Fra konflikt til løsning – opplevelser av rettsmekling i jordskiftesaker
Get PDFTemaet i denne oppgaven er rettsmekling i jordskifteretten, og partenes opplevelse av dette. Denne masteroppgaven undersøker hvordan partene opplever rettsmekling i jordskifteretten, med særlig fokus på saker fra rurale områder i Norge.
Hovedproblemstillingen for oppgaven er: “Hvordan opplever partene i jordskifteretten resultatet av rettsmekling, og hvordan påvirker dette deres fremtidige bruk av eiendommen?”
For å finne svar på hovedproblemstillingen har jeg benyttet meg av tre delproblemstillinger: 1) Hvordan har partene opplevd rettsmeklingsprosessen?
2) Hvordan fungerer avtalen i ettertid? og
3) Hvordan påvirker rettsmeklingen samarbeidet mellom partene?
For å belyse disse problemstillingene har jeg benyttet meg av kvalitative intervjuer med utvalg parter. Jeg har fått tilgang på rettsmekklede saker fra Sogn og Fjordane og Innlandet jordskifterett fra perioden 2018 - 2023. Fra disse sakene har jeg intervjuet 5 informanter om deres opplevelse av rettsmekling i jordskifteretten. Jeg har spesielt fokusert på hvordan meklingen har vært gjennomført og meklers opptreden har påvirket informantenes opplevelse av prosessen.
Funnene i studien viser at de fleste informantene har en positiv opplevelse av rettsmekling i jordskifteretten, særlig når mekleren er aktiv, faglig trygg og balanserer godt mellom veiledning og nøytralitet. Meklingens opplevde kvalitet henger tett sammen med meklerens rolle og evne til å tilpasse seg. Bruk av visuelle hjelpemidler som kart og bilder, samt gjennomføring av befaring, trekkes frem som viktige faktorer for å skape forståelse og redusere misforståelser i komplekse saker.
Når det gjelder virkningen på det videre forholdet mellom partene, tyder funnene på at rettsmekling i liten grad reduserer det underliggende konfliktnivået. Likevel oppgir flere informanter økt klarhet og trygghet i eiendomsbruken i etterkant av meklingen. Dette kan tolkes som en funksjonell forbedring, selv om den sosiale relasjonen mellom partene forblir uendret. Avtalene som inngås ser i hovedsak ut til å fungere i ettertid.
Studien bidrar med innsikt i hvordan rettsmekling i jordskifteretten fungerer i praksis, og kan ha relevans for videre utvikling av rettsmekling i jordskifteretten.The topic of this thesis is court-annexed mediation in the land consolidation court, and the parties experience of this process. This master´s thesis explores how the parties experience mediation in the land consolidation court, with particular focus on cases from rural areas in Norway.
The mein research question is: «How do parties in the land consolidation court experience the outcome of mediation, and how does this effect their future use of the property?»
To answer the main question, I have used three sub-questions:
* How have the parties experienced the mediation process?
* How does the agreement function over time?
* How does the mediation affect cooperation between the parties?
To shed light on these research questions, I have conducted qualitative interviews with selected parties. I was granted access to mediated cases from the Sogn og Fjordane and Innlandet Land Consolidation Courts from the period 2018–2023. From these cases, I interviewed five informants about their experiences with judicial mediation in the land consolidation court. I focused particularly on how the mediation was conducted and how the mediator's conduct influenced the informants' perception of the process.
The findings of the study show that most informants have a positive experience with judicial mediation in the land consolidation court, especially when the mediator is active, professionally competent, and able to strike a good balance between guidance and neutrality. The perceived quality of the mediation process is closely linked to the mediator’s role and their ability to adapt to the case. The use of visual aids such as maps and images, as well as the implementation of on-site inspections, are highlighted as important factors in fostering understanding and reducing misunderstandings in complex cases.
Regarding the impact on the ongoing relationship between the parties, the findings suggest that judicial mediation has limited effect in reducing the underlying level of conflict. Nevertheless, several informants report increased clarity and a greater sense of security in the use of their property following mediation. This may be interpreted as a functional improvement, even if the social relationship between the parties remains unchanged. The agreements reached appear, for the most part, to function well in practice.
This study contributes valuable insight into how judicial mediation functions in the context of the land consolidation court and may be relevant for the further development of mediation practices in this setting
Going Beyond Counting First Authors in Author Co-citation Analysis

counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Variations on the Author
Get PDF“Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship
Appropriate Similarity Measures for Author Cocitation Analysis

We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature. Note that the objective for the hut study was to evaluate the IRS treatment applications for residual efficacy against Anopheles mosquitoes, including the local An. coluzzii mosquito population. Cows were only used to attract mosquitoes into the huts and no tests were carried out directly on the cows. The author checklist is intended for use with studies where experiments are carried out on animals, which is why we have had such difficulty in completing this for the hut study, as many of the questions do not relate to how the cows were used
