The margin of appreciation doctrine and the right to life : the article 2 of the ECHR
Get PDFThe margin of appreciation is proving to be an increasingly fundamental mechanism when it comes to human rights since the protection given to such rights varies from state to state, and from time to time, depending on their beliefs and traditions. The purpose of this thesis is not only to explain the concept of the margin of appreciation and its evolution throughout time but also to establish the relationship of this doctrine with the right to life, enshrined in Article 2 of the European Convention on Human Rights. Thus, and because it becomes interesting from a comparative perspective, the legal regime of three Member States of the Council of Europe, at the time of writing, will be indicated.A doutrina da margem nacional de apreciação revela-se um mecanismo cada vez mais fundamental no que toca aos direitos humanos, uma vez que a proteção dada a tais direitos varia de Estado para Estado, e de tempo em tempo, consoante as crenças e as tradições daqueles. Esta tese tem como objetivo não apenas dar a conhecer o conceito de margem nacional de apreciação e a sua evolução, mas também estabelecer a relação de tal doutrina com o direito à vida, previsto no artigo 2.º da Convenção Europeia dos Direitos Humanos. Deste modo, e por se afigurar interessante do ponto de vista comparativo, indicar-se-á o regime legal, à data da escrita da dissertação, de três Estados membros do Conselho da Europa

Get PDFCatólica Porto Law School of Portugal annually awards dozens of students a master\u27s degree in law, in seven areas of specialization, as well as a master\u27s degree in law and management. In order to give visibility to the result of the research, the Católica Porto Law School took the decision to publish the master\u27s dissertations that obtained the highest classifications. Thus, the best master\u27s dissertations whose exams have been completed until December 8 of the previous calendar year are published annually. This dissemination allows us to share quality research with the rest of the scientific community. In addition, it is an incentive for the qualification of the research of master\u27s students in Law and in Law and Management. It is our conviction that this initiative contributes to a fruitful sharing of knowledge and that it allows the opening of a path of dialogue with the legal community and civil society. This issue includes thirty-one dissertations. They are presented in alphabetical order by author and cover areas as diverse as Criminal Law, International and European Law, Company and Business Law, Labour Law, Administrative Law, Tax Law, and Private Law.
The coordination of this project intends to publicly acknowledge the meticulous and dedicated work of Dr. Isabel Ferreira.A Escola do Porto da Faculdade de Direito da Universidade Católica Portuguesa atribui, anualmente, a dezenas de estudantes, o grau de mestre em Direito, em sete áreas de especialização, bem como o grau de mestre em Direito e Gestão. Com o intuito de dar visibilidade ao resultado da investigação, a Escola do Porto da Faculdade de Direito tomou a decisão de publicar as dissertações de mestrado que obtiveram as mais elevadas classificações. Assim, são publicadas, anualmente, as melhores dissertações de mestrado cujas provas se tenham realizado até ao dia 8 de dezembro do ano civil anterior. Esta divulgação permite partilhar investigação de qualidade com a demais comunidade científica. Para além disso, constitui um incentivo para a qualificação da investigação dos mestrandos em Direito e em Direito e Gestão. É nossa convicção que esta iniciativa contribui para uma profícua partilha de conhecimento e que permite a abertura de uma via dialogante com a comunidade jurídica e a sociedade civil. O presente número integra trinta e uma dissertações. São apresentadas por ordem alfabética de autor e abarcam áreas tão diversas como o Direito Criminal, o Direito Internacional e Europeu, o Direito da Empresa e dos Negócios, o Direito do Trabalho, o Direito Administrativo, o Direito Fiscal, e o Direito Privado.
