    This article discusses the applicability of open peer review to criminal investigation data. First, it means identifying the strengths and weaknesses of the dataset review and validation process. Second, there will be evidence of practices that facilitate process transparency, data diffusion, reliability and reuse. To achieve these objectives, it will be argued that it is necessary to adopt a methodology on which to base the selection criteria of the scientific community of reference, to identify the types of actors and the relative modalities of analysis, at the moment when the construction of a collaborative and participative context is the first step to delimit a community representative of the criminal process and its different research techniques

    Several sectors of today´s knowledge are marked by characters that grow, exhort, modify. It considers the reciprocal influences between Criminal Procedure Law, word quality and interpretation; academia, transmission of knowledge and technological advance. These are just a few of the intersections that permeate and determine today the whole system, whose connections and intersecting spaces are constantly changing. This editorial is based on the conviction that the subject of the Criminal Procedure can not contain in itself all that is necessary for the jurist, and also that the effects of the typical transformations of our times must not be ignored. In this context, therefore, the question asked points to the role played by the academy, the researcher and the publisher in relation to their own responsibility in the production and diffusion of scientific knowledge

    Con il presente scritto l’Autrice si interroga sulla reale natura giuridica della confisca c.d. “di prevenzione” di cui all’art. 24 del codice antimafia italiano, con la quale, come è noto, si trasferiscono allo Stato beni appartenenti a privati sulla base della probabile provenienza illecita dei beni medesimi. Più esattamente, ci si chiede: con la misura ablazionale in questione, non si è di fronte a una pena straordinaria nascosta, mirante a imporre una pena patrimoniale contro l’autore di reati non accertati nell’ambito di un procedimento penale? Oppure si tratta di una misura a carattere non sanzionatorio, che si limita a negare tutela giuridica al rapporto di disponibilità sul bene costituito dal soggetto mediante un’attività, ossia il reato, che non rientra tra i modi legittimi di acquisto della proprietà? Dalla risposta a queste semplici domande discende l’individuazione delle garanzie costituzionali e sovranazionali applicabili alla confisca antimafia, che sta sperimentando un sempre maggiore successo nella prassi legislativa e giudiziaria italiana, ma che, al contempo, desta crescenti preoccupazioni per la sua imponente carica restrittiva dei diritti fondamentali, in assenza delle tutele tipiche del procedimento penal

    Generally and increasingly, governments decide to implement policy measures aimed at promoting and rewarding excellence in scientific research. This is the purpose of national research evaluation exercises, typically based on the analysis of the quality of the best research results. However, a different approach to the analysis and the intervention is based on the measure of the productivity of each researcher, the overall impact of their scientific publications over a given period. The present editorial analyzes, firstly, the convergence of the two approaches; secondly, it questions whether and to what extent the most productive researchers always obtain the greatest number of citations; thirdly, what is the role of scientific publishing in relation to the impact factor

    Going Beyond Counting First Authors in Author Co-citation Analysis

    The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed
