The Sexual Contract 30 Years on: A Conversation with Carole Pateman
This reflection is based on a conversation with Professor Carole Pateman on 4th December 2017 as we prepared for a conference at Cardiff University to celebrate the thirtieth anniversary of her seminal work, The Sexual Contract (1988). As socio-legal scholars, The Sexual Contract has been formative in, and transformative of, our understandings of law and gender. We explore Professor Pateman’s academic journey and consider how she came to write a ground-breaking book that has made major impacts on socio-legal and feminist legal studies. The paper is structured around the main themes arising in conversation with Pateman, with each section centred on her own account taken from our conversation in late 2017

The author analyses the close relationship between patriarchy and the social contract. Carole Pateman puts forward a thesis that the concept of the contract consciously subordinates women to men. Pateman argues that the theoretical tool, which is the idea of the contract, masks the male genesis of political life. The purpose of this deconstruction is to indicate the source of and reasons for male domination over women, which is associated with revision and criticism of the liberal tradition. The fictitiousness of the contract (of the original source idea) leads Pateman to conclude that it is necessary to re‑evaluate other contracts and the marriage contract in particular

CAROLE PATEMAN: o patriarcado moderno fraternal
This article approaches the new formulation or a new model of patriarchy, which becomes predominant from modernity onwards and which Carole Pateman calls fraternal modern patriarchy. With the help of the analyzis developed by Pateman in The Sexual Contract (1993 [1988]), the research sought to expose, especially, how the omission of the history of the sexual contract, previous and necessary for the consolidation of the original contract theory, contributed to the legitimation of the modern fraternal patriarchy, consigning women to subordination in all spheres of civil society. The effort in this article resides, therefore, in reassembling the contractualist theory, from Pateman\u27s thought, to propose that the stories about the genesis of the new modern civil society can provide us the conceptual tools to designate the origin of modern fraternal patriarchy. We also seek to expose the importance that Pateman places on the concept of “patriarchy”, given its relevance to the author\u27s theoretical and political project. Finally, we analyze the forms of patriarchal argumentation presented by the author in order to show that there is a problem in interpreting the continuing domination of men over women in a patriarchal way.O presente artigo aborda a nova formulação ou um novo modelo de patriarcado, que passa a ser predominante a partir da modernidade e que Carole Pateman denomina de patriarcado moderno fraternal. Com o auxílio das análises desenvolvidas por Pateman em O contrato sexual (1993 [1988]), a pesquisa buscou expor, sobretudo, como a omissão da história do contrato sexual, anterior e necessário para a consolidação da teoria do contrato original, corroborou para a legitimação do patriarcado moderno fraternal, destinando a mulher à subordinação em todas as esferas da sociedade civil. O esforço neste artigo reside, portanto, em remontar a teoria contratualista, a partir do pensamento de Pateman, a fim de propor que as histórias sobre a gênese da nova sociedade civil moderna podem fornecer-nos as ferramentas conceituais para designarmos a origem do patriarcado moderno fraternal. Também buscamos expor a importância que Pateman deposita no conceito de “patriarcado”, dada a sua relevância para o projeto teórico e político da autora. Por fim, analisamos os modos de argumentação patriarcal apresentados pela autora a fim de evidenciar que há um problema em interpretar patriarcalmente a contínua dominação dos homens sobre as mulheres

W artykule przedstawiono ideę bezwarunkowego dochodu podstawowego w uję ciu Carole Pateman. Jej stanowisko zostało porównane z koncepcją dochodu podstawowego Bru- ce'a Akcermana/Anne Alstott oraz Philippe Van Parijsa. Artykuł rekonstruuje argumenty Pateman, które dowodzą przewagi jej stanowiska. Konkurencyjne koncepcje dochodu podstawowego charakteryzują się brakiem konsekwencji wywodu oraz krótkowzrocznością w odniesieniu do tematu feminizmu. Novum koncepcji Pateman polega na powią zaniu dochodu podstawowego z procesem demokratyzacji oraz emancypacją kobiet (demokratyzacja powinna dotyczyć również sfery gospodarstwa domowego). W artykule zostało również omówione zagadnienie free riders oraz kontynuacja myśli Pateman dokonana przez Michaela Goodharta.The article presents an idea of unconditional basic income as proposed by Carole Pateman. Her viewpoint has been compared to the concept of basic income of Bruce Akcerman/Anne Alstott and Philippe Van Parijs. The article reconstructs Pateman's arguments which prove the superiority of her stance. Competitive concepts (of basic income) are characterised by the lack of reasoning consistency and short-sightedness in relation to the topic of feminism. The novelty of Pateman's idea consists in establishing the connection between the basic income and the process of democratisation and emancipation of women (democratisation should also concern the sphere of a household). The article also discusses the issue of free riders and the continuation of Pateman's thoughts by Michael Goodhart

O artigo discute a contribuição de Carole Pateman para a teoria política democrática. A crítica ao instrumento liberal do contrato, presente desde suas primeiras obras, permite entender como relações de subordinação, que reduzem a possibilidade de autonomia dos agentes, transitam de maneira voluntária e consentida. Isso leva Pateman a analisar como a subordinação das mulheres organiza uma ordem política liberal que, no entanto, busca se apresentar como neutra em relação a gênero. Uma análise do enfrentamento de Pateman com seus críticos possibilita observar os limites de sua empreitada teórica, assim como a radicalidade de seu projeto democrático.This article discusses the contribution of Carole Pateman for the democratic political theory. The criticism of the liberal instrument “contract”, which is frequent since her early works, allows us to understand how relations of subordination, which reduce the possibility of autonomy for the agents, pass as voluntary and consensual. This leads Pateman to analyze how the subordination of women organizes a liberal political order that seeks to present itself as neutral in relation to gender. An analysis of Pateman’s confrontations with her critics permits us to observe the limits of her theoretical work, and also the radical nature of her democratic project.L’article aborde la contribution de Carole Pateman à la théorie politique démocratique. La critique de l’instrument libéral du contrat, présente dès ses premières œuvres, nous permet de comprendre comment les relations de subordination, qui réduisent la possibilité d’autonomie des agents, circulent de façon volontaire et consensuelle. Cela conduit Pateman à analyser la manière par laquelle la subordination des femmes organise un ordre politique libéral qui, cependant, cherche à se présenter comme neutre par rapport au genre. Une analyse de la confrontation de Pateman avec ses critiques permet d’observer les limites de son œuvre théorique, mais aussi la nature radicale de son projet démocratique
