La Corte di Cassazione reputa tale modalità investigativa compatibile con il divieto di lesione della libertà di autodeterminazione nell'assunzione della prova, sancito all'art. 188 c.p.p. in tema di libertà morale. L'autore propone alcune osservazioni.With the ruling number 31604/20, the Fifth Section on the Supreme Court addresses the issue of the suspect unconsciously self-installing the Trojan virus software. The Italian Court of Cassation ruled that said operation does not violate the prohibition of the use of coercion in the obtaining of an evidence, stated in art. 188 c.p.p, regarding moral freedom.     Understanding TOMA and its Practical Application to State and Local Government

    The focus is on understanding the implications of the Texas Open Meetings Act (TOMA) on state and local government. The fundamental tenet underlying TOMA is that all regular, special, or called meetings of a governmental body must be open to the public. TOMA accomplishes this by providing rules and procedures for state and local government meetings, notices and records.     Toma Niger Mrčić poznat je našoj kulturnoj javnosti kao diplomat i humanist, skradinski pa trogirski biskup, s kraja 15. i prvih desetljeća 16. st., jer su o njemu fragmentarno pisali neki naši istraživači. No, kako ne spada u naše poznatije humaniste, nemamo njegove cjelovitije biografije. S njim bi se trebalo malo više pozabaviti da bi se vrednovalo njegovo rodoljublje i diplomatska djelatnost u smislu organiziranog otpora osmanlijskom prodoru u naše krajeve i u Europu. Potrebno je malo bolje osvijetliti njegov lik zbog uspomena koje ga vežu uz franjevački samostan na Poljudu u Splitu, gdje je htio da počivaju njegovi smrtni ostaci i gdje je ostavio svoj "portret nad portretima" slavnog autora Lorenza Lotta. Pokušat ću staviti u jednu cjelinu podatke koje su o njemu iznijeli pojedini publicisti kao i njegovu povezanost s poljudskim samostanom.As a diplomat and humanist, as the bishop of Skradin then of Trogir from the end of the XVth through the first decades of the XVIth century, Toma Niger Mrčić is known to Croatian cultural circles because Croatian scholars have fragmentarily written about his life. However, because he is not deemd to be amongst our foremost humanist writers, there is no extensive biography of him in Croatian. It would be worthwhile to devote attention to him in order to valorise his love for the motherland and his diplomtic activitties which can be sees as organised resistance against the Ottoman invasion into Croatia and Europe. It is necessary to shed additional light on his life because of the memories which connect him to the Franciscan monastery in the region of Poljud in the city of Split where he wanted his body to be buried and where he lefts “portrait above all portraits” of the famous author Lorenzo Lotto. What I will attempt to do in the article is to assemble into a whole the facts that have been published by different journalist and to describe his ties to the Poljud monastery

    This work presents some of the characteristics of the studies about the decision making process in Psychology, focusing on individual decisions in a risky environment (with known probabilities). First, some historical considerations on the decision making origine are discussed and then the author focuses on the subject referring to Cognitive and Mathematical Psychology. The next point speaks briefly about the main topics related to decision making (task, the decision maker and the answer), and discusses different ways of conceiving the general aspects of the models -descriptive versus normative- and comments on the contributions of the Theory of the Expected Utility (Von Numann and Morgenstern, 1944). Stemming from the progressive psychologization of the behavioural theories about decision making with risk, the approach of Kahneman and Tversky (1979) is schematically presented, and finishes by offering an integrative view on decision making studies.En este trabajo se presentan algunas de las características de los estudios de toma de decisiones en psicología, centrándose en las decisiones individuales en ambiente de riesgo (con probabilidades conocidas). En primer lugar aparecen algunas consideraciones históricas respecto del origen de la toma de decisiones y a continuación se centra el tema con referencia a la psicología matemática y a la cognitiva. En el punto siguiente se tratan brevemente algunos de los tópicos de mayor relevancia en toma de decisiones (la tarea, el decisor y la respuesta) y posteriormente se discuten las distintas formas de concebir los modelos en su aspecto más general -descriptivos versus normativos- y se comentan las aportaciones de la teoría de la utilidad esperada (Von Neumann y Morgenstern, 1944). Como resultado de la progresiva psicologización de las teorías comportamentales de la toma de decisiones con riesgo se presenta a grandes rasgos la aproximación de Kahneman y Tversky (1979), concluyendo con un intento de panorama integrador de los estudios de toma de decisiones

    The purpose of this qualitative study was to examine the factors that may affect teacher and parent perception of the academic achievement of eighth grade African American male students. The independent variables were socioeconomic status, family structure, perceived self-esteem, peer affiliations, extracurricular activities, and student behavior. The dependent variable was student achievement. The qualitative case study method was specifically selected for this study to examine the similarities and differences of two groups of African-American male students. The researcher collected data and offered strategies and recommendations for school and district-level leadership to identify and better support African-American male students. The study took place at an all-male charter school for boys in grades 6 through 11. This urban charter school is located in the southeastern region of the United States in a major metropolitan area. There were 20 participants involved in this study. While studying the participants, the researcher interviewed parents and teachers, conducted observations, and analyzed students' report cards. The data collected were triangulated through interviews, observations, and document analysis. The limitations of this study included the number of people involved in the study, school setting, and age constraints of the students studied. The findings of this study revealed that socioeconomic status, the level of parental engagement, peer affiliations, and student behavior had an impact on student academic achievement. The highlight of this study showed the influence parental involvement had on student achievement. Parents who were heavily involved and engaged in their son's education performed well in school. Conversely, students whose parents were not involved and/or showed very little interest in their son's education experienced some challenges in their academics and had low academic achievement. Recommendations for educational leaders and suggestions for further research are included in the study
