Tecnologia e prove di c.d. nuova generazione: non sempre la modernità aiuta a semplificare il processo civile
No full textNon si deve cadere nell’errore di ritenere che le prove di nuova generazione rendano più facile provare i fatti allegati e che la loro acquisizione nel giudizio consenta di risparmiare tempo (tema, quello della durata del giudizio, sempre assai caldo). Non siamo, in altre parole, al cospetto della rivincita della prova precostituita e, segnatamente, documentale, sulle più macchinose e vetuste prove costituende tradizionali.
La volatilità del linguaggio informatico, fatto di codici che i computer, gli smartphone e i tablet leggono e traducono per noi, infatti, mal si sposa con la tradizionale idea di documento e pone tutti i numerosi interrogativi che si è cercato di sintetizzare in questo breve elaborato, rendendo sovente necessario aprire nel processo delle apposite sottofasi istruttorie – che chiameremo “incidenti” – ad esempio per verificare una prova di nuova generazione (in caso di disconoscimento di conformità) o per consentire la corretta esplicazione del diritto di difesa di tutte le parti in relazione a quel peculiare mezzo di prova.
Eppure, poiché il progresso non si arresta, anche il processo civile deve adeguarsi a questo nuovo passo. Ed è quindi probabile che non solo il processo debba modernizzarsi divenendo telematico quanto a modalità di deposito di atti e provvedimenti, ma che anche il diritto delle prove stesso debba essere ridisegnato per adattarsi a tale nuova realtà, magari recependo a livello di diritto positivo taluni dei suggerimenti operativi ed interpretativi che si è qui cercato di illustrare
