Historical representation in the age of lost innocence: a study of Bernardo Bertolucci's and Gilbert Adair's adaptations of The Holy Innocents
Dissertação (mestrado) - Universidade Federal de Santa Catarina, Centro de Comunicação e Expressão. Programa de Pós-Graduação em Letras/Inglês e Literatura CorrespondenteThis research discusses the representation of French youth's culture in the late 60's in a postmodern context of critical debates, through a comparative analysis between Gilbert Adair's novel The Holy Innocents (1988), its filmic adaptation The Dreamers (2003) by Bernardo Bertolucci and Adair's second version of his novels The Dreamers (2004). Through the theoretical framework of Fredric Jameson's interpretation of art as a capital product and Linda Hutcheon's concept of historiographical metafiction, the analysis shall demonstrate that these texts represent the historical context of the May 68 uprise through a combination of nostalgia and irony. This combination results in a postmodern contradiction which indicates a need to revise history from a contemporary perspective in which longing and distance are two main issues. In this sense, historical representation becomes more than a view of the past, it is also a reflection on the postmodern context.
Bernardo Cappello (Venezia 1498 ca.-Roma 1560), member of one of the oldest patrician families of Venice, played an active role in the politics of the Venetian Republic, until his exile in 1540. After that, he became a collaborator and a protégé of cardinal Alessandro Farnese, who is one of the most significant figures of the century. Then he took refuge in Rome, where over the years he held varied appointments. Since his youth and in parallel with his political career, Cappello constantly devoted himself to humanistic studies and to rhymes production: pupil of Pietro Bembo, interlocutor of Giovanni Della Casa and close friend to Bernardo Tasso, the author is among the greatest exponents of the sixteenth-century Petrarchism. For the first time the critical edition of Rime by Bernardo Cappello is here given, namely the book of 353 compositions that the author elaborated on the pattern of Bembo’s directives, over a large period of time. In his book of poetry (canzoniere), through lyrical pieces, the author creates his own existential and biographical path. Regarding the evolution of the architecture of Cappello’s collection, four witnesses survived, in which we distinguish different phases: the first one is genetic and manuscript (Roma, Biblioteca Casanatense, 277), with addition of corrections that generally are close to the textual variants of the princeps; the second is the print of 1560 for the press of the Guerra brothers; finally, a further evolutionary stage is represented by two postillated prints. To these witnesses a rich miscellaneous tradition is added, which, for a large number of rhymes, restores the elaborative complexity through multiple genetic forms. Poems ousted from the ancient print, but part of the canzoniere in other phases of composition, are included in this critical edition
Se presta especial atención a los investigadores que han dedicado sus conocimientos a detectar huella de influencia clásica grecolatina en la obra...The first part of the work contains the presentation of the work to be studied, the epic poem entitled Bernardo and contextualizes its author, the Spanish writer Bernardo de Balbuena, within his time, the Golden Age, and in the literary stream –late Renaissance or baroque– in which it was framed. Balbuena composes an epic-chivalrous poem about the Leonese hero Bernardo del Carpio in which the author follows the flow of the romanzi influencers of the Tuscan language, especially the Orlando furioso of Ariosto and also of the Orlando innamorato of Boiardo. The biography of Bernardo de Balbuena is briefly reviewed, from his birth in Valdepeñas, going through the beginning of his professional career –ecclesiastical and literary– in Mexico, his return to Spain and his death in Puerto Rico, where he served as bishop. In Balbuena's work there is a clear global correlation with that of Virgil. The different opinions and comments that the Bernardo has registered since the time it was published until today are also reviewed. Special attention is given to researchers who have dedicated their knowledge to detecting a classic Greco-Roman influence in the work...Fac. de FilologíaTRUEunpu
Embargo status: Restricted until 09/2024. Bernardo Guimarães, social thinker
Bernardo Guimarães, literary work synthesizes more a disorganized and incoherent complex of themes, projects and visions of world that were part of the intellectual, political and cultural environments experienced by the author than an organized project. In this study, I will devote an effort aiming at elucidating how Bernardo Guimarães presents his narrators and characters establishing their routines and refl ecting about major and minor political and social concerns that surrounded him, such as violence, family relationships, slavery, indigenous and civility problematics and the relationships between the urban area and rural area
Defining the Role of Courts and Administrative Bodies in Private Enforcement in Europe: United in Diversity?
