Ghayat al-amani and the life and times of al-Hadi Yahya b. al-Husayn: an introduction, newly edited text and translation with detailed annotation
The thesis is anchored upon a text extracted from an important 11th / 17th century Yemeni historical work. This text deals primarily with al-Hādī ilā 'I-Haqq, the founder of the Zaydī Imamate in the Yemen that lasted well over a thousand years. AI-Hādīs imamate, of considerable significance in itself, also coincides with one of the most turbulent periods of early Yemeni mediaeval history. The- edited Arabic text, with its accompanying apparatus criticus. Is to be found at the opposite end of this volume. The Introduction considers various aspects of Imam al-Hadī’s life, religious ideas and aspirations and matters directly connected with the edited text and the work of which it forms a part. Among the most important subjects discussed are the MSS used in the production of the edited text, the problem concerning the authorship of Ghāyat al-amānī and the relationship of the latter work to Anbā' al-zaman. A short biography of al-Hādī is provided, together with a treatment of the historical background to ai-Hādīs imamate. The introduction also describes the editorial method followed with regard to the text, and certain key personal names and toponyms are dealt with there. The method employed by the author of the Ghāyat is to record the events of any one year by Itself. I have translated one year at a time and then followed it by the annotations appertaining to it. It is hoped that by means of these annotations. (some of which through necessity are quite detailed ), the text will be better understood. The numerous personages, tribal names and toponyms are considered, as well as problems concerning points of chronology and various matters of historical and religious significance. Specific comment is made upon certain interesting terms or any unusual or striking vocabulary. The thesis concludes with maps, genealogical tables and a comprehensive bibliography
Beberapa Isu Haraki di dalam Karya-karya Hadis Sayyid Muhammad Nuh
Sayyid Muhammad Nuh is a prominent ‘haraki’ figure and has produced a number of works in the field of hadith studies. He has been involved in the dakwa movement of the Muslim Brotherhood which influenced his approach in the production of his works, in terms of the ‘haraki manhaj’ and methods. Almost all the works of Sayyid Muhammad Nuh emphasized issues of dakwa and tarbiyah, whether in the field of tafsir, hadith, history and issues of the Muslims’ society. Moreover, the issues that he highlighted were practical and the application of ‘haraki’ approach in production of writings brought about significant lesson to the dakwa movement, including the ones in the field of hadith. The author presents three of his works in the field of hadith which have been among the most referred and widely read in the dakwa circle, including the dakwa movement in Malaysia. His selected works in the field of hadith are ‘Tawjihat of the Prophet `ala al-Tariq’ (Hadiths of Guidance on the Dakwa Path), ‘Manhaj al -Rasul fi Ghars Ruh al-Jihad fi Nufus Ashabih’ (The Messenger’s Approach in Inspiring Spirit of al-Jihad in the Companions), and ‘Min Akhlaq al-Nasr fi Jiyl al-Sahabah’ (Winning Attitudes in the Generation of the Companions). Through this article, the authors highlights a number of ‘haraki’ issues based on the works of Sayyid Muhammad Nuh and the important lessons that he has highlighted for the people of dakwa in facing the dakwa path, based on the hadith of the Messenger
Sistem Pengajaran Alquran Menurut Imam Abu Zakariya Yahya Bin Syarf Annawawi Dalam Kitab Attibyan Fi Adab Ḥamalat Alquran
The description given by Imam Abu Zakariya Yahya bin Syarf Annawawi in the book Attibyan Fi Adab Ḥamalat Al-Qur'an is in the form of what an ideal Al-Qur'an educational institution should be, what are the criteria for teachers in teaching the Al-Qur'an, what are the manners of Al-Qur'an students. Then the author tries to find out whether there is still any relevance between the description of the relevance system for teaching the Al-Qur'an according to Imam Abu Zakariya Yahya bin Syarf Annawawi and the current system for teaching the Al-Qur'an. The type of research is qualitative research with a library research approach because the research requires books, and in this case the book or book Attibyan Fi Adab Ḥamalat Al-Quran by Abu Zakariya Yahya bin Syarf Annawawi is the primary data. Apart from that, this research also uses a character study approach, because in this research we also look for writings and opinions, either in Imam Nawawi's books or from people who quote his opinions. The author's findings in this research are that Al-Qur'an educational institutions must have correct goals and management, then Al-Qur'an teachers must have expertise and morals as Al-Qur'an teachers, then Al-Qur'an students must has the etiquette as a student of the Qur'an, and after reviewing it again, there is relevance between the thoughts of Imam Abu Zakariya Yahya bin Syarf Annawawi in the book Attibyan Fi Adab Ḥamalat of the Qur'an and the system of teaching the Qur'an in Indonesia.
