweiten Fall geht es um ein Arbeitsverhältnis zwischen der polnischen Care-Arbeiterin Romana Wroclawska und einer privaten Personalverleih-Firma. Beide Aushandlungen sind auch Ausdruck davon, dass sich in der Schweiz in den letzten zehn Jahren migrantische Care-Arbeiter*innen verstärkt organisiert haben und mit gewerkschaftlicher Unterstützung Rechtskämpfe führen konnten. Anhand der beiden Fallbeispiele nehmen wir sowohl den Gegenstand der Aushandlungen (insbesondere: Definition von Arbeit und Freizeit und die Frage nach Entschädigung von Bereitschaftsdienst) als auch deren struktureller und transnationaler Kontext sowie die Agency der Live-in Betreuer*innen in den Blick. Abschliessend (4) ziehen wir ein Fazit zur Zukunfts(un)tauglichkeit des Live-in Betreuungsmodells

No full textLes arrêts de la Cour européenne des droits de l'homme relatifs à la vie privée et à la vie de famille de l'art. 8 CEDH et à l'interdiction accessoire de discrimination prévue à l'art. 14 CEDH ont eu un impact sur plusieurs développements en droit suisse, notamment en matière de droit de la filiation, d'adoption, concernant le droit à l'autorité parentale et l'accès aux données sur sa propre origine ou au sujet de la jurisprudence relative au droit à connaître sa propre paternité (ou non-paternité). L'ouverture qui prévaut actuellement pour une plus grande diversité de formes de vie familiales reflète les assouplissements ayant déjà eu lieu dans la législation sur la famille d'autres pays européens et est largement soutenue par la jurisprudence de la CourEDH. Plus particulièrement, les récents arrêts de la CourEDH sur le traitement des relations en cas de maternité de substitution, sur la constatation ou la contestation de la paternité et sur les droits de personnes de même sexe vivant en partenariat pourraient avoir une influence sur les révisions légales en cours ou à venir en Suisse
Going Beyond Counting First Authors in Author Co-citation Analysis

counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed
Variations on the Author
Full text link“Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship
Appropriate Similarity Measures for Author Cocitation Analysis
Full text linkWe provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature.