This study is a follow-up to a survey conducted by the author in the framework of Euro-Comp-Aid, a networking programme co-funded by the European Commission, DG Competition, and directed by the author. Several experts, mainly from National Competition Authorities (NCAs) of the EU Member States, answered a questionnaire drafted by the author of the study. The study reflects on some of the most interesting results of the survey, as to the actual impact of cooperation tools provided for by Article 15 of Regulation 1/2003. It also addresses the ways in which the legal systems of Member States complement Article 15 cooperation tools especially as concerns NCAs. Such national mechanisms of cooperation between courts dealing with private enforcement cases and public enforcement authorities are assessed by taking into account their soundness in the framework of the modernization and decentralization of EU competition law and some concerns about possible inconsistencies with the system designed by Article 267 TFEU. Due account is also taken of the role played by NCA public enforcement findings before civil courts dealing with private enforcement follow-on actions. First of all, the article analyzes the effective role as amicus curiae role played by the German Bundeskartellamt before German courts, stressing on the other side the unsatisfactory consideration German Supreme Court gives to the preliminary ruling mechanism. Then, the French Autorité de la Concurrence position as an amicus curiae is considered, noting in particular the interesting French approach to disclosure of public enforcement files, strictly intertwined with the amicus curiae role of the Authority; another issue which gives interesting hints on a question of general interest in the field, is that of coordination between NCA and Commission's interventions before national Courts. The focus is then on British NCAs role as amici curiae, where the more general question is addressed of the relationship between general courts and specialized competition courts entrusted with judicial review over NCA acts, in light of the decentralized nature of the EU competition law enforcement system, and of the sincere cooperation principle of EU law. Again, as for the German approach, an unsatisfactory consideration of Art. 267 TFEU procedures is observed. The Italian model is then analyzed, based on a strict separation between administrative and judicial functions, which requires a strict reading of the res indicate effect of EC decisions and will eventually make the enactment of the enforcement directive a quite delicate issue. As for the French approach, the usefulness of resorting to general tools of the law of evidence is stressed, instead of relying too much on (not satisfactory) tools of direct cooperation. The position of the Spanish Comisión Nacional de la Competencia in the EU decentralized system of competition law enforcement is then taken into consideration, by stressing not only the active role public enforcement authorities can have before Spanish civil courts, but also the useful assistance they can provide to courts in damage assessment. The complementarity between special EU law cooperation tools, and general tools provided for by national law is then highlighted when it comes to the assessment of the Swedish legal system; at the same time, the analysis of Swedish practice shows the decisive role such cooperation might have in interim proceedings, as well as the risks inherent in such situations.
Further, some other Member State legal systems are taken into account, that seem to have gone further than EU law itself in providing for cooperation between civil courts entrusted with private enforcement and public enforcement agencies, by setting some forms of reinforced and even structural connection between the two sides of competition law enforcement. This is the case of Malta, Latvia and Romania. In all of these Member States, a system is put in place, which goes to a certain extent beyond the model of smooth cooperation outlined by Article 15 Regulation 1/03. Such approaches might favor the effectiveness of EU competition law enforcement. In some cases, however, the risks arises of compromising the unitary character of EU competition law. The role of preliminary rulings proceedings under art. 267 TFEU remains therefore essential. Czech, Slovakian, Luxembourgish and Bulgarian systems are finally considered.
Besides making apparent obvious differences existing among various Member States, the study shows the need for a more comprehensive and coherent approach to cooperation between courts dealing with private enforcement cases and administrative authorities entrusted with public enforcement powers. It also shows the need to preserve the European Court of Justice’s role in ensuring the uniform interpretation of EU competition law, which some national approaches risk jeopardizing

A hitherto unpublished painting of a Woman Potting a Sapling, recently acquired by the Pinacoteca Tosio Martinengo in Brescia, is here attributed to the Danish artist Eberhard Keilhau (1624-1687), better known in Italy as Monsù Bernardo. In addition to discussing the style of the canvas in order to establish its likely date in the mid-1650s, the author focuses on its iconography, identifying a pendant image in another work already ascribed to Monsù Bernardo, a Woman Holding a Sapling