Abstrak
Gambaran yang diberikan Imam Abu Zakariya Yahya bin Syarf Annawawi dalam kitab Attibyan Fi Adab Ḥamalat Al-Qur’an ini berupa bagaimana idealnya lembaga pendidikan Alquran itu, bagaimana kriteria guru dalam pengajaran Alquran, bagaimana adab pelajar Alquran tersebut. Kemudian penulis mencoba mencari tau apakah masih ada relevansi antara gambaran sistem relevansi pengajaran Alquran menurut Imam Abu Zakariya Yahya bin Syarf Annawawi dengan sistem pengajaran Alquran yang sekarang. Metodologi penelitian yang digunakan ialah kualitatif dengan pendekatan studi kepustakaan (Library Research) karena dalam penelitiannya diperlukan buku-buku, dan dalam hal ini buku atau kitab Attibyan Fi Adab Ḥamalat Al-Qur’an karya Abu Zakariya Yahya bin Syarf Annawawi adalah sebagai data primernya. Selain itu penelitian ini juga memakan pendekatan studi tokoh, karena dalam penelitian ini juga di cari tulisan, ucapan pendapat, baik di dalam kitab-kitab Imam Nawawi atau dari orang-orang yang mengutip pendapat beliau. Ibadism in Oman and developments in the field of Christian – Muslim relationships
The purpose of this study is to explore the relationship between Christians and the IbadT of Oman, as a contribution to Christian-Muslim dialogue. The main focus is an assessment of the contribution offered in the past by the small missionary presence, and of the potential scope and areas of dialogue between the recent guest-worker Christian community, and their hosts - a Muslim country growing in international status. The thesis tells the story of a dynamic engagement in dialogue. The history, customs and beliefs of the country will be outlined, with particular emphasis on meeting points with Christian missionaries. The History of the Imams and Seyyids of Oman by SalTl bin Razlk, translated by CP. Badger and published in 1871, is the source of several more recent works consulted. The Journal of the Arabian Mission of the Reformed Church of America, Neglected Arabia/ Arabia Calling: 1892-1962 and the quarterly The Muslim World (from 1911) have been among other main sources. Some of the many books and articles by Samuel Zwemer have been read; he visited Muscat in Oman on several occasions - his brother Peter contracting a fatal illness while serving there. The IbadT believe their understanding of Islam to be close to that of the Prophet Muhammad; individual in faith, they fiercely claim to be orthodox in their interpretation of the Our'an and they are quick to speak out when they think Its essential tenets are being compromised. They can therefore perhaps afford to be relaxed when it comes to living alongside those who are not themselves IbadT and are willing to listen to them with an open mind. Their courteous meeting with the Christians they welcome to their country offers clues in the wider field of Christian-Muslim relations
The role of the accused in English and Islamic criminal justice
This thesis is a comparative study of the role of the accused in the systems of
English and Islamic criminal justice. It seeks to explore the underlying
relationship between the individual and the state through an historical, structural
and contextual analysis of their rules relating to questioning and of confessions.
The analysis of the English system covers the period 1800 to 1984, with
particular reference to developments during the nineteenth century when the
foundations for the modern English state were established. The analysis of the
Islamic system combines traditionally Islamic and modern methods, assessing the
"Islamisation" movement in Malaysia through a religico-structural understanding
of juristic opinion from the four main schools of Sunnite jurisprudence.
The thesis contributes to existing knowledge on a number of levels: first, it
questions and revises the "myth" of "progress" that has dominated observations
of the history of the English criminal justice system; second, it elucidates the
relationship between Islamic law in theory and the law that is applied and
proposed in its name in Muslim states; third, it provides an analytical framework
for drawing comparisons between the underlying values of the systems of English
and Islamic criminal justice.
