Attachment in California: Senate Bill 1048, The Interim Response to Randone

    No full text
In 1971, California\u27s long-standing prejudgment attachment procedures were held unconstitutional. The basis of this decision was that these remedies denied the debtor procedural due process by failing to provide him with notice of the attachment or an opportunity to contest it. The California Supreme Court also made it clear that the fact that attachment remedies reached necessities of life-without a hearing on the validity of the creditors claim was an additional ground for holding it unconstitutional. The Legislature responded to the court\u27s criticisms by enacting a revised attachment procedure. This comment analyzes the court\u27s opinion and tests the constitutionality of the new legislation. The author concludes that these procedures may suffer certain constitutional infirmities

The suspension characteristics of agricultural tractor tyres

    No full text
A method used to measure the radial suspension properties of agricultural tractor tyres is described. The stiffness and damping of a range of tyres have been measured. The effects on tyre stiffness and damping coefficient of rolling speed, inflation pressure, load, amplitude, frequency of vibration, driving torque, surface type, tyre size, ply rating, construction, wear and age are reported. A relationship is developed which enables the stiffness of a rolling tyre to be estimated from the tyre size, age and inflation pressure. It is shown that this is a more accurate estimate of rolling tyre stiffness than measurement of the stiffness of a stationary tyre. The measured tyre characteristics are used to predict the vibration of a single degree of freedom system and of a four wheel tractor. Significant improvements in accuracy are found when the results are compared with those obtained using stationary tyre characteristics. The frequencies of the natural pitch and vertical modes of vibration are usually predicted to within ± 10%. Predictions of rms acceleration levels are less accurate. Further improvements in modelling accuracy should be achieved by more accurate measurement and modelling of the suspension characteristics of the drive wheels in the longitudinal direction

Master of ScienceFood Science InstituteElizabeth A. E. BoyleAntioxidants are used to limit oxidation in many food products; however, there is limited published research evaluating the incorporation of antioxidants in ground pork trim. The objective of this research was to assess lipid oxidation in ground pork fat trim containing no antioxidants, nitrite at 70 ppm, citric acid-based vinegar buffered to 6.0 to 7.0 pH at 0.35% of the total formula, rosemary extract at 0.3% of the total formula, and rosemary green tea (RGT) extract at 0.28% of the total formula during 12 m of frozen storage at -17°C. The treatments (nine replications) were packaged in plastic, heat-sealed bags that were cased in a corrugate box with a weight of 22.68 kg. Treatments, quick frozen at a wind chill of -42°C, reached an equilibrated temperature of -28°C within 26 h and were stored in a commercial freezer at -17°C. Fatty acid profiles and proximate analyses were analyzed for each treatment at the beginning of the study. The control and vinegar treatments at 61.65 and 61.15% fat, respectively, had higher (P < 0.01) percent fat than the nitrite, RGT, and rosemary treatments and was higher than the 58 ± 2% target. This, however, was attributed to a small sample size from a larger batch that was evaluated in real time on the production line to be within 2% of 58%. There were slight differences (P < 0.05) in fatty acid profiles and proximate analyses among the treatments, and these differences were potentially due to sample collection in a commercial pork processing facility where hogs were sourced from multiple production facilities. The aerobic plate count and pH of the samples were measured each month for 12 m. The aerobic plate counts ranged from 2.47 to 2.98 log₁₀ CFU/g throughout 12 m storage at -17°C and 2.69 to 2.80 log₁₀ CFU/g among the individual treatments. Pork trim pH varied from 5.79 to 6.23 during 12 m of storage. The nitrite treatment had a higher (P < 0.05) pH than the pork trim containing rosemary. Lipid oxidation was measured monthly using thiobarbituric acid reactive substances (TBA), gas chromatography, and a trained sensory panel. The malonaldehyde (MDA) of RGT and rosemary treatments remained below 0.2 mg MDA/kg during frozen storage. The control, vinegar, and nitrite treatments, however, increased resulting in higher (P < 0.05) MDA at 8 through 12 m than rosemary and RGT. Vinegar exceeded 1.0 mg MDA/kg at 12 m, where a consumer is likely to taste oxidation in a pork product. Hexanal, measured by gas chromatography, was similar (P < 0.05) for the control, rosemary, and RGT treatments during storage and stayed at or below 0.1 mg hexanal/kg throughout the 12 m of frozen storage. None of the treatments, however, exceeded 1.0 mg hexanal/kg, or reached levels of hexanal that would impact sensory. The trained sensory panel ranked rancid aroma, cardboard aroma, rancid flavor, and cardboard flavor on a 100-point scale where 0 was none and 100 was intense aroma or flavor. All treatments for all four measurements were below 7 on the 100-point scale at each month through 10 m. At 11 m, the vinegar treatment was removed from further evaluation due to due to off aroma and flavors such as meat or sour, though not defined as oxidation. The largest sensory differences among the treatments occurred at 12 m of storage where rosemary and RGT were lower (P < 0.05) than control for rancid and cardboard aroma and flavor. None of the treatments exceeded 30 on the sensory scale. The color was measured instrumentally and by the trained sensory panel using the National Pork Board 6-point scale. The reaction of nitrite with myoglobin impacted the color of the trim based on lower (P < 0.05) a* and b*; however, this color change is expected in a cured product. All the color differences were less than 3 on the color scale, and most were below two. Since most of those differences only a trained panelist will notice, the instrumental color changes do not eliminate any of the treatments. As a result, Rosemary and RGT treatments were effective at slowing oxidation of frozen pork trim during 12 m of storage and may be used to create a flexible supply chain. to maintain pork quality during frozen storage

