The Wind of Change. On Some EU-related Transformations of German and French Judicial Discourses
No full textThe ‘transformative power of Europe’ is a promising standpoint to shed light on national attitudes and beliefs formed in the course of centuries, as well as on paths taken by legal systems more recently.
The paper seeks to unravel some - more or less cryptic - legal changes driven by the EU integration process in both the German and the French judicial discourse.
In doing so, it argues that the souveraniste stance taken by the Bundesverfassungsgericht, as well as the ‘constitutional identity’ turn of the Conseil constitutionnel, contain the seeds of a new representation of what German and French constitutional judges consider to be their role in the relationships between EU law and domestic law

Le ragioni di questa eccezione culturale sono da ricercare in strutture di pensiero che hanno dato vita ad una sorta di memoria collettiva, il cui oggetto principale non è il carattere passato del passato, bensì la presenza del passato. L’autrice indaga tale eccezione non solo retrospettivamente ma anche prospetticamente, riflettendo in modo particolare sulle evoluzioni che il diritto costituzionale francese ha conosciuto nel corso di questo primo scorcio di secolo, e su quelle che potrebbero realizzarsi in un futuro più o meno lontano

No full textLeon Duguit figura tra gli interpreti più illustri e acuti delle trasformazioni economico-sociali che hanno investito l’Europa e in particolare la Francia alla fine del XIX secolo . Lungi dal rappresentare un fenomeno isolato, la sua enfasi sul “sociale” si inscrive in un complesso movimento che dall’Europa si è diffuso su scala globale, e che in Francia ha avuto come precondizione l’insofferenza verso l’approccio esegetico, e in modo particolare verso la tendenza a ridurre l’essenza del diritto alla legge positiva . L’originalità del progetto di Duguit sarebbe tuttavia destinata a restare incompresa laddove non si tenessero in debita considerazione i riferimenti culturali che lo pervadono e dai quali trae costante alimento. Basti dire che nella storia della revisione critica della scienza giuridica francese, nessuno ha così energicamente fatto del richiamo al “sociale” una “necessità”, dotata della stessa obiettività delle leggi fisiche. Da questo punto di vista, ciò che a distanza di più un secolo ancora colpisce delle sei conferenze tenute da Duguit a Buenos Aires, poi confluite nelle “Les transformations générales du droit privé depuis le Code Napoléon”, è il radicale tentativo che esse rappresentano di recepire quella tradizione teorica di rigido positivismo sociologico che, da Comte a Durkheim, muoveva dall’idea fondamentale secondo la quale la realtà ci presenta costantemente dei dati oggettivi, e che da questo fatto occorre prendere le mosse per produrre costruzioni capaci di darne conto e di interpretarli
Going Beyond Counting First Authors in Author Co-citation Analysis
Full text linkThe present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation
counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed
Variations on the Author
Full text link“Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship

Si tratta, peraltro, di percorsi noti e che tuttavia a noi sembrava di poter rivisitare non in una mera ricognizione storico-storiografica, ma rimisurando il tutto con i modi della biologia e della filosofia contemporanee. E allora Darwin, Nietzsche, von Uexküll, Heidegger, Portmann, Arendt, “come se”, al di là delle specificità dei discorsi, potessero ibridarsi su di uno sfondo comune che, va da sé, è impuro perché è il nostro e non necessariamente il loro. Non tre testi separati, e nemmeno riuniti artificiosamente col senno di poi: volevamo che i differenti dettati – per quanto diversi nei tempi, nei modi, nei temi, negli autori e negli attori – alla fine si incontrassero e si contaminassero
Appropriate Similarity Measures for Author Cocitation Analysis
Full text linkWe provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature. Images in cardiovascular medicine voluminous left main stem to pulmonary artery fistula: A conservative approach
No full textThe presence of a coronary arteriovenous fistula is almost rare in the adult population, even rare when associated with aortic valve insufficiency. Management and treatment options can vary and depend on a single patient. In our case, a large fistula with a rounded origin started from the roof of the left main stem, just attached to the wall of the aortic root, and finished with a very narrowed end in the pulmonary trunk. Due to its anatomical position and to the potential complications related to a proximal surgical closure as well as the incidental discovery in adult age (without signs or symptoms until the operation), we decided to have a conservative approach, leaving untouched the fistula. No intraoperative, perioperative, and follow-up signs of myocardial ischemia were observed