While acknowledging fundamental differences in terms of outlook and
articulation, the author concludes there are important similarities expressed
through such notions as "suspect" in the English system and "kafir"I"fasiq" in the
Islamic. These act as intermediate constitutional categories to whom the state
owe less protection. But the author notes also that these similarities are not
observed necessarily in the "law" which is implemented or proposed in Muslim
states; exact correspondence depends upon the over-arching political structure
and the institution of Caliphate.
The thesis is divided into six chapters: chapter one sets out the conventional view
of the historical development of English criminal procedure and evidence;
chapter two subjects that to a critique and chapter three offers a revised thesis.
Chapter four, explores methods for interpreting and explaining Islam; chapter
five sets out rules relating to confessions and questioning according to the four
Sunni schools; chapter six puts them into "context" through an examination of
the "Islamisation" process in Malaysia

PhDThis study is undertaken on the premise that Islam and Islamic law is to be taken into
serious consideration in any future legislative reform of laws in Malaysia. Islam being
the religion of the country and the strong religious sentiment of the Muslims (who
form the majority in Malaysia) cannot be overlooked or dismissed lightly by the
legislators in Malaysia. Reformation of intellectual property laws is timely, as we are
now approaching to the dateline set by GATF-Trips agreement which aim is to
improve our standard of intellectual property protection. This study seeks to analyze
and evaluate the current legislation pertaining to intellectual property in Malaysia in
terms of the philosophy and rules governing the existence, ownership and exercise of
these rights and their consistency and inconsistency with Islam and Islamic law. The
main objective of this study is to prove that a coherent and logical conceptual
framework of ownership of intellectual property can be derived from an Islamic
perspective which not only offers the basis of rights but also defines the scope of
these rights. From the point of ownership of rights, support can be obtained from the
normative framework of property rights within the traditional classification of 'mal'
(property) and 'haqq al-milkiyyah' (ownership rights) under Islamic law. From the
point of exercise of rights, the exact scope can be defined from the analysis of
fundamental concepts which have been developed by Muslim jurists. It has been
established that Islam and Islamic law offers a sound and systematic paradigm, which
in deeper analysis, can satisfy both our current obligations under international

PENERAPAN METODE TILAWATI DAN MEDIA KARTU HIJAIYAH UNTUK MENINGKATKAN KEMAMPUAN MEMAHAMI SANTRI PADA HURUF HIJAIYAH DI TAMAN PENDIDIKAN QUR’AN AL- FATTAH NANGGUNGAN DIWEK JOMBANG
