    Riassunto - L’Autore ripercorre in chiave critica l’evoluzione delle politiche legislative in materia di lavoro, alla luce dell’attuale fase di crisi economico finanziaria. Nell’esaminare i principali interventi normativi attuati da inizio secolo, l’Autore mette in evidenza le scelte di metodo e gli elementi di continuità che accomunano i vari provvedimenti, individuandoli nell’affannosa ricerca del punto di equilibrio tra flessibilità e garantismo. La riflessione si chiude con alcuni interrogativi sulle ultime linee di riforma del mercato del lavoro e con l’auspicio che, anche al cospetto delle imprescindibili ragioni dell’economia, il diritto del lavoro possa continuare a svolgere il proprio tradizionale ruolo di disciplina di tutela della persona.   Abstract - The author analyzes, with a critically oriented approach, the development of the employment law, in the light of the current economic and financial crisis. In examining the main regulatory measures implemented since the beginning of the century, the author highlights the methodological choices and the elements of continuity that unite the various measures, focusing them in a hard research of a point of balance between flexibility and security. The discussion concludes with some questions about the last lines of the reform of the labor market and with the hope that, even in the face of compelling reasons of economy, labor law can continue to play its traditional role of governing the protection of person.</p

L’A. sostiene che, sebbene più rigorosa rispetto alla corrispondente disciplina europea, la normativa italiana sia compatibile con i principi, europei e nazionali, in materia di libera concorrenza e auto-determinazione della p.a.This article analyzes the detailed explanation that the public administration must give in order to create “in-house companies” according to Italian legislation addressed in Legislative Decree no. 175/2016 (Consolidated Law on Public Companies).     The article critically analyzes a recent trend of the Italian jurisprudence, according to which the public entities would not incur liability pursuant to Article 2497 of the Civil Code in the event that the companies subjected to their decisive influence exercise purely instrumental services, since they cannot be qualified as “entrepreneurial activities”. Instead, according to the thesis presented by the author, also in the light of an analysis of teleological and systematic nature, the public purposes of the body exercising the directive activity should always be considered substantially irrelevant and the only decisive elementfor deciding of the liabilityregime is tobefound in theeconomiccharacter of the activity carried out by the directed company, quite possible even in the case of so-called instrumental services

    La revoca dello stato di liquidazione: interessi in gioco e questioni ancora aperte

    L'articolo analizza in dettaglio la disciplina della revoca dello stato di liquidazione di cui all'art. 2487-terc.c. Sebbene l'introduzione di tale norma nel 2003 abbia avuto il merito di sancire in modo chiaro e definitivo la revocabilità dello stato di liquidazione delle società di capitali, molti altri aspetti restano ancora in ombra. Fra questi ultimi, assumono particolare rilievo: (i) la possibilità di revocare lo stato di liquidazione nelle società di persone; (ii) l'ambito di applicazione temporale della disciplina in esame; (iii) le interconnessioni tra il recesso dei soci dissenzienti e lo scioglimento della società; (iv) le modalità di preventiva eliminazione di talune cause di scioglimento; e (v) gli interessi sottesi alla facoltà di opposizione dei creditori. Sotto tale ultimo profilo, peraltro, l'autore ritiene preferibile adottare, in una prospettiva sistematica, un'interpretazione restrittiva circa l'individuazione dei creditori legittimati.This article provides a detailed analysis of the Italian regulation concerning the revocation of corporate liquidation pursuant to Article 2487-ter of the Italian Civil Code. Although this Article - enacted in 2003 - stated in an incontrovertible manner the revocability of voluntary liquidation of limited companies, many other related aspects still remain unclear. In particular, the following are examples: (1) the possibility of extending the same legal principle to partnerships; (2) the temporal scope of the application of this regulation; (3) the relationships between the right to withdraw exercisable by dissenting shareholders and the company liquidation; (4) the procedures for the preventive elimination of factors determining the closure of the relevant company; and, (5) the interests underlying the right of opposition for creditors. In this last regard, the author considers a restrictive interpretation about the identification of entitled creditors to be more coherent under a systematic point of view

    Expanded polystyrene (EPS) in road construction: Twenty years of Italian experiences

    Expanded polystyrene (EPS) is a thermoplastic material, derived from pre-expanded polystyrene beads, that combines an extreme lightweight with versatile strength and thermal insulation. These characteristics made EPS an excellent alternative to natural materials for the feasibility of building and construction projects that would otherwise destined, for time and implementation costs, to be postponed or alienated. Specifically, this technology has been successfully used in road infrastructure sector in the last twenty years in the construction of roads, bridge abutments, lightweight embankments and backfills, above all for the rapid restoration of compromised roads following landslide or calamitous events, representing an interesting and resilient solution in areas exposed to seismic risk or persistent vibratory actions. Thus, the authors want to offer a critical analysis of different EPS road applications in Italy, considering benefits and drawbacks, proposing technical and economic considerations for ideal conditions of use and suggesting failure analysis methods and tools. © 2020 The Author(s)

    Easylife: a Conceptual Framework for Semi-automatic Survey Management

    Easylife is a conceptual framework aimed at the semi-automatic management of spectroscopic surveys. Conceived in 2012 (Garilli et al. 2012) as a tool to manage the VIPERS spectroscopic survey (Guzzo et al. 2014) and based on a prototype version of the FASE framework (Grosböl et al. 2012), it evolved into a survey-independent generalised framework following the MVC (Model-View-Controller) paradigm. Easylife has been deeply modified to exploit PNGS (Pandora Next Generation Software) APIs (Fumana et al. 2019) and FASE stable version, and is currently used to manage the ongoing VANDELS ESO public spectroscopic survey carried out using the VIMOS@VLT spectrograph

    The paper analyzes the impact of the recent art. 8 of l. n. 148/2011 on the system of industrial relations and on the traditional order of italian labour law. After outlining the regulatory framework, the Author focuses on the most relevant questions posed by that provision of law, pointing out the critical issues concerning the legislative choice of overloading the collective bargaining with the power to derogate the discipline of the individual employment relationship. The reflection deals with the two most known problems of the trade union representativeness and the so called “erga omnes” effects of the collective bargaining. The author compares the criteria adopted by art. 8 l. n. 148/2011 with the ones contained in the interconfederal Agreement of june 28th 2011, in order to highlight the discontinuity between the two legal sources. At last, the Author identifies some aspects of unconstitutionality of the law, because of its possible contrast with art. 39 of the italian Constitution
