La Corte di giustizia dell'Unione europea alla prova dell'articolo 47 della Carta dei diritti fondamentali
La Corte di giustizia dell'Unione europea (CGUE) gioca un ruolo pivotale nell'architettura giudiziaria dell'Unione europea, vestendo alternativamente i panni di una corte costituzionale, suprema e di merito. In questo contesto, la CGUE interpreta e stabilisce lo standard di tutela giurisdizionale effettiva che le corti nazionali sono tenute a rispettare in applicazione dell'articolo 47 della Carta dei diritti fondamentali. Il presente elaborato mira a verificare se tale standard sia rispettato dalla CGUE stessa, con particolare riguardo ai casi di azione diretta, in cui ha unica ed esclusiva competenza. L'analisi deve essere distinta in due parti: la prima, di natura "strutturale"; la seconda, "procedurale". In prima battuta saranno analizzati criticamente la composizione e il procedimento di nomina della CGUE al fine di verificare se rispettino il livello di indipendenza, imparzialità e costituzione per legge richiesto dall'articolo 47 Carta e imposto dalla CGUE alle corti nazionali. In secondo luogo, partendo da una breve ricognizione della giurisdizione della CGUE e dalla ripartizione interna di competenze tra Corte di giustizia e Tribunale, l'analisi si sposterà sulle norme processuali applicate nelle azioni dirette. Guardando alle norme previste dallo Statuto della CGUE, dai regolamenti di procedura della Corte di giustizia e del Tribunale e dalla fonti processuali di terzo livello, l'Autrice metterà in evidenza le criticità che l'attuale struttura procedurale presenta alla luce dell'articolo 47 Carta, suggerendo come il diritto ad una tutela giurisdizionale effettiva dovrebbe divenire il nuovo parametro da utilizzare per aumentare la rispondenza del diritto processuale dell'Unione europea con la stessa giurisprudenza di Kirchberg.The Court of Justice of the European Union (CJEU) plays a peculiar role in the judicial architecture of the EU, acting as a constitutional, supreme and also merit court. In this context, the CJEU interprets and sets the standard of effective judicial protection that national courts are required to adhere to pursuant to Article 47 of the Charter of Fundamental Rights (CFR). This contribution aims at assessing whether such standard is indeed respected by the CJEU itself, in particular when called to decide in direct actions, which are of its sole and exclusive competence. The analysis shall be distinguished in two parts: the first one, “structural” in nature; the second one, “procedural”. Firstly, the composition and appointment procedure to the CJEU will be critically analyzed in order to ascertain whether it complies with the level of independence, impartiality and establishment by law (Article 47 CFR) the CJEU itself imposes to national courts. Secondly, starting with a brief excursus on the jurisdiction of the CJEU and the internal repartition of competence between the Court of Justice and the General Court, the analysis will shift to procedural rules applied in direct actions. Looking at the provisions provided for in the Statute of the CJEU, the rules of procedure of both the Court of Justice and the General Court and the third-level procedural sources, the Author will highlights the drawbacks and criticalities that the current procedural scheme presents in light of Article 47 CFR, suggesting that the right to effective judicial protection should become the new parameter for increasing compliance of EU procedural law with Kirchberg’s own case-law
Going Beyond Counting First Authors in Author Co-citation Analysis
The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation
counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed

L’analisi del fenomeno dell’impact investing è stata condotta ponendo grande attenzione al problema definitorio e terminologico, analizzando le differenti teorie predominanti e le caratteristiche che definiscono questa strategia di investimento, oltre al suo collocamento rispetto al più ampio mercato della finanza sostenibile.
L’obiettivo dell’analisi è non solo l’individuazione degli attori che caratterizzano questo mercato, delle caratteristiche del fenomeno, dei settori e delle aree di impatto principali e degli strumenti finanziari che consentono l’incontro tra la domanda e l’offerta, ma anche la mappatura delle principali reti nazionali ed internazionali che effettuano ricerche sul tema in modo tale da individuare le principali barriere all’incontro tra la domanda e l’offerta e le lacune della letteratura di riferimento
Variations on the Author
“Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship

The volume collects ten essays, followed by thirty Best Practices sheets, which collectively provide an outline of the interconnections between Public History and schools. Through discussing and hypotheses of teaching and educational paths the essays collected here reflect on the implicit educational value of Public History. The book also opens towards systematic integration with the territory, its publics, and identity traditions, through its interactions with Public History, schools and the university, in relation to other educational institutions and in various local contexts, in particular, school museums. Appropriate Similarity Measures for Author Cocitation Analysis
We provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature. Dispelling the Myths Behind First-author Citation Counts
We conducted a full-scale evaluative citation analysis study of scholars in the XML research field to explore just how different from each other author rankings resulting from different citation counting methods actually are, and to demonstrate the capability of emerging data and tools on the Web in supporting more realistic citation counting methods. Our results contest some common arguments for the continued
use of first-author citation counts in the evaluation of scholars, such as high correlations between author rankings by first-author citation counts and other citation
counting methods, and high costs of using more realistic citation counting methods that are not well-supported by the ISI databases.