Pembelajaran di TPQ (Taman Pendidikan Qur’an) Al-Fattah Nanggungan Diwek Jombang, guru masih menggunakan metode yang monoton sehingga proses pembelajaran menjadi membosankan serta tidak adanya media yang mendukung proses pembelajaran yang mampu memudahkan santri menerima materi , penelitian dilaksanakan karena pemahaman siswa terhadap huruf hijaiyah rendah. Tujuan penelitian untuk meningkatkan pemahaman santri pada huruf hijaiyah di TPQ Al-Fattag Nanggungan Diwek Jombang. Subyek penelitian ini adalah santri jilid sebanyak 22 siswa. Penelitian ini menggunakan analisis data flow model dan data yang dikumpulkan berasal dari observasi, wawancara, dokumentasi, dan tes. Pada tahap pra tindakan, hanya 6 santri yang mampu dengan prosentase ketuntasan sebanyak 27,27% dan rata-rata sebanyak 65. Hasil pada siklus 1 terdiri dari 15 santri hasil belajar mengalami peningkatan dengan prosentase ketuntantasan sebanyak 68,18% dan 78,18 rata-rata klasikal. Sedangkan pada siklus 2 terdiri dari 20 santri dengan hasil belajar mencapai 90,9% ketuntasan dengan rata-rata sebanyak 86,22. Dapat disimpulkan bahwa dengan menggunakan metode tilawati dan media kartu hijaiyah dapat meningkatkan kemampuan memahami santri pada huruf hijaiyah di TPQ Al-Fattah Nanggungan Diwek Jombang
نزهة المشتاق شرح لمع الشيخ أبي إسحاق على المنهج التوثيق والنقدي من أول الكتاب إلى مباحث الحقيقة والمجاز

خلفية البحث : لقد كان لعلماء البلد الحرام عنايةٌ خاصَّةٌ بكتاب «اللمع» للإمام الشيخ أبي إسحاق إبراهيم بن علي الشيرازي (ت ٤٧٦هـ) ، وإقبال خاصٌّ على تدريسه ، وقد شرحه الشيخ محمد يحيى أمان الحنفي المكي (ت ١٣٨٢هـ) في كتابه «نزهة المشتاق»، وأهمية الكتاب ترجع إلى أهمية العلم المبحوث فيه وهو علم أصول الفقه، وإلى المتن المشروح فيه وهو كتاب «اللُّمَع» ، وإلى مكانة الشارح الشيخ محمد يحيى أمان العلمية ، وإلى أن المتن المذكور يقرر مسائل أصول الفقه على طريقة الجمهور بينما شارح المتن من علماء الحنفية ، وقد طبع الكتاب في حياة المؤلف مع اشتماله على كثير من الأخطاء النصية والسقطات المطبعية، لأجل ذلك حاول الباحث أن يتحصل على نسخته الخطية حتى تحصل على معلومات بأنها ضاعت بعد طباعته، ومع ذلك فقد تحصَّل بعد ذلك على نسخة من المطبوعة وعليها تصحيحات المؤلف نفسه، مما يساعد كثيرًا على تصحيح ودراسة هذا الكتاب خلال هذا البحث .
الهدف من البحث : إخراج جزء من الكتابِ المذكورِ محقَّقًا مُصحَّحًا منقَّحًا على الوجه الذي يغلب على الظن أن المؤلِّف الشيخ محمد يحيى أمان أراده وارتضاه ، مع دراسة عن كتاب اللمع ومؤلفه ، وكتاب نزهة المشتاق ومؤلفه ومنهجه وما فيه من مميزات ومآخذ .
منهج البحث : اتخذ الباحث المنهج النقدي والتوثيقي في تحقيق الكتاب المذكور ، وقدَّم على ذلك مقدمة تشتمل على دراسة حول متن «اللمع» ومصنِّفه الشيخ الشيرازي ، ودراسة حول كتاب «نزهة المشتاق» ، وقام بترجمة المؤلف الشيخ محمد يحيى أمان مع دراسة الأحوال السياسية والعلمية والحركة الأصولية من تدريس وتأليف في القرن الرابع عشر الهجري الذي عاش فيه المؤلف ، كما قام بمقارنة كتاب «نزهة المشتاق» بكتاب «بغية المشتاق» للشيخ محمد ياسين الفاداني ، وبيَّن أهمَّ الفروقات التي يختص كلُّ كتاب به دون الآخر، ثم حقَّق الباحث نصَّ كتاب «نزهة المشتاق» من أوَّله إلى آخر مباحث الحقيقة والمجاز ، وعزا المسائل الأصولية وغيرها إلى المصادر التي يظَنُّ أن الشارح رجع إليها ، مع تحقيق الأقوال ، وترجمة الأعلام الواردة في النصّ ، وتخريج الآيات القرآنية والأحاديث النبوية والشواهد الشعرية .
النتائج والتوصيات: توصَّل الباحث إلى أن الكتاب مطبوع في حياة المؤلف وقد فقدت نسخته الخطية وأن هذا غير مانع من تحقيقه ودراسته ، بل تُعَدُّ من الأصول الثانوية التي ينبغي الرجوع إليها في التحقيق ، وأن ما بقي من الكتاب حقيق بأن يوضع في أولوية الاهتمام بالدراسة والبحث في نصوصه على النهج والأسلوب المقرَّر في علم تحقيق النصوص ونشرها .
