The status of Anas bin Malik’s narrations in Hanafi corpus - An applied analytical study
يتجه هذا البحث لمعالجة مسألة أصولية نسبها عيسى بن أبان إلى الحنفية، ألا وهي ردهم حديث الصحابي غير الفقيه إذا خالفت روايته القياس، وقد مثل تلامذته بعده لهؤلاء الصحابة بأبي هريرة وأنس بن مالك وآخرين، فأردت أن أجمع مسند أنس-لا أبا هريرة نظرًا لكثرة ما كتب بحقه- من مدونة الفقه الحنفي الكبرى، ثم أبحث في مَواطن العمل بأحاديثه ومواطن العدول عنها، ثم أُخضع هذه النتائج للتحليل والتأمل، للوصول إلى أسباب هذا الإعمال أو العدول، ومن ثم أصل إلى حكم أغلبي يضم جزئيات المسألة بحيث يمكن لنا أن نحدد مدى دقة وانطباق ما ذكره عيسى بن أبان على عمل الحنفية وتطبيقاتهم في الفروع.
وقد أتت النتائج مرجحةً أن الحنفية اعتبروا فقه الراوي في مسائل معينة خصوصا في ميدان ترجيح رواية الفقيه على الأقل فقها، أما منزلة حديث أنس بن مالك فكانت كغير من الصحابة بلا تمييز بين فقيه وغير فقيه، بل أعملوا قواعدهم الأخرى في مجال الموازنة بين القطعي والظني، وأخذوا بأحاديث أنس في مواطن كثيرة بل ورجحوها في أحيان أخرى على مرويات لصحابة أكثر فقها، بل ورجحوها على القياس كثيرا، وعلى القواعد أحيانا على خلاف بينهم. بما يشير إلى أن قاعدة ابن أبان تحتاج إلى إعادة نظر من جهة كونها توصيفًا لمذهب الحنفية.This research aims to discuss the usul principle of disregarding the narration of the non-jurist companion when it contradicts the qiyas (analogical reasoning) that Isa ibn Abban attributed to the Hanafi school of law. Many of his students mentioned Abu Hurayrah, Anas bin Malik, and others as examples when discussing this principle. This research will analyse this issue by collecting the narrations of Anas from the books of Hanafi jurisprudence and will investigate both the incidents in which the Hanafis utilized these narrations and the incidents in which they disregarded them. I will then subject my findings to various forms of analysis in order to understand the reasons for the rejections of such narrations. All of this will be used to reach a grneral conclusoion that evaluates the statement of Isa ibn Abban regarding Hanafi usul and their application within their jurisprudence. This research concludes that the Hanafis did, in fact, give consideration to the narrator’s knowledge of jurisprudence in certain matters, especially when preferring the narrations of a jurist narrator to a non jurist narrator. However, the status of the narrations of Anas bin Malik, in particular, was considered the same as those of the other companions. Rather, the Hanafis referred back to their other principles of distinguishing between the decisive and non-decisive texts, accepted the narrations of Anas in many places, and sometimes even favoured them over traditions narrated by companions better known for their knowledge of jurisprudence, over qiyas (analogous reasoning), and over other principles. This conclusion indicates that the argument put forth by Isa ibn Abban describing this Hanafi usul principle is in need of further consideration
Infrastructure bottlenecks, private provision, and industrial productivity : a study of Indonesian and Thai cities
This research project followed an earlier similar project on Nigeria, applying the same methods. A sample of manufacturers was surveyed to document their responses to infrastructure deficiencies in electricity, water, transport, telecommunications, and waste disposal. They found the manufacturers undertook significant expenditures to offset deficiencies in publicly provided infrastructure services, and that changing public policy toward privately supplied infrastructure and changing the pricing of public infrastructure could yield significant savings in social costs. Thailand and Indonesia have made significant strides in following the policies for private sector participation in infrastructure provision. Nigeria, where public infrastructure monopolies still dominate, lags behind, yet stands to benefit most from such policy reform. Environmental influences on moult and movement strategies in southern African waterfowl
Includes abstract.Includes bibliographical references.Waterfowl annual life history events in north-temperate regions are driven primarily by predictable seasonal variations in temperature. In contrast, the spatio-temporal availability of adequate resources to waterfowl in the semi-arid regions of southern Africa is determined by rainfall which is extremely variable in timing and intensity. I studied the environmental influences on flight-feather moult and movement strategies of southern African waterfowl. Six duck species that are fairly common in most parts of South Africa were selected for the study, namely; Egyptian Geese, Alopochen aegyptiaca, Spur-winged Geese, Plectropterus gambensis, South African Shelducks, Tadorna cana, Yellow-billed Ducks, Anas undulata, Red-billed Teals, A. erythrorhyncha and Southern Pochards, Netta erythrophthalma. I chose two study sites to represent the extremes of environmental conditions in southern African, namely Barberspan (summer-rainfall region) and Strandfontein (temperate winter-rainfall region). I investigated the underlying responses of Afrotropical waterfowl to stochastic varying environmental conditions in southern Africa and the life-history strategies they have evolved to cope with this variability. Electrochemistry as a Powerful Tool for Investigations of Antineoplastic Agents: A Comprehensive Review
Cancer is most frequently treated with antineoplastic agents (ANAs) that are hazardous to patients undergoing chemotherapy and the healthcare workers who handle ANAs in the course of their duties. All aspects related to hazardous oncological drugs illustrate that the monitoring of ANAs is essential to minimize the risks associated with these drugs. Among all analytical techniques used to test ANAs, electrochemistry holds an important position. This review, for the first time, comprehensively describes the progress done in electrochemistry of ANAs by means of a variety of bare or modified (bio)sensors over the last four decades (in the period of 1982–2021). Attention is paid not only to the development of electrochemical sensing protocols of ANAs in various biological, environmental, and pharmaceutical matrices but also to achievements of electrochemical techniques in the examination of the interactions of ANAs with deoxyribonucleic acid (DNA), carcinogenic cells, biomimetic membranes, peptides, and enzymes. Other aspects, including the enantiopurity studies, differentiation between single-stranded and double-stranded DNA without using any label or tag, studies on ANAs degradation, and their pharmacokinetics, by means of electrochemical techniques are also commented.
