A Política criminal para o trânsito no Brasil: uma leitura a partir do garantismo jurídico de Luigi Ferrajoli e do princípio da dignidade da pessoa humana

Programa de Pós-Graduação em Direito.Estamos vivendo tempos difíceis, tempos de desrespeitos aos direitos e garantias individuais, de um direito penal de emergência, onde a busca pela eficácia tem olvidado direitos e garantias individuais. E é neste contexto que se faz necessário um resgate da teoria do Garantismo Penal de Luigi Ferrajoli. Nesse sentido o Garantismo tem-se apresentado como uma teoria jurídica e política que revela grande potencial explicativo e propositivo para todos aqueles operadores jurídicos preocupados com as patológicas práticas operativas cada vez mais distantes do modelo jurídico-político centrado em direitos. É desenvolvido a partir da crítica ao Direito Penal, adquirindo atualmente pretensões generalistas, isto é, nasce como discurso de deslegitimação do sistema penal e alça seu potencial à estruturação de nova concepção sobre a teoria geral do Direito e do Estado (teoria política). De sorte que a presente investigação buscará realizar uma análise crítica do momento atual à luz da teoria do Garantismo Penal e do Princípio da Dignidade da Pessoa Humana, correlacionando-os com a política criminal e, principalmente, com os ditames constitucionais, buscando uma fundamentação jurídico-constitucional para (dês)legitimar a criminalização de condutas no trânsito. A pesquisa vincula-se à área de concentração enominada Direito, Estado e Sociedade e à linha de pesquisa Constituição, Cidadania e Direitos Humanos, do programa de Mestrado em Direito da Universidade Federal de Santa Catarina e Universidade Comunitária da Região de Chapecó, Turma Especial MINTER UFSC/UNOCHAPECÓ. A pesquisa é bibliográfica, com consultas a diversas obras, periódicos, bancos de dados, legislações, estudos cadêmicos, disponibilizados na forma impressa e eletrônica e as conclusões deram-se a partir dessas análises. Como resultado da pesquisa aponta-se ue ao contrário do afirmado por muitos, que consideraram a legislação de trânsito brasileira um grande avanço, vislumbrou-se exatamente o contrário, uma vez que o Código de Trânsito Brasileiro pouco inovou e, onde inovou, a exemplo da criação de um capítulo destinado à criminalização de algumas condutas tidas como mais graves, andou mal. E andou mal porque ao criar o chamado Direito Penal de Trânsito, fez uso de um procedimento em total desarmonia com um Direito Penal de índole garantística. Valendo-se de uma reforma penal pontual, cuja justificativa é um #clamor social#, um clamor social da mídia, que ao mesmo tempo em que manipula é manipulada, uma vez que é o instrumento de convencimento para uma política de ocasiãoWe are living difficult times, times of disrespect for individual rights and guarantees of a criminal emergency, where the search for efficiency has forgotten individual rights and guarantees. And in this context a rescue of the Luigi Ferrajoli Criminal Guaranteed is made necessary. In this regard, the Guarantee has been introduced as a legal and political theory that reveals great explanatory potential and purpose for all those concerned with the legal operators pathologial operating practices increasingly distant model focused on legal and political rights. It is developed from the criticism of the Criminal Law, currently acquiring general claims, that is, born as a discourse of illegitimacy of the criminal justice system and its potential do handle the new structure design of the general theory of law and the state (political theory). So that the current inquiry will seek to make a critical analysis of the current moment in the light of theory and Criminal Guaranteed Principle of Human Dignity, correlating them with the criminal policy, and especially to the dictates of the Constitution, seeking a legal-contitutional justification mandate to delegitimize the criminalization of conductin traffic. The survey is linked to the concentration area known as Law, State and Society and the research line Constitution, Citizenship and Human Rights, the Master#s program in Law at the Santa Catarina Federal University and at the Community University od Chapecó and Region, Special Class MINTER UFSC/Unochapecó. The survey is bibliographical consulted on several works, periodicals, databases, legislation, academic studies, available in print and electronic, were given up the conclusions from these reviews. As a result of research points out that unlike stated by many, who considered the Brazilian traffic laws a major breakthrough, was seen exactly the opposite since the Brazilian Traffic Code shortly innovated, and which has innovated, such as the creation of a chapter for the criminalization of certain behaviors considered most serious went wrong. Going Beyond Counting First Authors in Author Co-citation Analysis
Get PDFThe present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation
counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Variations on the Author
Get PDF“Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship
Appropriate Similarity Measures for Author Cocitation Analysis
Get PDFWe provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature. Dispelling the Myths Behind First-author Citation Counts

use of first-author citation counts in the evaluation of scholars, such as high correlations between author rankings by first-author citation counts and other citation
counting methods, and high costs of using more realistic citation counting methods that are not well-supported by the ISI databases. Note that the objective for the hut study was to evaluate the IRS treatment applications for residual efficacy against Anopheles mosquitoes, including the local An. coluzzii mosquito population. Cows were only used to attract mosquitoes into the huts and no tests were carried out directly on the cows. The author checklist is intended for use with studies where experiments are carried out on animals, which is why we have had such difficulty in completing this for the hut study, as many of the questions do not relate to how the cows were used