ENGLISH:
Background: The book The Refulgence of the Principles of Islamic Jurisprudence (Al-Luma’) had been given a special care by the scholars of Makkah who also had a special interest in teaching it. Sheikh Muhammad Yahya Aman Al-Hanafi Al-Makki (died in 1382AH) had explained Al-Luma’ in his book Nuzhat Al-Mushtaq. The importance of his book is attributed to the importance of the science it discussed which is principles of Islamic jurisprudence (Usul Al-fiqih), to the text discussed in it which is from Sheikh Abu Ishaq Ibrahim ibn Ali Al-Shirazi Al-Shafi’i’s Al-Luma’, to the scientific status of Sheikh Muhammad Yahya Aman, as well as to the fact that the text aforementioned approves the issues of the principles of jurisprudence in the manner of the majority of scholars, while the text had been explained by a Hanafi scholar. The book was printed when the author is still alive, but it contained many mistakes and typographical errors. For that reason, the researcher have tried to look for a written copy for the book but he found out that the copy was lost after printing it. Fortunately, the researcher have obtained a printed copy containing the author’s corrections on those errors which helped a lot in correcting and studying this book through this research.
Research aim: The aim of the research is to produce a part of the aforementioned book, Nuzhat Al-Mushtaq, edited, corrected and revised in a way that the author Sheikh Muhammad Yahya Aman would most likely accept it, with a study of Al-Luma and its author and Nuzhat Al-Mushtaq and its author in addition to an explanation of the author’s approach in his book and stating its characteristics and drawbacks.
Methodology: The researcher have used the critical and the documentary approach to review the book aforementioned. He presented an introduction contained a study about Al-Luma’ and its author Al-Shaikh Al-Sherazi in addition to a study about the book Nuzhat Al-Mushtaq. He also wrote a biography of the author Al-Shaikh Mohammed Yahya Aman, with a study about the political and the scientific conditions and the fundamentalist movement back then during the author’s life in the 14th century AH. Moreover, The researcher has compared Nuzhat Al-Mushtaq with Al-Shaikh Mohammed Yassin Al-Fadani’s Bughiyat Al-Mushtaq and explained what distinguished each book from the other. The researcher also, investigated Nuzhat Al-Mushtaq’s text from the beginning to the end of the investigation of the truth and metaphor, and attributed the fundamentalist issues and others to the references which believed the author have used back then. In addition he reviewed the quotes and wrote biographies of each scholars who had been mentioned within the book, and provided authentications and verifications of Qur’an verses, Hadith and poetries that have been mentioned in the book.
Research recommendation: The researcher concluded that even though the book Nuzhat Al-Mushtaq was printed during the lifetime of the author and its written copy was lost, it does not preclude it from being revised and studied. Rather, the book is considered to be one of the secondary assets that should be referred to; and what is left from the book should be put into priority for studying and and researching on the approach and method established by the science of textual criticism and publication.

Latar belakang: Para ulama di Kota Suci Mekkah memiliki perhatian khusus pada kitab Alluma' karya Al-Imam Asy-Syaikh Abu Ishaq Ibrahim Bin Ali Asy-syirazi (wafat 476 H.) dalam mengajarkannya. Juga As-Syaikh Muhammad Yahya Aman Al-Hanafi Al-Makki (wafat 1382 H.) telah menjelaskan kitab tersebut dalam karangannya Nuzhatul Musytaq. Orgensi suatu kitab kembali pada orgensi bidang ilmu yg dibahas di dalamnya yaitu Ilmu Ushul Fikih, pada matan yg dijelaskan yaitu Alluma’, juga pada kedudukan pengetahuan yang menjelaskan kitab tersebut yaitu As-Syaikh Muhammad Yahya Aman dan pada objek pembahasan dalam matan tersebut yaitu Ilmu Ushul Fikih menurut metodologi Aljumhur padahal yang menjelaskan matan tersebut bermadzhab Hanafi. Kemudian Kitab Nuzhatul Musytaq telah diterbitkan semasa hidup pengarangnya yaitu As-Syaikh Muhammad Yahya Aman, akan tetapi terdapat di dalamnya banyak kesalahan tekstual dan beberpa kata yang terhapus, oleh karena hal itu Peneliti mencarikan manuskrip kitab tersebut sehingga dapat informasi bahwa manuskripnya sudah tidak ditemukan lagi, cuman setelah itu peneliti mendapatkan naskah cetakan kitab itu dengan koreksian pengarangnya yang sangat membantu untuk mengkoreksi juga mengkaji ulang dalam penelitian ini.