    The Art of Extraction

abstract: The Art of Extraction: ABSTRACT Anthropocentric society faces a multiplicity of environmental challenges, catalyzed and perpetuated by urban-industrial culture. Many of today’s perspectives and sustainable strategies cannot accommodate the challenges’ inherent complexity. Because urban-industrial society is only projected to grow, both in enormity and influence, the only viable option is to elucidate the complexity and employ it. A potential setting in which to frame this exploration is the intersection of urbanism, landscape, and ecology –an overlap first introduced by the theories of Landscape Urbanism and Ecological Urbanism. Here, urbanization is not just discussed as an isolated phenomenon but one that is embedded within and responding to a variety of systems and scales. The methodologies of Landscape Urbanism and Ecological Urbanism also acknowledge artists and the visual arts as invaluable tools for realizing, communicating, and inspiring the new perspectives and modes of intervention needed to address the aforementioned urban complexity. Such artists who operate within this realm include Sissel Tolaas, Maya Lin, Katrin Sigurdardottir, David Maisel, Olafur Eliason, Mierle Ukeles, Suzanne Lacy, Steve Rowell, Mel Chin, and the Center for Land Use Interpretation. Case study analyses reveal many of these artists begin their investigations with provocative, searching questions situated within the realms of urbanism, landscape, and ecology. This is proceeded by relative scientific research and/or community involvement or outreach. Furthermore, the artists work within and extrapolate from a variety of other disciplines —increasing the scope and applicability of their work. The information they collect via this multidisciplinary approach is then metaphorically translated to the visual arts, where the public can not only physically or sensorially experience it, but understand and deduce its meaning and significance: public awareness being one of the more essential aspects of a sustainable society and at the root of our current struggle. As a designer and architect, I will engage the artist’s mindset to explore the current and complex issue of resource extraction within Superior, Arizona: a topic at the core of urbanism, landscape, and ecology. While the town is not considered "urban" by standard definition, it and its surrounding landscapes are indirectly sculpted by the needs of urban society —rendering it the setting for this application. Within a group, we will begin with a searching question. We will conduct relative scientific research, engage the community of Superior, and call upon a variety of other disciplines to aid and inform our work. Through metaphor, the research and resulting discoveries will be artistically represented and composed within a designed exhibition of hopeful “things” (See Bruno Latour, “From Realpolitik to Dingpolitik”). This exhibition will theoretically take place on Superior’s currently dilapidated Main Street, amid a more accessible sphere. The eventual goal of the project is to illuminate and understand the complexities of resource extraction, specifically within Superior, while also enabling public awareness and empowerment through lucidity and comprehension

Australian Farmers' Attitudes Toward Succession and Inheritance

    No full text
Unlike other businesses, family farming is characterised by an intimate connection between the farm as a place of work, career and family tradition. What impacts upon one aspect, will impact upon all. An earlier study by the lead author (Kaine, Barclay and Stayner 1997) noted the difficulty and complexity of succession planning for Australian farmers as they sought to meet three conflicting objectives: to maintain a viable farm business for the next generation, treat all of their children fairly and provide for their own retirement. For some farmers, farming is a 'way of life' and they experience great difficulty in handing responsibility over entirely to their children. ... As the vast proportion of Australian agricultural businesses are family owned and operated, how these families plan and manage retirement, succession and inheritance is therefore a concern for the whole agricultural industry. Effective advance planning in these areas can provide a sense of confidence and security and thus help preserve harmony within the family. However, if not properly handled, the transfer of the farm between generations can lead to confusion, uncertainty, suspicion and can result in deeply damaging divisions between family members. These decisions have been made even more difficult by prolonged and severe drought and economic forces, which have left many of Australia's farm families unable to sustain operating budgets