Tujuan Penelitian: Menerbitkan sebagian dari kitab tersebut yg telah diteliti, dikaji ulang dan dikoreksi sesuai dengan tata cara yang sekiranya ditujukan dan diinginkan oleh pengarang kitab tersebut. Juga memabahas tentang kitab Alluma' dan Pengarangnya, juga tentang kitab Nuzhatul Musytaq, pengarangnya, metode pembahasannya dan menjelaskan kelebihan juga kekurangan dari kitab tersebut.
Metode Penelitian: Peneliti memilih Metode Documenter dan Metode Kritis untuk penelitian dalam kitab tersebut. Dan memulai dengan pembukaan yang mencakup atas Pembahasan sekitar matan Alluma’ juga pengarangnya syaikh Syirazi. Dan Pembahasan sekitar kitab Nuzhatul Musytaq. Kemudian peneliti membahas tentang biografi Pengarang yaitu Syaikh Muhammad Yahya Aman juga Mengkaji keadaan Politik, keilmuan dan pengembangan Ilmu Ushul Fikih dalam pembelajaran dan pengarangan pada abad 14 hijriyyah masa kehidupan pengarang tersebut. Juga melakukan komparasi kitab Nuzhatul Musytaq dengan kitab Bughyatul Musytaq karangan Syaikh Muhammad Yasin Al-Fadani, dan menjelaskan perbedaan terpenting yang membedakan satu kitab dengan yang lainnya. Kemudian meneliti teks kitab Nuzhatul Musytaq dari awal sampai akhir pembahasan hakikat dan Majas. Juga merujukkan setiap pembahasan Ushul atau selainnya pada sumbar yang dianggap sebagai rujukan. Dengan mengkaji juga meneliti pendapat-pendapat para ulama yang terdapat dalam kitab tersebut. Juga menjelaskan biografi setiap orang yang tercantum namanya di dalam teks kitab tersebut dan menyebutkan rujukan setiap ayat dari Al-Qur'an, hadits-hadits Nabi saw dan bait-bait syair.
Simpulan dan Saran: peneliti mendapatkan kesimpulan bahwa kitab Nuzhatul Musytaq telah dicetak semasa hidup pengarang dan manuskripnya tidak ditemukan. Hal ini tidak menjadi penghalang untuk dijadikan sebagai bahan penelitian. Bahkan dianggap sebagai rujukan sekunder yang harus dijadikan referensi. Dan sisa kitab yang tidak diteliti dalam Tesis ini sangat pantas untuk diberi perhatian khusus supaya dijadikan bahan penelitian dengan metode yang ditetapkan dalam Ilmu Filologi
Membandingkan Konsep Pajak (Kharâj) Yahya bin Adam (758-818 H) dan Imam al-Mawardi (974-1058 H)
The rise of Islamic civilization since the 6 th century up to the 18 th century is a historical fact that can not be negated. Starting from the establishment of the State of Medina by the Prophet Muhammad until the Ottoman Dinasty. The course of history that sustained over centuries, has a significant influence on the development of Islamic civilization, at least in terms of taxation which commonly called as kharâj. In the hands of Islam, was created a various principles of the state, especially on the financial and monetary aspect. The creation of financial system for the state is one of proof for the creation of the state’s basic principles in order to achieve justice and prosperity of mankind. This paper aims to discuss in-depth analysis related to the concept of taxation in Islam through literature method. In order to obtain deeper analysis, the author chose two characters who was concerns in the field of taxation in the history of Islamic Economic thought, namely Yahya bin Adam in his al-Kharâj and Imam al-Mawardi in his al-Ahkâm al-Sultâniyah. The conclusion from this study is that there are some similarities between the two ideas. On the other hand, according to the author, Imam al-Mawardi’s theory of taxation has two advantages; first, his futuristic theory of taxation and second, his contextual theory of taxation that possible to be applied in the present time.
